18 ON CERTAIN STREETS WITHIN THE CITY OF PETALUMA AND DECLARING THE URGENCY
19 THEREOF, TO TAKE EFFECT IMMEDIATELY

23 BE IT ORDAINED BY THE COUNCIL OF THE CITY OF PETALUMA AS FOLLOWS:

27 Section 1. That pursuant to California Vehicle Code 2235.7, 22358, and
29 22358.3, the radar enforceable speed zones on the following Petaluma City streets are hereby
30 amended and/or re-established:

27 Section 2. Previously established radar enforceable speed zones, for which
28 the traffic and engineering survey are still valid, are hereby expressly approved as
29
30 speed limits for the streets to which they apply.

33 Section 3. If any section, subsection, sentence, clause or phrase or word of this
34
35 ordinance is for any reason held to be unconstitutional, unlawful or otherwise invalid by
36
37 a court of competent jurisdiction, such decision shall not affect the validity of the
38 remaining portions of this ordinance. The City Council of the City of Petaluma hereby
39
40 declares that it would have passed and adopted this ordinance and each and all
41
42 provisions thereof irrespective of the fact that any one or more of said provisions be
43 declared unconstitutional, unlawful or otherwise invalid.

47 Section 4. This ordinance is hereby declared to be necessary for the immediate
48 preservation of the public peace, health and safety of the City of Petaluma, and shall
49
50 take effect and be in force from and after its final passage by unanimous vote of the
51
52 members of the City Council present at the time of its adoption. The reason for the

1 urgency is so that the last speed survey was conducted on August 16, 1999 and the last

3 Ordinance adopted pursuant to that speed survey was effective December 1, 1999
4 and under the California Vehicle Code an argument exists that speed surveys used to
5
6 support speed limits are valid for only five years rather than five years from the effective
7
g date of Ordinances adopted pursuant to such speed surveys. Therefore to assure the
9 validity of citations and enforcement of those citations issued for speeding violations
10
11 and thus to assure .protection of the public peace, health and safety this ordinance is

13 hereby declared to be an urgency ordinance.

16 Section 5. The City Clerk is hereby directed to post this- ordinance for the period
17 and in the manner required by the City Charter.
