SUBJECT: Ordinance of the City Council of the City of Petaluma Repealing Chapter 11.52 of
the City of Petaluma Municipal Code Entitled "Restricted Use of Certain Streets"
and Adopting a New Chapter 11.52 Entitled "Commercial Vehicles and Truck
Routes"; and, the Resolution Establishing Truck Routes within the City of
Petaluma
RECOMMENDATION
It is recommended that the City Council introduce the Ordinance Repealing Chapter 11.52 of the
City of Petaluma Municipal Code Entitled "Restricted Use of Certain Streets" and Adopting a
New Chapter 11.52 Entitled "Commercial Vehicles and Truck Routes" (Attachment 1); and, the
Resolution Establishing Truck Routes within the City of Petaluma (Attachment 2).
BACKGROUND
Existing PMC Chapter 11.52 prohibits commercial vehicles on certain streets based on localized
neighborhood issues, roadway design, and traffic characteristics in the Central Business District.
This Ordinance has not been updated or evaluated in more than twenty years and does not
include a truck route map to assist transportation companies and local businesses. The Police
Department established a Commercial Vehicle Enforcement Officer position assigned to the
Traffic Team in January 2009 to manage the large volume of commercial vehicles within the
City and their effects on traffic safety and City roadways.
DISCUSSION
The Police Department and Public Works Department identified a need to update regulations for
commercial vehicle use within the City limits, consistent with State and Federal law. The
proposed changes to PMC Chapter 11.52 and the resolution will create a published truck route
system to help transportation companies and local businesses;ship and receive goods. If adopted,
the Truck Route Map (Attachment 2) will identify routes where commercial vehicles can travel
safely on roadways designed to accommodate such traffic, and which will be designated with
posted signs, in accordance with the California Vehicle Code (CVC). The proposed amendments

will continue to allow local deliveries or shipments to and from locations that are not on
designated truck routes. These changes will also increase the minimum weight limit for
commercial vehicles subject to the regulations of this chapter from 3 tons (6,0001bs) to 5 tons
(10,0001bs). The weight increase from 3 tons to 5 tons is consistent with statewide standards and
will no longer restrict larger passenger trucks with a gross vehicle weight greater than 6,0001bs
under this chapter. The proposed changes will help the Police Department manage commercial
vehicle traffic safety and reduce commercial vehicle damage to City maintained roadways.
Nothing in this proposed ordinance changes existing Federal and State law related to over length
vehicles permitted on "Terminal Access Routes" as determined by Caltrans. The only roadways
within the geographical city limits of Petaluma that have been evaluated and approved by
Caltrans that meet the standards necessary to allow trucks longer than 65 feet are highways
US 101 and State Highway 116 (Lakeville Highway) as shown on the attached map. Only a
change in federal and state law can change where trucks over 65 feet can travel. This limitation
makes it difficult for local businesses receiving and shipping goods because many trucks,
especially those traveling long distances, exceed 65 feet. Commercial trucks that typically
exceed 65 feet involve trucks (tractors) with a sleeper berth pulling a 53 foot trailer.
Law Enforcement and Economic Development staff met with Petaluma's Chamber of Commerce
and other affected businesses to discuss the law and to strategize ways to meet business needs
and protect public safety and city roadways. Long-term, over length trucks could be allowed
access to City streets once the East Washington and Old Redwood Highway interchanges are
improved. Staff has already been working with Caltrans to be sure needed roadway
improvements at the freeway interchanges are completed. Once the improvements to the
interchanges have been made, staff will then be able to evaluate other city roadways for Local
Terminal Access route approval. Staff is also working with the Chamber of Commerce to
identify an interim delivery location along the dedicated Terminal Access Route where over
length trucks could transfer goods to shorter trucks before accessing city streets. The proposed
ordinance changes will have no effect on current enforcement practices related to trucks
(tractors) which exceed 65 feet.
On a case-by-case basis, transportation companies can apply for a special transportation permit
allowing them to deliver something exceeding the legal size and weight limitations. These
permits are processed by Public Works and the Police Departments who assure the deliveries are
made safely. This type of delivery addresses one-time deliveries of large items like large
machinery, tanks, or prefabricated homes and offices on trailers and is not a method for
addressing regular deliveries in over length trucks.
The Truck Route Map will be available online through the City of Petaluma website and the
California Department of Transportation website. City staff has worked collaboratively on this
amendment to the PMC and has completed proactive outreach to local businesses, transportation
companies, and the Petaluma Chamber of Commerce. If the proposed changes are adopted, the
Police Department will coordinate an extensive public awareness and media campaign.

