Joe Edward and City`Councihnembers On the Agenda Bill for February 5, 2001 there are 3 agenda items which are considering authorizing the issuance of Certificates of Public Convenience and Necessity to 3 different taxi companies. I Greg McCord, owner of A-1 Taxi Company of Petaluma must contest the approval of the applications of Rohnerf Park Taxi and Hometown Taxi on the following grounds: Petaluma Municipal Code, Chapter 14, Transportation and Utilities, Number 14.14.0200 Section B states the following: "The number, kind, color markings and trade style of the proposed taxi cabs in relation to taxis already in operation". The,purpose of this code is to avoid confusing the general public and the police department of Petaluma. In the 7 years that I have been in the transportation industry I do not know of any city that allows 2 taxi companies with the:same;general color. Both Hometown Taxi and Rohnert Park Taxi are proposing to use white taxicabs. A-1 Taxi of Petaluma has been running white taxis for nearly? years. Therefore I must respectfully object to 2 new companies entering the marketplace with the same or similar color schemes. In addition it should be noted that in 1995 George's Yellow Cab, Inc;submitted an application for taxi permits that was rejected by the councilmembers of Petaluma for this very reason. V Lastly, I am protesting Rohnert Park Taxi's and Hometown Taxi's permits for the reason of diluting:the marketplace. I am not opposed to competition in the marketplace. However it does not serve the citizens of Petaluma by quadrupling the number of taxi companies services the area • By admitting 3 additional companies into the marketplace you will undoubtedly jeopardize the health and viability of A-1 Taxi of Petaluma. A- 1 Taxi of Petaluma has been faithfiilly serving the citizens of Petaluma nearly 7 years. Thank you for your cooperation in this matter. EXECUTIVE SUMMARY: The City has received an application from Gary and Paula.Brown of Hometown Taxi (a transportation company located in the City• of Rohnert Park);; requesting approval of a Certificate of Public Convenience and Necessity to authorize the operation of a 20-hour (6 AM-2 AM, Monday through Saturday; 6 AM-midnight Sunday), 6-cab taxi service inside Petaluma city limits: Hometown Taxi will continue to store the Hometown Taxis in Rohnert Park. The base for all operations, dispatch and vehicle storage, will be in Rohnert Park. 2. BACKGROUND: Petaluma Municipal Code Chapter 14.20 regulates taxicab operations addressing the number of passengers, routes, fares, etc. Chapter 14.08.070 limits the ratio of taxicabs to, city population, the number of which may not exceed one cab per,fifteen hundred persons within the city. Based on the California State Department of Finance's Population and 'Housing estimates of California Cities and Counties, the population of Petaluma is ,52,985. Therefore a maximum 0,35 taxis;may operate within the City. There is currently only one taxi company operating in the i City of Petaluma (A-1, which includes Yellow Cab, Belaire Cab, Radio Cab); they possess 18.Certificates of Public Convenience and Necessity in total. On August '8, 2000 staff received an application from Gary and Paula Brown (Hometown Taxi) requesting,6 certificates, on August 9, 2000, Max.Jacobsen (Rohnert Park Taxi)requested 6 certificates, and on September 6, 2000 Kevin Kroh (AC Taxi) requested 6 to 17 certificates. On September 13, 2000 Mr. Jacobsen°filed an,amendment to his application by requesting an,additional 4 certificates for a total of 10. Given that-there are%only 17 Certificates available, staff requested advice from the City Attorney as to how to recommend distribution of the certificates to council, and im what order to calendar the requests. It was the City Attorney's advice to ;adhere, to the order the •applications were received. Therefore, staff is presenting these requests as follows: Hometown Taxi/6 Certificates, Rohnert Park . Taxi/5 Certificates, AC Taxi/6 Certificates. It should be noted that with all companies involved, the permits when'issued would be at the prescribed limit`for'the City of Petaluma: Per Petaluma Municipal Code 14.16.020, the Police Department has performed the-required background investigation of Gary and Paula Brown. The mechanical fitness,:safety, cleanliness, appearance of each taxicab will be checked by Police personnel prior to commencement of operation pending council approval The Browns have provided the City with satisfactory evidence of their'insurance. Therefore; the Police Department is able to forward its recommendation to the City Council'that Hometown Taxi be. issued aCertificate of Public Convenience.and Necessity. • 3. ALTERNATIVES: a Adopt Resolution to approve a Certificate of Public Convenience and Necessity for Gary and Paula Brown to operate Hometown Taxi, .a 20-hour (6 AM-2 AM,-Monday through Saturday; 6 AM- midnight Sunday), 6-cab taxi service inside Petaluma city limits. 2 • • • Adopt resolution to deny a Certificate of Public Convenience and Necessity for Gary and Paula "Brown'to operate Hometown Taxi, .a 20-hour (6 AM-2 AM, Monday through Saturday; 6 AM- . -midnight Sunday), 6-cab taxi service inside Petaluma city limits. 4. FINANCIAL IMPACTS: N/A 5. CONCLUSION: Based'on the information provided by the applicant, and the data researched by the Police Department, it is recommended that the City Council issue a Certificate of Public Convenience and Necessity to Greg and Paula Brown authorizing the;operation of Hometown Taxi of Rohnert Park, a 20-hour (6 AM-2 AM, Monday through Saturday; 6 AM-midnight Sunday), 6-cab taxi service inside Petaluma city limits. 6. OUTCOMES OR PERFORMANCE-MEASUREMENTS THAT WILL IDENTIFY SUCCESS OR COMPLETION: Certificate of Public Convenience and Necessity will be issued. ' 7. RECOMMENDATION: Staff recommends that the City Council approve a Certificate of Public Convenience and Necessity for Hometown Taxi of Rohnert Park based on the.following conditions: 1. Hometown Taxi shall comply with all application provisions of Petaluma Municipal Code Title 14. 2. This Certificate of Public Convenience,and Necessity is hereby issued to Hometown Taxi of Rohnert • • Park authorizing the operation of a-20-hour per-day (6 AM-2 AM, Monday through Saturday; 6 AM- midnight Sunday), operation of six (6) taxicabs inside City of Petaluma city limits. All cabs shall be stored outside City limits: The dispatch center shall be located outside City limits. 3. The fare rates as. proposed by the applicant are hereby fixed, and may only be changed by City Council action. They are $2:00 at the-flag drop, $2:00 per mile thereafter. Senior discount shall be 10% for customers over 65. years of age and students Wait time shall be at the rate of$20.00 per hour. 4. The six (6) vehicles owned and operated by Hometown Taxi. shall be inspected by the Police Department prior to operationi inside City limits. Any defects uncovered during the inspection shall be corrected and the vehicle re-inspected by the Police Department. The six (6) taxis owned and operated by Hometown Taxi shall,besubject to their annual inspection June-30, 2001. 5. Any proposal for increase in the number of taxicabs shall be reviewed and approved by the City Council before expansion of service;is made. 6 Certificates issued to owners of taxicab companies and automobiles for hire may be suspended or revoked by the Council for violation of any the tefms'of such certificate or for misuse or abuse of the privilege thereby,granted. 7.
