HomeMy WebLinkAboutResolution 90-423 12/17/1990 - Resolution No. 90,4;3 N.C.S. 1 of the City of Petaluma, California 2 3 APPROVING EXTENSION OF 1990 ALLOTMENTS 4 FOR OAKVIEW ESTATES SUBDIVISION 5 6 7 WHEREAS, the City of Petaluma has adopted a Residential Growth Management 8 System's Ordinance; and 9 10 WHEREAS, Oakview Subdivision was granted 22 1990 allotments pursuant to the 11 Residential Growth Management System Ordinance in 1989 by the City Council; and 12 13 WHEREAS, Section 17.26.070(F) of the Residential Growth Management System 14 Ordinance (Chapter 17.26 of the Municipal Code) establishes a deadline of December 31st 15 of the year said allotments are granted for, as the date by which certain projects must have 16 either an approved tentative map or have been through preliminary review and have had 17 their project application deemed completed by the Community Development Department; 1.8 and 19 20 WHEREAS, Section 17.26.070(G) of the Residential Growth Management System 21 Ordinance requires projects subject to the growth management system to have completed 22 approval of all related documents on or before December 31st of the year for which the 23 allotments have been granted or said allotments shall be forfeited; and 24 25 WHEREAS, with appropriate findings, the City Council may extend the December 31st 26 deadline for projects approval and forfeiture of allotments; and 27 28 WHEREAS, a Draft Environmental Impact Report for Oakview Estates will be completed 29 and will require review by the City beyond December 31, 1990; 30 31 WHEREAS, staff has determined that one year is ample time to complete processing the 32 application; 33 34 NOW, THEREFORE, BE IT RESOLVED that the City Council hereby extends the 35 forfeiture deadline of December 31, 1990 to December 31, 1991 for 22 1990 allotments 36 granted to Oak View Estates based on the following findings: 37 ~~~5.