FINANCIAL IMPACTS
The Public Works Department estimates there will be minimal costs associated with the removal
of existing signs which prohibit truck traffic and the installation of new"Truck Route" signs and
that the required signage changes can be done with existing resources and equipment.

1 11.52.010 Definitions
2 For the purpose of this chapter, certain terms are defined as follows:
3 A. "California Legal Truck" means a truck tractor-semitrailer (or double) which meets the height,
4 width and length provisions of CVC Sections 35250, and 35100-35111, and which can travel on
5 virtually any route in California, as described in the California Department of Transportation truck
6 size and routes classifications.
7 B. "Central Traffic District" is that portion of the city as described in Section 11.04.030.
8 C. "City" means the most current corporate limits of the City of Petaluma.
9 D. "CVC" means California Vehicle Code.
10 E. "Destination" or"destinations" means an address for either a single delivery or multiple deliveries
11 of goods or services to an address within or outside the city.
12 F. "Double" means a truck tractor that tows a semitrailer and trailer.
13 G. "Jake BrakeTM" is a trademarked term for a type of retarder known as an engine compression
14 brake, which is designed to.aid in the braking or deceleration of any vehicle.
15 H. "National Network (NN)" means primarily the interstates, also called the National System of
16 Interstate and Defense Highways.
17 I. "Person" means a"person" as defined in Section 1.04.010.M of this code.
18 J. "Retarder" is a device which assists service brakes in the braking or deceleration of any vehicle
19 and includes engine compression brakes, exhaust brakes and driveline retarders.
20 K. "STAA" means the Federal Surface Transportation Assistance Act of 1982.
21 L. "STAA Network" means the routes that allow STAA trucks, which include the National Network
22 (NN), Terminal Access(TA) routes and Service Access routes.
23 M. "STAA Truck" means a truck tractor-semitrailer (or double) that conforms to the requirements of
24 the STAA.
25 N. "State Terminal Access (TA) Routes" means State approved routes that can accommodate STAR
26 trucks.
27 O. "Local Terminal Access (TA) Routes" means Local (City of Petaluma) approved routes that have
28 can accommodate STAR trucks.
29 P. "Service Access Routes" means roads that allow STAA truck access for fuel, food, lodging,
30 and repair within one road mile of a signed exit from the National Network.
31 Q. "Transportation Permit" is a single use or annual vehicle permit for vehicle loads or the movement
32 of manufactured homes which exceed the weight or size limits contained in CVC sections 35000
33 through 35796.
34 R. "Transportation vehicle" means any vehicle or combination of vehicles or special mobile
35 equipment or manufactured home that exceeds the size or weight specified in Sections 35000
36 through 35796 of the CVC.
37 S. "Truck" means any vehicle exceeding a gross vehicle weight of five tons.
38 T. "Truck route" means any street as designated in this chapter upon which the unrestricted use of
39 trucks is permitted.

41 11.52.020 Peak hour restrictions for certain vehicles in central traffic district.
42 A. No person shall operate any of the following vehicles in or through the central traffic district
43 between the hours of ten a.m. and six p.m. of any day.

1 1. Any commercial vehicle exceeding a gross vehicle weight of five tons;
2 2. Any freight vehicle more than eight and one-half feet in width, with load, or any freight
3 vehicle so loaded that any part of its load extends more than three feet to the front or more
4 than ten feet to the rear of said vehicle;
5 3. Any vehicle conveying solid waste, refuse, rubbish, garbage or dirt, construction and
6 demolition debris and/or commercial recyclables, except vehicles operated by a duly
7 authorized franchise holder for the collection of such items in the.city.

9 B. Any vehicle and/or load wider than 8%feet must be operated in conjunction with and preceded by
10 at least one pilot car and must obtain approval by the public works director or his/her designee
11 prior to operating within the central traffic district.
12 C. This section is subject to the exception for pickups and deliveries established in Section
13 11.52.100.A.

