HomeMy WebLinkAboutRESOLUTION 2024-119 N.C.S. 09/16/2024 Docusign Envelope ID:492CF6C7-3C9A-449F-8AOB-FF7C50575E8E Resolution No. 2024-119 N.C.S. of the City of Petaluma, California RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PETALUMA AUTHORIZING THE PURCHASE AND INSTALLATION OF 10 TRANSIT SHELTERS AND AMENITIES FROM TOLAR MANUFACTURING COMPANY,INC.,VIA THE CALACT/MBTA COOPERATIVE PURCHASING AGREEMENT WHEREAS, Petaluma Transit seeks to increase transit ridership throughout the City of Petaluma; and WHEREAS, the City seeks to improve conditions at bus stops throughout the City to help encourage transit ridership, lower vehicle miles traveled, and greenhouse gas emissions; and WHEREAS, the City wishes to procure bus shelters and amenities to be installed at 10 bus stop locations; and WHEREAS, an option was located to purchase 10 bus shelters and stop amenities through a procurement consortium, led by the California Association for Coordinated Transportation (CALACT) and Morongo Basin Transit Authority (MBTA), known as the "Cooperative," Tolar Manufacturing Company, Inc., was a successful bidder; and WHEREAS, Tolar Manufacturing Company, Inc.,bus stop amenities will meet the needs of the project sites and compatibility with other Petaluma Transit bus stops; and WHEREAS,upon reviewing quotes provided by Tolar Manufacturing Company,Inc., staff recommends that the Council authorizes the purchase of 10 bus shelters and amenities from Tolar Manufacturing Company, Inc., under the terms of the CaIACT MBTA Purchasing Cooperative; and WHEREAS, the Petaluma Municipal Code section 4.04.100 provides that purchases made through a cooperative purchasing program with the state, county, or other public agencies are exempt from provisions of Chapter 4.04 of the Petaluma Municipal Code,which requires the City to conduct its own competitive bid process for certain purchases and documentation as to the advantage of the cooperative purchases will be retained; and WHEREAS, the total cost for ten shelters and amenities is $171,491 with an estimated installation cost of $50,000, which can be paid for with $171,811 in Transit Development Act (TDA) funding, and $49,680 in Petaluma Traffic Impact Funds (TIF); and WHEREAS, the proposed action is statutorily exempt from the California Environmental Quality Act (CEQA), in accordance with the Public Resources Code § 21080.25 (Added 1-1-2021 pursuant to SB 288), in that the project meets the definition of a project defined as "Pedestrian and bicycle facilities, including new facilities"and a project for the increase of bus services; and WHEREAS, additionally, the project is also categorically exempt from CEQA pursuant to Section 15301 as a minor alteration of existing public facilities, Section 15303, as the bus shelters and amenities are small structures, and Section 15311, in that the new bus shelters and amenities are accessory structures to established Resolution No. 2024-119 N.C.S. NOW, THEREFORE,BE IT RESOLVED,by the City Council of the City of Petaluma as follows: 1. The above recitals are hereby declared to be true and correct and are incorporated into this ordinance as findings of the City Council. 2. The proposed action is statutorily exempt from the California Environmental Quality Act (CEQA), in accordance with the Public Resources Code § 21080.25 (Added 1-1-2021 pursuant to SB 288), in that the project meets the definition of a project defined as "Pedestrian and bicycle facilities, including new facilities" and a project for the increase of bus services. The project is also categorically exempt from CEQA pursuant to Section 15301 as a minor alteration of existing public facilities, Section 15303, as the bus shelters and amenities are small structures, and Section 15311, in that the new bus shelters and amenities are accessory structures to established uses. Additionally, there are no cumulative impacts, unusual circumstances, or other factors that would make the exemptions inapplicable pursuant to CEQA Guidelines section 15300.2 3. Authorizes the purchase of transit shelters and amenities from Tolar Manufacturing Company, Inc., via the CaIACT/MBTA Cooperating Purchasing Agreement in the amount of$171,811 with an estimated installation cost of$50,000. 4. Allows staff to install the bus stop fixtures at 10 bus stop locations. 5. Authorizes the City Manager, or their designee, to execute all documents necessary to complete the purchase and installation. Under the power and authority conferred upon this Council by the Charter of said City.
