HomeMy WebLinkAboutResolution 2009-109 N.C.S. 07/20/2009Resolution No. 2009-109 N.C.S. of the City of Petaluma, California ACCEPTING BIDS AND AWARDING CON'TRACTS TO 'THE I.OWES'I' I2ESPONSIBI,E BIl)D~RS FOR F~JRNISHING CHEMICAI.S ~'OR WASTEWAI'ER TREATIVIEN'I' ~OR FISC'AL 1'EAR 2009/10 ANI) ALT'd'I-dOI2IZING rd'I~E CI'1'~' 1VIANAGER TO SIGN THE CONTRACTS ON BEHALF OF THE CIT~' W~IEREAS, the City of Petaluma uses bulk chemicals in its operation of the Ellis Creek Water Recycling Facility; and, WHEREAS, City Management joined the North Bay Agency Chemical Pool (NBACP) in the Spring of 2009 to provide the best possible pricing for the rate payers; and, W~IEREAS, NBACP member Vallejo Sanitation & Flood Control District conducted a competitive bid process for bulk purchase of numerous chemicals for the Fiscal Year 2009/2010; and, WI~EREAS, NBACP bid the chemicals on May 7, 2009, and twelve (12) bids were received and opened in accordance with applicable law; and, WI~EREAS, the lowest responsive bids for the chemicals to be purchased through NBACP by the City of Petaluma were: A. Brenntag Pacific, Inc. for Sodium Bisulfite B. General Chemical Company far Aluminum Sulfate C. Olin Chlor Alkali Products for Sodium Hypochlorite WHEREAS, as a member of NBnCP, the City of Petaluma is entitled to purchase bulk chemicals for the NBACP low bidders at the bid price stated; and, W~IEREAS, the bulk chemical purchases contemplated by this resolution are exempt from other competitive bid requirements of Petaluma Municipal Code Chapter 4.04 pursuant to Petaluma Municipal Code Section 4.04.100, "Cooperative Purchasing Programs"; and, WI~EREAS, purchasing bulk chemicals through the NBACP is estimated to achieve savings of $26,585 compared to private contractor purchases from Fiscal Year 2008/2009. NOW, 'TI~EREFORE, BE I'T RESOLVEll by the City Council of the City of Petaluma as follows: 1. The above recitals are true and correct and adopted as findings of the City Council of the City of Petaluma. 2. The bids for chemicals listed above are hereby accepted. 3. Contracts are awarded to the following vendors for the following bulk chemicals, in conformance with the NBACP lowest responsive bids, conditioned on timely Resolution No. 2009-109 N.C.S. Page l execution by each vendor of the contract that was part of the bid package and Addendum No. 1 updated for the NBACP by the City of Petaluma to meet the City's insurance requirements and submission of all required documents: a. Brenntag Pacific, Inc., sodium bisulfite, $0.947/gal and not to exceed $104,348. b. General Chemical Company, aluminum Sulfate, $358.00/dry ton, and not to exceed $8,004. c, Olin Chlor Alkali Products, Sodium Hypochlorite (12.5%), $0.759/gal and not to exceed $226,412. The City Manager is authorized to execute appropriate agreements and purchase orders with each named supplier for bulk chemical purchases for Fiscal Year 2009-2010. Under the power and authority conferred upon this Council by the Charter ofsaid City.