15 11.52.030 Vehicles equipped with sound-amplifying devices.
16 No person shall operate within the city a motor vehicle equipped with and using a sound amplifying
17 device, loud speaker and/or public address system which is audible for more than 50 feet from the
18 centerline of the vehicle except in conformance with the noise regulations established in the City of
19 Petaluma Implementing Zoning Ordinance, Section 21.040.A, or successor ordinance or resolution.

21 11.52.040 Unlawful use of retarders.
22 Pursuant to the general authority of the city to regulate use of its streets pursuant to CVC Section
23 21001(c), it shall be unlawful for the driver of any vehicle to use or operate or cause to be used or
24 operated within the city, any retarder that results in excessive, loud and raucous, unusual, or
25 explosive noise from such vehicle, except in an emergency.

27 11.52.050 Truck routes—Designation.
28 Whenever any resolution of this city designates and describes any street or portion thereof as a street
29 the use of which is permitted by any vehicle exceeding a maximum gross weight limit of five tons, the
30 city traffic engineer is authorized to designate such street or streets by appropriate signs as "Truck
3.1 Routes" for the movement of vehicles exceeding a maximum gross weight limit of five tons.
32 Established "Truck Routes" will be identified separately from "State and Local Terminal Access
33 Routes". "Terminal Access Routes" will be considered "Truck Routes" but "Truck Routes" are not
34 "Terminal Access Routes" for purposes of over-length vehicles. "Truck Routes", "State Terminal
35 Access Routes", and "Local Terminal Access Routes" will be identified on the approved city truck
36 route map.

38 11.52.060 Trucks over five tons required to use truck routes.
39 When any such truck route or routes are established and designated by appropriate signs, the
40 operator of any vehicle exceeding a maximum gross weight, limit of five tons shall drive on such route
41 or routes and none other, except as otherwise provided herein.

43 11.52.070 Truck routes established for vehicles over five tons.
44 Those streets and parts of streets established by resolution of the city council for the movement of
45 vehicles exceeding a maximum gross weight of five tons are declared to be truck routes.

2 11.52.090 Weigh-in.
3 Any police officer is authorized to require any person driving or in control of any truck being operated
4 on a street within the City other than on a truck route to proceed to any public or private scale
5 available for the purpose of weighing the vehicle to determine whether this chapter has been violated.

7 11.52.100 Exceptions.
8 A. The provisions of this chapter shall not prohibit the operation of any truck coming from an
9 unrestricted street having ingress or egress by direct route to and from a restricted street when
10 necessary for the purpose of making pickups or deliveries of goods, wares and merchandise from
11 or to any building or structure located on the restricted street, or for the purpose of delivering
12 materials to be used in the actual and bona fide repair, alteration, remodeling, or construction of
13 any building or structure upon the restricted street for which a building permit has been obtained
14 and is in effect.
15 B. The provisions of this chapter shall not apply to:
16 1. Passenger buses under the jurisdiction of the California Public Utilities Commission.
17 2. School buses as defined in CVC Section 545 and/or California Education Code Section
18 39830 or successor statutes.
19 3. Any vehicle owned or operated by the city.
20 4. Any vehicle conveying solid waste, refuse, rubbish, garbage or dirt, construction and
21 demolition debris and/or commercial recyclables operated by a duly authorized
22 franchisee for the collection of such items in the city.
23 5. Any vehicle owned by a public utility or licensed contractor while necessarily in use in the
24 construction, installation or repair of any public utility.

26 11.52.110 Transportation permits.
27 The city, as authorized by CVC Sections 21101, 35780 and 35790 and subject to the limitations,
28 restrictions, and conditions imposed by those sections, will, in its sole discretion and if good cause
29 appears, issue a permit authorizing the permittee to:
30 A. Operate a vehicle or combination of vehicles or special mobile equipment that exceeds the
31 maximum legal weight and/or size specified in CVC Sections 35000 through 35796.
32 B. Move any manufactured home in excess of the maximum width, length, and height specified in
33 CVC Sections 35790 through 35790.6.

35 11.52.120 Operation of vehicles with overweight or over-size loads without transportation
36 permit unlawful.
37 It is unlawful to operate or move in the city a vehicle or special mobile equipment that exceeds the
38 maximum legal weight and/or size specified in CVC Sections 35000 through 35796, or any
39 manufactured home that exceeds the maximum width, length, and height specified in CVC Sections
40 35790 through 35790.6without an transportation permit.

