RESOLUTION AUTHORIZING CITY MANAGER
TO SIGN WAIVER OF CONFLICT WITH SENNEFF, FREEMAN & BLUESTONE
WHEREAS, the Law Firn~ of Semleff, Freeman and Bluestone recently represented the
City of Petaluma with regards to the City's water recycling facility project; and,
WHEREAS, Semleff, Freeman & Bluestone, LLP, has been approached by the Law
Firm of Frank Bailey to assist them with a lawsuit in which the City has instituted an action for a
partial taking of property located at 3653 Washington Street in Petaluma, which is owned by
Zukin, Inc.; and,
WHEREAS, Mr. Bailey's client, Zukin, Inc., is working amicably to resolve this lawsuit;
and,
WHEREAS, Longs Drugs is a tenant on the Washington Street property and has
forwarded a demand for money to Zukin because they feel the partial taking has an economic
impact on its lease; and,
WHEREAS, because this lawsuit involves a completely different matter than what
Semieff, Freeman & Bluestone represented the City on, they are requesting the City of Petaluma
to waive any conflict in order for them to represent Zukin, Inc.
NOW, THEREFORE, BE IT RESOLVED that the City Council authorizes the City
Manager to sign the Waiver of Conflict.
Under the power and authority conferred upon this Council by the Charter of said City.

Council of the City of Petaluma at a Regular meeting on the 21 s` day of November, fornt/~
