which they have jurisdiction. There will be no Commission discussion or action. The chairman will allot no more
than five minutes to any individual. If more than three persons wish to speak, there time will be allotted so that the

APPEAL STATEMENT: Within fourteen(14)calendar days following the date of a decision of the Planning
Commission, the decision may be appealed to the City Council by the applicant or by any other interested party. If
no appeal is made within that time,the decision shall be final. An appeal shall be addressed to the Council in writing
and shall be filed with the City Clerk. Said appeal shall be accompanied by the appeal fee as specified by Resolution
2002-I 14-N.C.S. as adopted by the City Council. The appeal shall state specifically the grounds for the appeal and

Motion: Approve recommendation that the City Council adopt a Mitigated Negative Declaration for
the project, and approve a rezoning from Planned Community District (PCD) to Planned Unit
District (PUD) and the associated Unit Development Plan and Development Standards, and
approve a Tentative Subdivision Map with added conditions that drainage be maintained by the
HOA, that the storm drain inlets within Parcel A shall be stenciled with "Drains to Creek"
language, that the location of the public utilities at the Lots 1 and 21 PUE be confirmed, that
green building condition 7 includes language about special attention to water reduction and hot
water distribution efficiency, that condition 9 be expanded to include any other sycamores lost
because of the increase curb returns required by Fire, that condition 11 be reworded, that use of
CDD and Planning Division in the PUD Standards be revised, and that the treatment between the
turn-around and the Derby property line be modified to enhance privacy for Allegheny Court
residences, subject to SPARC review and approval. Also, the Planning Commission's
recommendation included the flexibility to eliminate one of the shared parking spaces at the turn-
around, to flip the house plan at lot 11 to reduce pavement abutting the Derby property line, and

to increase the planting area between the turn-around and the Derby property line.