42 11.52.130 Application for Transportation permits.
43 A. Transportation permits described in Section 11.52.110 shall be obtained by applying to the
44 director of public works or his/her designee ("director"). The application and permitting process

1 shall be consistent with the requirements of CVC Sections 35780 through 35796 and successor
2 statutes and the application requirements of the California Department of Transportation as
3 modified in this chapter.
4 B. Applications for transportation permits shall be submitted at least two business days in advance
5 of the time for which the permit is needed. In some circumstances the director may determine
6 that up to an additional five business days are needed to review or process the application. In
7 such event, the director shall notify the applicant of the additional time needed within two
8 business days of receipt of the application. The director in his or her sole discretion may also
9 grant exceptions to the forty-eight hour requirement when, in the judgment of the director,
10 circumstances permit and/or require that the application be reviewed and processed in less than
11 forty-eight hours.
12 C. When necessary to protect against injury to the road, foundations, surfaces or structures,
13 pursuant to CVC Section 35782(b), the director may require extra insurance or other financial
14 security as a condition for a permit for unusually large or heavy loads that pose a substantial risk
15 to public facilities.

17 11.52.140 Transportation permit fees.
18 A. The director of public works shall collect from the applicant at the time of application a
19 transportation permit fee to recover up to the full cost of processing the application.
20 Transportation permit fees shall be established by resolution of the City Council, and may be
21 amended from time to time, in compliance with CVC Section 35795 or successor statute, and
22 may include one-time and periodic fees.
23 8. Special services necessitated by unusually large or heavy loads as described in and calculated
24 pursuant to CVC section 35795(b) or successor statutes shall be billed separately for each
25 permit.

27 11.52.150 Restrictions on transportation permits.
28 Approved transportation permits shall include and be subject to the following conditions.
29 A. The transportation permit must be carried on the vehicle for which it was issued. The permit must
30 be displayed upon demand to any peace officer, traffic officer, or other employee of the city
31. charged with the enforcement of this chapter.
32 B. Permitted vehicles are prohibited from using city streets or alleys between the hours of seven
33 a.m. to nine a.m., noon to one p.m., and four p.m. to six p.m. Monday through Friday.
34 C. Permitted vehicles are restricted to the truck routes specified in Section 11.52.070, subject to the
35 exceptions contained in section 11.52.100.
36 D. Any other conditions required by this code, the CVC, or other applicable law.
37 E. Permits shall provide for full indemnification of the city by the permittee, substantially similar to
38 the following: "Liabilities. The permittee is responsible for all liability for injury to, or death of any
39 person, or damage to public or private property which may occur through any act or omission of
40 either the permittee or the City of Petaluma arising from the issuance of this permit. In the event
41 any claim, suit or action is brought against the City of Petaluma, its officers, employees or agents
42 thereof, by reason of, or in connection with any such act or omission, permittee shall defend,
43 indemnify, and hold harmless the city, its officers, employees or agents from such claim, suit or
44 action."
45 F. Any conditions deemed necessary by the director of public works to protect the public health,
46 safety and welfare including, but not limited to:
47 1. Limiting the number of trips the permitted vehicle may make.

1 2. Establishing seasonal or other time limitations within which the vehicle or vehicles
2 described may operated.
3 3. Requiring proof;of financial responsibility in excess of the required for compliance
4 with CVC Section 16500':5 as a condition for granting a permit for unusually large or
5 heavy loads which may pose a substantial risk to publicfacilities:
6 4. Special services as described in and calculated pursuant to CVC Section 35795(b) or
7 successor statutes.

