Council meeting„City"personnel stated that they would be back to the Council this spring with a recommendation to proceed with eminent domain "proceedings in order to obtain the necessary right-of-way-for the McDowell/E.. Washington St. Transportation Improvement •' Project. • In order to insure that the contractor can-'start construction on' this project in ,June- 2001, the City Attorney's office needs to take any and all steps necessary to obtain the necessary rights of way for construction, including steps to be in a position to initiate eminent domain and if"necessary, to initiate said procedures assoon as possible. BACKGROUND: The McDowell Blvd./E. Washington St Intersection Transportation Improvement Project is composed of three alternatives that were chosen by the City;Council On October 4, 1999. Alternative 1 includes ransportation impro'vements,in the area of the intersection (see Exhibit C), Alternative,B-1 includes bicycle,and pedestrian improvements over Highway 101 from the northbound off-ramp of Highway,101..to Ellis Street on the west, and Alternative Cis.being studied for 5 bicycle lanes on both sides of E:'Washington St. from McDowell Blvd. to Adobe Road on the east The project has continued to use Alternatives 1, B-1, and C for identifying the specific improvements because each Alternative has its own funding, design, and.construction scheduling issues. 1 • The City Council directed City personnel,to;complete the-contract documentsto construct the Alternative].intersection improvements in 2001(see•Exhibit'C). Alternative B-1 and • C are scheduled for construction in 2002 because:these Alternatives'have Federal funds. The Federal funds require an NEPA environmentandocument, which could-take approximately 18 months to+complete and approve: As,partof the McDowell/E. WashingtonSt:Transportation-Improvement Project,the City has been:proceeding in acquiring the fee titles and easements needed.to.do the improvements. These acquisitions are mainly small.strips of property along•McDowell Boulevard. In all, eight;fee titles and twelve easements are required eight,property owners. The one'.structure that is;affected'by"the_right-of-way acquisition is the elimii ation.to two ofthe'eight.gasolinepnmps•at the Beacon Service Station. GeoffIdo•rnsby, the City's right-of-way consultants has submitted the,offers to the property owners and is continuing to negotiate with the owners for the fee titles and temporary easements. However,-in order to insure that>the contractor can start•work June 2004, staff is recommending that-the Council adopt the resolutions.of necessity authorizing-the City.Attornev, o •his designee, to file eminent domain lawsuits to obtain' orders for the•right:of entry to construct the City's project: The orders will:pemlit the: contractor to start-work on schedule: Through eminent domain,proceedings: a public agencycan, through.a court hearing; obtain immediate possession of property in order,to perform a public+project Once immediate possessio is;granted by the courts, fimdsto purchase-the properties.are filed �� n with the courts, and the•public project proceeds. This;procedure allows-time for the property owner and the City's right=ofwayconsultant(eminent domain appraiser), or(the courts, to arrive_at an agreement to ftnalize;the.purchase of needed property.- Mr. Hornsby will continue to negotiate with:the o vnersf of the properties. Lach•of the owners•was.advised by letter, copies of which!are.attached. that'the City would continue ' to negotiate with.them even if a resolution'of necessity is adopted. 'Government Code Section 7267,2 requires the City to submit-,written offers to the• owners. The offers must set fOrtif the basis for the City's offer`and"the:factual data supporting the offer: A 2/3.vote (5 Councilmembers) is required to adopt;a resolution of necessity. Project Schedule: Several key,project tasks•such as design,.right-of-way-acquisition, environmental review, • assessment district-formation, and utility reloCation coordination are beiig tracked simultaneously in ordertomeet the:City Council's goal of constructing the°intersection transportation;iinprovements in Alternative;l, in the'summer of 2001. The,bicvcleaand • pedestrian improvements in,Alternatives B-h:and C•arescheduled for 2002'in order to completethe environmental documents:necessary for securing,Federal funds:, The schedule for thetwophases of the improvements is shown on Exhibit-C_ Right-of-way acquisition continues to be the key'issue in the schedule. • 2 • • • 3. ALTERNATIVES: • a. Adepta resolution of necessity • b. Do not°adopPa,resolution of necessity and let the right-of-way consultant complete the right-of_waynegotiations. This alternative would:not insure that the needed right- of-way will be available by June 2001. Lack of right-of-way will delay the project and result in claitnstftdh thercontractor. c. Other combinations or options from the discussion by the City Council. 4. FINANCIAL IMPACTS: Right-of-wav cost The estimated cost'for'right-of-way-acquisition was,estimated in 1999 as $312,000. In October 2000, during'the preparation of the assessment district feasibility study; the estimated.cost for-right-o£way was increased to $803,000. This increase was to take into account the cost of purchasing fee simple and temporary construction easements from the Beacon Service Station. The:purchase of fee simple and temporary construction easements from the Beacon Station will enable the contractor to-construct the improvements without blocking"the travel lanes. •Atfthis time the cost of purchasing • right-of-way for all ofthe�other parcels_except'the Beacon Station,site, as included in these eminent domain proceedings is$471,000. The Beacon Station site is not included in this packet because one additional easement is needed from the-site. Once its cost is • determined, City:personnel