RECOMMENDATION: Adopt A Resolution Opposing AB761 Establishing Mobile Home Vacancy Decontrol. 2. BACKGROUND AND' DISCUSSION: Existing law permits rent control in mobile home parks and exempts certain rental. agreements relating to mobile homes from any local measure establishing the maximum amount that a landlord may charge a tenant for rent: This bill .as currently written would provide, in addition, that upon the sale, assignment, transfer, or termination of an interest in a mobile home, the management.of the park mayoffer anew rental agreement containing an initial rent that is the lesser of market rates or an amount which adds a specified percentage to the maximum rent last charged under a local measure. The percentage of permitted increase would start at 14.285%, beginning January 1, 2011 and allow an increase of as much as 100% more than the last=charged rent by January 1, 2017. AB761 would except certain mobile home parks from its provisions and would provide that; after an increase in initial rent, the rent should be governed by our local: ordinance. 3.