9 11.52.160 Appeals.
10 A. An applicant who,has been denied a transportation permit or who wishes to appeal a condition
11 imposed by the,director of public works in accordance with Section 11.52.150 may appeal such
12 denial or condition in accordance with this section.
13 B. Within five business days:of the date of denial or issuance.of the permit, the applicant shall file the
14 appeal with the director of public works, together with an"appeal fee to recover up to the full cost
15 of processing the appeal. Transportation permit appeal fees shall be established by resolution of
16 the city council, as,may be amended from time to time and shall meetthe requirements of Vehicle
17 Code Section 35795. The appeal shall be in writing and shall state the reason(s) for the appeal.
18 The director of public works shall forward the appeal to the city manager or designee. Upon
19 receipt of the appeal, the city manager or designee shall issue the appellant notice of an informal
20 meeting to hear the appeal within thirty days of receipt of the appeal, or at a time acceptable to
21 the appellant:and city manager ordesignee, unless the city manager or designee determines on
22 the basis of the written documentation that the permit should be issued or condition modified as
23 requested by the applicant; After hearing, the city manager or designee may deny or grant the
24 appeal, and amend, delete or add permit conditions. The decision of the city manager or
25 designee on the appeal shall be.final.

27 11.52.170 Liability for damage caused.
28 Any person operating a vehiclesubjectto transportation permit requirements in the city shall be liable
29 for and indemnify and hold the city harmless for any damage or liability to public facilities arising out
30 of or related to the use of the vehicle in the city, including but not limited to:
31 A. Cost of repair or replacement of public facilities and/or property;
32 B. Cost of cleanup;
33 C. Administrative, staff and legal costs.

35 11.52.180 Violations.
36 Any person who violates any provision of this chapter shall be guilty of a misdemeanor, except that
37 officials chargedrwith enforcement of this chapter, including the city attorney, may in their discretion
38 charge violations,ofthis chapter as infractions. Each day or portion thereof a violation of this chapter
39 continues shall be deemed a separate offense and punishable as such. Violations of this chapter
40 may be enforced in any combination as permitted by Chapters 1.10 through 1.16 of this code, by a
41 civil court action brought in the name of the city, by criminal action brought by the city attorney in the
42 name Of the city or in the name of the people of the State of California, or using any other
43 enforcement or legal remedies available to the city under the law. Penalties applicable to violations of
44 this chapter shalt be as prescribed'in the city's bail schedule as from tim a to time amended, and may
45 in no event exceed maximum penalties prescribed by this code or state law.

1 Section 2. The City Council finds that adoption of this ordinance is exempt from the California
2 Environmental Quality Act("CEQA"), pursuant to Sections 15061(b)(3)ofthe CEQA Guidelines (Title
3 14, Chapter 3 of the California Code of Regulations)because`there'is no possibility that the activity
4 may have a/significantimpact onthe environment.

6 Section 3. If any section,subsection, sentence, clause, phrase or word of this ordinance is for any
7
reason held to be unconstitutional, unlawful or otherwise invalid bya court of competent jurisdiction or
8 preempted by state legislation, such decision or legislation shall,not affect the validity of the remaining
9 portions of this ordinance. The City Council of the City of Petaluma hereby declares that it would
10 have passed and adopted this ordinance and each and all provisions thereof irrespective of the fact
11 that any one or more of said provisions be declared unconstitutional, unlawful or otherwise invalid.

13 Section 4. This ordinance shall become:effective thirty.(30) days after the date of its adoption by the
14 Petaluma City Council, and upon the posting of all signs required by California Vehicle Code Section
15 21103.

17 Section 5. The City Clerk is,hereby:directed to publish or post this ordinance or a synopsis for the
18 period and in the manner provided by the City Charter and any other applicable law.

RESOLUTION OF THE,CITY COUNCIL OF THE CITY OF PETALUMA
ESTABLISHING TRUCK ROUTES WITHIN THE CITY OF PETALUMA
WHEREAS, pursuant to Petaluma.Municipal Code,Section 11.52.070, the City Council
shall establish by resolution those streets and parts of streets which are truck routes for the
movement of vehicles exceeding a maximum gross weight of five tons.
NOW THEREFORE, BE IT RESOLVED that the following City of Petaluma streets,

BE IT FURTHER RESOLVED that all previous resolutions establishing truck routes
are hereby repealed..
BE IT FURTHER RESOLVED that,this resolution shall take effect upon the effective
date of Ordinance No 2012-. N.C.S.ran Ordinance of the City Council of the City of
Petaluma Repealing Chapter 11.52 of the City of Petaluma Municipal Code Entitled "Restricted
Use of Certain Streets" and Adopting,a New Chapter 11,52'Entitled "Commercial Vehicles and
Truck Routes."