wilhcome back to the Council'for approval to negotiate its purchase. Totalptoject cost estimate • An update of the project"s+estimated costs by the-design engineer for the three Alternatives 1, B-I, and C is shown on Exhibit F. The project's cost estimate in October 1 1999 is shown in the,top'block: The revised:project cost as of September 5, 2000 in shown in the middle.block. The project's'budget; as,shown in the 5-Year Capital Improvement Plan, i`s shown in the`bottoin'block'. The increase'in the design engineer's project cosr;estimate onSeptember,5'„2000 of $704,000 (for Alternate 1), includes the Landscape Conceptual Design A improvements for $335,000, the special concrete paver crosswalks for$134,000, and to'include replacing the approach lanes,on East.Washington St.;and McDowell Blvd: So. with concrete instead of asphalt for an added cost of$235,000: These additions were approved by the City Council on December 4,`2000. Ifis proposed that the Traffic Mitigation.Fund, PCDC, and an assessment district fund these:improvements. The estimated-cost for the bicycle and pedestrian improvements in Alternative B-1 (bicycle and pedestrian iinprovements over Highway 101) has remained the same. • 3 The-estimated cost for the bicycle and pedestrian improvements in Alternative C • (McDowell Blvd. to:Adobe Rd.) has increased to $3,046,000 (See,middle,block on Exhibit,F). The')ncrease of$671,000 is because of the cost of the improvements along Washington Creek from McDowelFBlvd. to Sonoma Mountain Parkway. An alternative•of installing 5-foot wide•bike lanes•.on both sides of Washington St. • from McDowell Blvd. to Sonoma Mountain Parkway (Alternate C)'is-;to`turn Lauren, Drive into a•bike boulevard. This wouldreduce the,cost of Alternate C;and is explained in more detail at the end Of this section. Once the appraisals are completed and accepted, and bids are received, the surplus funds will bereturned'to the properties being assessed. Alternative I includes transponation'improvements in,the area of the intersection (see E.YhioitL),:Alternative B 1 includes tricycle and,pedestrian'improvements over Highway 101' from the northbound off-ramp of Highway 101 to Ellis Street on the west. and Alternative Cis being studied for'bicycle improvements from McDowell,Blvd. to Adobe'Road on the east'(see Eshioit M). The project has continued to use AlternativesI; B-1, and C foreidentifyinethe•specific improvements because each Alternative has'its own tending, design, and construction issues. The City.Council has directed City personnel to complete the contract documents to construct the Alternative I intersection imorovements in 200 1(see Eehi it D Alternative B-I and C are scheduled • for construction in 2002 because these a lternatiues'have>Federal funds. The.Federal', • funds require nVEPA.environmental document,"which could',take anorotimately 18 months to complete and approve.. Assessment"Districi Formation: The formation of an assessment district to fund`a portion,ofthis project must follow the guidelines of State Proposition 213. The elaw'has specific idelines that must be met in order.for an assessment district to'beviable. Two of the;most important are 1) The properties being assessed•mustreceive a direct benefit'?from the improvement's, and 2) in,order for district to be formed,50% of the properties based on the dollaramount being assessed;must vote lin favorldf,the,assessment district: One of the,first`stepsin,the formation of an assessment district.was:the preparation of an assessment district feasibility study to deter nine if a;district is feasible. The Assessment District Feasibility Study,`which was presentedito the City'Council on October 2, 2000, discussed which aspects!of the project result in "special benefit"to'specificpropery owners•versus the"generalbenefit"to the'community,oulines'which properties receive the°"special benefit",.provided an estimated assessment districtcost and alternative methods'for spreading costs to parcels,and'-made a recommendation`for.apportioning the costs that works best for the property owners and the City. • The Assessment District Feastbiity Study recommended funding only a portion of •, Alternative,1 improvements at the-intersection, and the bicycle and pedestrian improvements in Alternatives B-1 or.C. This is for,two reasons>'One,the feasibility study found little to no"spec,ficbenefit" for the'bicycle`andp'edestrian improvements in. Alternatives and,C for the;properties being considered,in the assessment district; and Two,the=final cost of the assessment district, once established, should be set following the'acceptance of construction bids within a reasonable,time period. Bids for Alternative 1 itnprovemehts aie'due in the spring 61 2001. Because;the.Assessment:District Feasibility Study recommended that an assessment district be based on the,costs for.Altenative 1 only.and not all threealternatives of the project; the potential funding from ansassessment district is reduced from previous "estimates. The Feasibility Report recommended that 0%;,or 31,234;300 of the total cost of.Alternative"1 (S4,116,000), be"funded by the assessment district. Of the 30%, 24%ois being=assessed against private parcels within theproposediboundary, and c% is assessed against.the City's Community center'proper y.. The 309 share came from a destination survey, which°showed that 24%of the driver's entering the intersection during the . hours were'there to-go shopping or to a restaurant..The other 6%were there°to attend City recreation facilities. These percentages confirinedby the City's traffic mode!, The Assessment Engineer felt that'the Community Center should be part of the assessment district because it receiVes.a special benefit,;and its main entrance is served. by the same signalized intersection as;thePlaza North Shoppingl'Center, which is also in the proposed assessment district,.
