Summarv_Statement: ,AB 761 would establish vacancy decontrol in mobile home parks by providing that upon.

mobile home park, the management of the park may offer a new rental agreement containing an initial rent in
excess of the maximum rent.establi shed. by rent control. Afterexecution of the new rental agreement; the local

Vacancy Decontrol.
1. RECOMMENDATION: Adopt A Resolution Opposing AB761 Establishing Mobile Home Vacancy
Decontrol.
2. BACKGROUND AND' DISCUSSION: Existing law permits rent control in mobile home parks and exempts
certain rental. agreements relating to mobile homes from any local measure establishing the maximum
amount that a landlord may charge a tenant for rent: This bill .as currently written would provide, in
addition, that upon the sale, assignment, transfer, or termination of an interest in a mobile home, the
management.of the park mayoffer anew rental agreement containing an initial rent that is the lesser of
market rates or an amount which adds a specified percentage to the maximum rent last charged under a
local measure. The percentage of permitted increase would start at 14.285%, beginning January 1, 2011
and allow an increase of as much as 100% more than the last=charged rent by January 1, 2017.
AB761 would except certain mobile home parks from its provisions and would provide that; after an
increase in initial rent, the rent should be governed by our local: ordinance.
3. FINANCIAL IMPACTS: There is no financial impact to the City by adopting this resolution.

RESOLUTION IN OPPOSITION TO AB 761 ESTABLISHING
MOBILE HOME VACANCY DECONTROL.
WHEREAS, the City of Petaluma adopted Ordinance No. 1949 NCS (dated May 14, 1994)
titled Mobilehome Park Space Rent Stabilization Program; and
WHEREAS, the Petaluma City Council continues'to support a stated purpose of the Ordinance
(6.505.010, O, (5) "...prevent excessive or, exploitive rent increases upon the transfer of a mobilehome-
on-site..." and
WHEREAS, AB 761 would- erode the City's efforts to support the community's low-income
senior mobile home residents.
NOW, THEREFORE, BE IT RESOLVED that the Petaluma City Council opposes AB 761
(Calderon) and directs staff to submit'letters of opposition in a timely fashion if the bill progresses
through the legislative process.
