HomeMy WebLinkAboutResolution 90-399 12/10/1990Resolution No. 90-399 N C.S. of the City of Petaluma, California 1 DECLARING CANVASS OF RETURNS AND RESULTS 2 OF THE REGULAR MUNICIPAL AND PETALUMA HIGH SCHOOL BOARD 3 AND CHARTER AMENDMENT ELECTIONS 4 HELD NOVEMBER 6, 1990, WITH THE s STATEWIDE GENERAL ELECTION 6 WHEREAS, the City of Petaluma conducted a Regular Election on November 6, ~ 1990, in conjunction with the Statewide General Election; and, s WHEREAS. the City of Petaluma also conducted a Special Election Consolidated 9 with the Regular Election to submit a proposed Charter amendment to add io Section 83 which reads as follows: 11 Measure E -Shall Section 83 be added to the City Charter which states: l2 "Section 83 -Voter Approval Reduired of Arbitrator's Awards -Wages, 1.3 benefits or employee-related expenses which have not been approved by ~4 resolution of the City Council and which are the result of binding fact-finding 1s or binding arbitration may not be imposed on the taxpayers of Petaluma 1~ without approval of the voters as set forth in this section. Notwithstanding any t~ other provision of this Charter, such expenses shall not be paid by the City s until additional revenues and appropriations therefor have been approved by ~~ vote of the people pursuant to California Constitution Article XIII A, Section 20 4 and Article XIII B, Section 4. The City Council shall not be required to call 2] an election to approve such additional revenues and appropriations more than 22 once a year and may consolidate said elections with elections held for other 23 purposes." 24 WHEREAS, the City of Petaluma also conducted a Special Election, on an initiative 2s measure which was certified by the City Clerk, to submit a proposed Charter 2C, amendment to add Section 82 which would read as follows: 27 Measure F -Shall Section 82 be added to the City Charter which states: 2s "Section 82: Police and Fire Binding Arbitration. 2~) Section 1. Declaration of Policv. It is hereby declared to be the policy of the 3o City of Petaluma that strikes by firefighters and police officers pose an 31 imminent threat to public health and safety and should be prohibited, and that Resolution Canvassing November 6, 1990, Election Page 1 of~pages i~~:G. N~~..90-3,99......._. N.cs. 1 a method should be adopted for peacefully and equitably resolving disputes 2 that might otherwise lead to such strikes. 3 Section 2. Prohibition Against Strikes. No City of Petaluma police officer or 4 firefighter employee, employee union, association or organization shall, strike 5 or engage in such concerted economic activity against the City of Petaluma. 6 Disputes unresolved by negotiations should be resolved by the arbitration 7 procedure set forth herein. Any such employee who fails to report for work s without good and just cause during said negotiations or who aids, abets or 9 encourages strikes, or other such economic activity against the City of 10 Petaluma during such time shall be subject to disciplinary action, including, 1.i but not limited to termination from the City of Petaluma employment, subject 12 to the provisions of this Charter, the City's Personnel Rules and Regulations 1.3 and lawful procedures. 14 Section 3 . Obligation to N~otiate in Good Faith. The City, through its duly 15 authorized representatives, shall negotiate in good faith with the recognized 16 fire and police department employee organizations on all matters relating to i~ the wages, hours, and other terms and conditions of the City employment, 1.s including the establishment of procedures for the resolution of grievances 19 submitted by either employee organization over the interpretation or 20 application of any negotiated agreement including a provision for binding 21 arbitration of those grievances. Unless and until agreement is reached 22 through negotiations between the City and the recognized employee 23 organization for the fire or police department or a determination is made 24 through the arbitration procedure hereinafter provided, no existing benefit or 25 condition of employment for the members of the fire department or police 2G department bargaining unit shall be eliminated or changed. 27 Section 4. Impasse Resolution Procedures. All disputes or controversies 28 pertaining to wages, hours, or terms and conditions of employment which 29 remain unresolved after good faith negotiations between the City and either 3o the fire or Police Department employee organization shall be submitted to a Reso. 90-399 N.C.S. Resolution Canvassing November 6, 1990, Election Page 2 of~opages 1 three-member Board of Arbitrators upon the declaration of an impasse by the 2 city or by the recognized employee organization involved in the dispute. 3 Representatives designated by the City and representatives of the recognized 4 employee organization involved in the dispute, controversy or grievance shall 5 each select one arbitrator to the Board of Arbitrators within three (3) days 6 after either party has notified the other, in writing, that it desires to proceed to 7 arbitration. The third member of the Arbitration Board shall be selected by s agreement between the two arbitrators selected by the City and the employee 9 organization, and shall serve as the neutral arbitrator and Chairman of the to Board. In the event that the arbitrators selected by the City and the employee i1 organization cannot agree upon the selection of the third arbitrator within ten 12 (10) days from the date that either party has notified the other that it has 13 declared an impasse, then either party may request the State of California 14 Conciliation Service to provide a list of seven (7) persons who are qualified 15 and experienced as labor arbitrators. If the arbitrators selected by the City 1.6 and the employee organization cannot agree within three (3) days after receipt 1~ of such list on one of seven (7) to act as the third arbitrator, they shall 18 alternately strike names from the list of nominees until only one name remains 1~ and that person shall then become the third arbitrator and chairman of the 20 Arbitration Board. 21 Any arbitration convened pursuant to this article shall be conducted in 22 conformance with, subject to, and governed by Title 9 of Part 3 of the 23 California Code of Civil Procedure. 24 At the conclusion of the arbitration hearings, the Arbitration Board shall 25 direct each of the parties to submit, within such time as the Board may 26 establish, a last offer of settlement on each of the issues in dispute. The 27 Arbitration. Board shall decide each issue by majority vote by selecting 28 whichever last offer of settlement on that issue it finds most nearly conforms 29 with those factors traditionally taken into consideration in the determination 30 of wages, hours, and other terms and conditions of public and private 31 employment, including, but not limited to, changes in the average consumer Reso. 90-399 N.C.S. Resolution Canvassing November 6, 1990, Election Page 3 of6pages 1 price index for goods and services, the wages, hours, and other terms and 2 conditions of employment of other employees performing similar services, and 3 the financial condition of the City and its ability to meet the cost of the award. 4 After reaching a decision, the Arbitration Board shall mail or otherwise 5 deliver a true copy of its decision to the parties. The decision of the 6 Arbitration Board shall not be publicly disclosed and shall not be binding until ~ ten (10) days after it is delivered to the parties. During that ten-day period the 8 parties may meet privately, attempt to resolve their differences, and by mutual 9 agreement amend or modify any of the decisions of the Arbitration Board. At to the conclusion of the ten-day period, which may be extended by mutual 11 agreement between the parties, the decision of the Arbitration Board together 12 with any amendments or modifications agreed to by the parties shall be 13 publicly disclosed and shall be binding upon the parties. The City and the 14 recognized employee organization shall take whatever action is necessary to 15 carry out and effectuate the award. 16 The expense of any arbitration convened pursuant to this article, including the 1~ fee for the services of the Chairman of the Arbitration Board, shall be borne 18 equally by the parties. All other expenses which the parties may incur 19 individually are to be borne by the party incurring such expenses." 20 WHEREAS, the Municipal Election was held in the City of Petaluma on November 21 6, 1990; and, 22 WHEREAS, the votes from said election were received and canvassed by the 23 Sonoma County and Marin County Elections Departments (Exhibit A to this 24 resolution), and the returns thereof were ascertained and declared in all 25 respects as required by law: Reso. 90-399 N.C.S.
