AN ORDINANCE OF THE COUNCIL OF THE CITY OF PETALUMA ACCEPTING CONVEYANCE
OF REAL PROPERTY ALONG WATER STREET NORTH AND AUTHORIZING THE CITY MANAGER
TO EXECUTE CERTIFICATES OF ACCEPTANCE FOR THE PARCELS
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF PETALUMA AS FOLLOWS:
WHEREAS, certain owners of real property along Water Street North
("Grantors"), individual persons, own in fee simple parcels of land in the City of
Petaluma located along Water Street North as APNs 006-284-028; 006-284-025;
006-284-021; 006-284-034; 006-284-032; 006-284-035; (collectively, the "Property")
as more specifically described in Exhibit A attached hereto and incorporated by
reference; and
WHEREAS, the Grantors have agreed to sell the Property to the City for
valuable consideration; and
WHEREAS, pursuant to Government Code Section 37350, a city may
purchase, lease, receive, hold, and enjoy real and personal property, and control
and dispose of it for the common benefit; and
WHEREAS, pursuant to section 46 of the Petaluma City Charter, the City
Council must adopt an ordinance to acquire real property; and
WHEREAS, the City Council finds that it is desirable for the City to acquire
fee simple title to the Property, and further conditioned upon title being delivered
to the City clear of any outstanding taxes, assessments, liens or other monetary
encumbrances; and
WHEREAS, the City Council finds that the actions authorized and granted
to the City Manager under this ordinance were considered and. approved under
the Specific Plan EIR pursuant to the California Environmental Quality Act.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PETALUMA,
CALIFORNIA, DOES HEREBY ORDAIN AS FOLLOWS:

1 Section 1. Upon execution and delivery by Grantors of grant deeds for the
2 Property, and conditioned upon delivery of title to the Property that is clear of
3 any outstanding assessments, taxes, liens or other monetary encumbrances, the
4 City Council accepts the conveyance of the Property from the Grantors.
5 Section 2. If and when the conditions of Sections 1 are met, the City
6 Manager is hereby authorized and directed to execute Certificates of
7 Acceptance accepting the conveyance of the Property on behalf of the City of
8 Petaluma and cause recordation of the same.

Section 3. The City Manager is hereby authorized to undertake such further
action as necessary to carry out the intent of this Ordinance, including the
issuance of license agreements for the interim use of the deeded property until
such time as construction of public improvements begins..
Section 4. This ordinance shall become effective thirty (30) days after the
date of its adoption by-the Petaluma City Council.
Section 5. The City Clerk is hereby directed to post this ordinance for the
period and in the manner required by the City Charter.
