Seconded by Mike O'Brien AN ORDINANCE TO RE-ESTABLISH OR AMEND SPEED LIMITS ON CERTAIN STREETS WITHIN THE CITY OF PETALUMA AND DECLARING THE URGENCY THEREOF, TO TAKE EFFECT IMMEDIATELY BE IT ORDAINED BY THE COUNCIL OF THE CITY OF PETALUMA AS FOLLOWS: Section 1. That pursuant to California Vehicle Code 2235.7, 22358, and 22358.3, the radar enforceable speed zones on the following Petaluma City streets are hereby amended and/or re-established: Phase 1 STREET FROM TO SPEED' LIMIT`' MPH/(Km/Hr.) Section 2. Previously established radar enforceable speed zones, for which the traffic and engineering survey are still valid, are hereby expressly approved as speed limits for the streets to which they apply. Section 3. If any section, subsection, sentence, clause or phrase or word of this ordinance is for any reason held to be unconstitutional, unlawful or otherwise invalid by a court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance. The City Council of the City of Petaluma hereby declares that it would have passed and adopted this ordinance and each and all provisions thereof irrespective of the fact that any one or more of said provisions be declared unconstitutional, unlawful or otherwise invalid. Section 4. This ordinance is hereby declared to be necessary for the immediate preservation of the public peace, health and safety of the City of Petaluma, and shall take effect and be in force from and after its final passage by unanimous vote of the members of the City Council present at the time of its adoption. The reason for the Ordinance No. 2190 N.C.S. Page 4 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 41 42 43 44 45 46 47 48 49 50 51 52 urgency is so that the last speed survey was conducted on August 16, 1999 and the last Ordinance adopted pursuant to that speed survey was effective December 1, 1999 and under the California Vehicle Code an argument exists that speed surveys used to support speed limits are valid for only five years rather than five years from the effective date of Ordinances adopted pursuant to such speed surveys. Therefore to assure the validity of citations and enforcement of those citations issued for speeding violations and thus to assure protection of the public peace, health and safety this ordinance is hereby declared to be an urgency ordinance. Section 5. The City Clerk is hereby directed to post this ordinance for the period and in the manner required by the City Charter.
