HomeMy WebLinkAboutResolution 2009-094 N.C.S. 06/15/2009Resolution No. 2009-094 N.C.S. of the City of Petaluma, California ADOPTING THE 2009-2014 HOUSING ELEMENT UPDATE AS AN AMENDMENT TO THE CITY OF PETALUIVIA GENERAL PLAN 2025 WHEREAS, State law requires California cities to prepare and adopt a general plan to guide future development of the city, including a Housing Element as one of the mandatory elements in a city's general plan; and, WHEREAS, on May 19, 2008, the City Council approved Resolution No. 2008-085 N.C.S., adopting its General Plan 2025, which contained the City's then-existing housing element; and, WHEREAS, State law requires that cities comprehensively update their Housing Elements at least once every five years to ensure their plans can accommodate .future demand for housing; and, WHEREAS, the City of Petaluma ("City") last updated its Housing Element in 2002; and, WHEREAS, the California Department of Housing and Community Development ("HCD") granted a two year extension of time to update housing elements for those cities within the Association of Bay Area Governments ("ABAG") from the date otherwise set forth in Government Code §65588(e)(2) to and including June 30, 2009; and, WHEREAS, the proposed 2009-2014 Housing Element Update ("Housing Element") therefore identifies and analyzes existing and projected housing needs and states goals, policies, quantified objectives and special programs for the preservation, improvement and development of housing in the City from 2009 through 2014; and, WHEREAS, the Housing Element has been prepared in conformance with the requirements of State law, including but not limited to Article 10.6 (Housing Elements) of the Government Code and was released. for preliminary review as a draft to HCD; and, WHEREAS, HCD made certain comments and requested certain changes to the draft Housing Element, which have been incorporated in the Housing Element prior to its consideration by the City Council; and, WHEREAS, on June 15, 2009, the City Council adopted Resolution No. 2009-093 N.C.S. approving a negative declaration of environmental impact, making findings and adopting a statement of overriding considerations in regard to the Housing Element, all in accordance with the requirements of Public Resources Code Sections 21000 et seq. ("CEQA"), Title 14, California Code of Regulations, Sections 15000 et seq. ("CEQA Guidelines") and the City of Petaluma Environmental Review Guidelines; and, Resolution No. 2009-XXX N.C.S. Page 1 WHEREAS, on April 14, 2009, the Planning Commission held a properly noticed public hearing, and after receiving all public comments on the Housing Element, continued the public hearing to Apri128, 2009; and, WHEREAS, on April 28, 2009, the Planning Commission provided an additional opportunity for public comment, and after full consideration of Housing Element made a unanimous recommendation that the City Council adopt the Housing Element; and, WHEREAS, on: June 15, 2009, the City Council held a properly noticed hearing, accepted comments from all interested parties on the proposed Negative Declaration and the Housing Element, considered the draft Housing Element, the Negative Declaration, including the supporting Initial Study, and minor revisions requested in the draft Housing Element requested by HCD as the result of HCD's initial review of the draft Housing Element. NOW, THEREFORE, BE IT RESOLVED: Recitals. The above Recitals are true and correct and adopted as findings of the City Council. 2. Adoption of Housing Element. Based on the findings and conclusions stated above, the City Council finds it in the public interest to, and hereby approves and adopts the City of Petaluma 2009-2014 Housing Element (June 2009) ("Housing Element"), incorporated herein by reference, as an amended Chapter 11 to General Plan 2025. 3. Effective Date. The Housing Element shall take effect thirty days from the date of the adoption of this Resolution pursuant to State law, including Midway Orchards v. County of Butte (1990) 220 Cal.App.3d 765, 778 and DeVita v. County of Napa (1995) 9 Cal. 4th 763, 787, fn. 9. Under the power and authority conferred upon this Council by the Charter of said City.
