HomeMy WebLinkAboutResolution 2005-209 N.C.S. 12/05/2005 Resolution No. 2005-209 N.C.S. of the City of Petaluma, California ACCEPTING COMPLETION OF THE 2004-2005 WATER SERVICE REPLACEMENT PROJECT PROJECT NO. C501000 WHEREAS, the City Council awarded the contract for the 2004-2005 Water Service Replacement Project to C. Hardy General Engineering Contractor, Inc., 3265 Old Adobe Road, Petaluma, CA 94954, on April 18, 2005; and, WHEREAS, C. Hardy General Engineering Contractor, Inc. has completed the work to the satisfaction of the Director of Water Resources & Conservation. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Petaluma, that the project is hereby accepted subject to the Contractor completing the punch list work within thirty days after acceptance of the project. DE IT FURTHER RESOLVED by the Petaluma City Council that:. 1. The City Clerk is hereby authorized to sign the Notice of Completion and file the same with Sonoma County Recorder. 2. The Finance Department is hereby authorized to release the retention money to C. Hardy General Engineering Contractor, Inc. sixty days after the acceptance of the project provided that no liens or stop notices have been filed against the project. 3. This resolution shall become effective immediately. 4. All portions of this resolution are severable. Should any individual component of this resolution be adjudged to be invalid and unenforceable by a body of competent jurisdiction, then the remaining resolution. portions shall be and continue in full force and effect, except as to those resolution portions that have been adjudge invalid. The City Council of the City of Petaluma hereby declares that it would have adopted this Resolution No. 2005-209 N.C.S. Page l resolution and each section, subsection, clause, .sentence, phrase and other portion thereof, irrespective of the fact that one or more section subsection, clause sentence, phrase or other portion may be held invalid or unconstitutional. Under the power and authority conferred upon this Council by the Charter of said City.
