APPROVAL OF MINUTES-COMMISSION: Approve minutes of the December 8,2009 Commission meeting. (07:01 PM) Motion: Approve with amendment to remove Jennifer Pierre from Motions and Votes regarding Sunnyslope item. Moved by Teresa Barren, seconded by Dennis Elias. 3. PUBLIC COMMENT:The Commission will hear public comments only on matters over which it has jurisdiction. There will be no Commission discussion or action. The Chair will allot no more than three minutes to any individual. If more than three persons wish to speak, their time will be allotted so that the total amount of time allocated to this agenda item will be 15 minutes. Lafranchi, P.E., on behalf of Bart Van Voorhis, property owner, for a Planned Unit Development(PUD)Amendment and a Vesting Tentative Map for a 19-lot subdivision to allow for the construction of single-family homes at 674 Sunnyslope Road. This is due to the insufficient clustering of the lots to reduce grading,the need to maximize the protection of the existing trees,to include public access to open space,and fire protection access. Lafranchi,P.E.,on behalf of the property owner for a Planned Unit District(PUD)Modification and a Tentative Parcel Map relating to two existing parcels consisting of 1.64 acres proposed to be 4 parcels and a remainder parcel,at 216 Sunnyslope Avenue and behind 1311 D Street. TITLE: Lands of Sunny D Development APN: 019-130-011 and 019-130-049 6 Planning Commission Minutes 12-22-09 FILE: 09-TPM-0134 STAFF: Tiffany Robbe A. Review of the Initial Study and adoption of a resolution making a recommendation to the City Council concerning adoption of a Mitigated Negative Declaration pursuant to CEQA. B. Review PUD modification and adoption of a resolution making a recommendation to the City Council concerning modification to the Sunnyslope PUD Development Standards for the subject 1.64 acre area, such that they default to the R2 rather than R-1:20,000 zoning standard. C. Review of a Tentative Parcel Map to allow for the division of two parcels into a 4 parcel plus remainder subdivision to allow for the construction of single-family homes and adoption of a resolution making a recommendation to the City Council. APPEAL STATEMENT: Within fourteen(14)days following the date of a decision of the Historical and Cultural Preservation Committee or the Planning Commission,the decision may be appealed to the City Council by the applicant or by any other interested party. If no appeal is made within that time,the decision shall be final. An appeal shall be addressed to the Council in writing and shall be filed with the City Clerk. Said appeal shall be accompanied by the appeal fee as specified by Resolution 2008-152-N.C.S. as adopted by the City Council.
