EFFECTIVE DATE OF ORDINANCE March 28, 2005 1 Introduced by Seconded by 2 3 Mike Healy Mike O'Brien 4 5 6 7 AMENDING CHAPTER 11.12.150 8 OF THE PETALUMA MUNICIPAL CODE 9 FOR VEHICLE CODE ENFORCEMENT OF PRIVATE PROPERTY AT ]0 (a) THE THEATRE DISTRICT PARKING GARAGE (AP#008-068-001,02,03) 11 BOUNDED BY C STREET, 1ST STREET, 2ND STREET AND D STREET; AND 12 (b) THE BASIN STREET TOWN CENTER PARKING LOT (AP#008-065-002,3,4,5) 13 ADJACENT TO B STREET BETWEEN PETALUMA BOULEVARD AND 2ND STREET 14 15 16 17 BE IT ORDAINED BY THE COUNCIL OF THE CITY OF PETALUMA AS FOLLOWS: 18 19 WHEREAS; the Basin Street Properties and ownership has requested the Petaluma 20 Parking Enforcement Unit obtain lawful authorization to enforce Vehicle Code 21 provisions in California Vehicle Code (CVC) 21 107.8 on a private parking lot and a 22 private parking garage; and, 23 24 WHEREAS, the Basin Street Owners are requesting this enforcement to mitigate 25 public safety and traffic concerns, and CVC 21 107.8 allows the City to adopt this 26 authority by Ordinance; and, 27 28 WHEREAS, the Basin Street Owners understand that they are responsible for the 29 appropriate placement of signs and ongoing maintenance associated with signs on 30 the .private property; and, 31 32 WHEREAS, the Basin Street Owners understand that no agreement for extra 33 Police, Fire or Parking Enforcement services attaches to this amendment; and 34 35 WHEREAS, the Basin Street Owners understand that all parking enforcement 36 revenues, fines or fees will be retained by the City to be used at its discretion in its 37 general fund operations. 38 39 NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Petaluma 40 does hereby approve the amendment of PMC 1 1.12.150 to authorize enforcement of Ordinance No. 2200 N.C.S. Page 1 1 the California Vehicle Code on the following private properties pursuant to CVC 2 Section 21 107.5: 3 4 (a) The Theatre District Parking Garage (AP#008-065-001,02,03) Bounded by C 5 Street, 1 S' Street, 2nd Street and D Street; and, 6 7 (b) The Basin Street Town Center Parking Lot (AP#008-065-002,03,04,05) 8 adjacent to B Street between Petaluma Boulevard and 2nd Street. 9 10 11 If any section, subsection, sentence, clause of phrase or work of this ordinance is 12 for any reason held to be unconstitutional, unlawful or otherwise invalid by a court of 13 competent jurisdiction, such decision shall not affect the validity of the remaining 14 portions of this ordinance. The City Council of the City of Petaluma hereby declares 15 that it would have passed and adopted this ordinance and each and all provisions 16 thereof irrespective of the fact that any one or more of said provisions be declared 17 unconstitutional, unlawful or other wise invalid. 18 19 This ordinance shall become effective thirty (30) days after the date of its 20 adoption by the Petaluma City Council. 21 22 The City Clerk is hereby directed to post this ordinance for the period and in the 23 manner required by the City Charter. 24 25 INTRODUCED and ordered posted/wed this 7'" day of February 2005. 26 ADOPTED this 28'" day of February 2005 by the following vote: 27 28 AYES: Canevaro, Mayor Glass, Healy, Nau, O'Brien, Torliatt 29 NOES: None 30 ABSENT: Vice Mayor Harris 31 ' 32 lJ 3 3 34 `David A.
