Summary Statement:
The City Council reviewed the proposed project on July 6, 2009. After deliberating and taking public testimony,
the Council continued the item to give the applicant time to make modifications to the project including adding a
smaller house at two of the lots and decreasing a parking space and~parking near the turn-around. The Planning
Commission had previously made the Recommendation.. listed above -for The Birches, a 21-unit Single-Family
Residential Subdivision located at 870 Wood Sorrel Drive, APN 137-061-022, File # OS-TSM-0369-CR.

TO APPROVE A TENTATIVE SUBDIVISION MAP, AND
TO ADOPT A MITIGATED NEGATIVE DECLARATION FOR THE BIRCHES

1. RECOMMENDATION:
Should the City Council find that their concerns were adequately addressed, it is
recommended that the Council Adopt a Resolution to Approve a Mitigated Negative
Declaration, introduce an Ordinance to Approve a Rezoning to Planned Unit District, and
consider a Resolution to. Approve a Unit Development Plan and Development Standards and
a Resolution to Approve a 'Tentative Subdivision .Map :for The Birches, a 21-unit single-
family subdivision on the vacant 2.2-acre parcel at 870 Wood Sorrel Drive (see Attachment
1 for Draft Resolutions and "Ordinance). If the Council decides to move the Project forward,
the ordinance will be adopted after second reading at a subsequent meeting, at which time
the Resolutions to approve a Unit Development Plan :and Development Standards and to
approve a Tentative Subdivision Map would also be adopted.
2. BACKGROUND:
On July 6, 2009, the City Council held a public hearing; considered the project, and then
continued. the project to give the applicant time to .make modifications including using a
smaller house plan at two of'the lots and eliminating a parking space and decreasing paving
near the turn-around.
3. DISCUSSION:
Regarding.. the smaller house, the Council specifically directed the applicant to propose a
smaller-sized, one-story house plan sited on two of the lots (lots 11 and 12 were the Council
recommended locations). They stated that a reduced. on-site parking requirement for this
smaller unit would be considered. They stated that, as an alternative to this one-story
requirement, a .plan with a master bedroom on the first floor could also be presented for
consideration.
The applicant has worked with their architect to provide Council with two alternate house
plans for consideration. The first alternate house plan (Plan 5) has the master bedroom on
the: first floor and two bedrooms and one bath upstairs; it sits at least 15'/2 feet to the rear
property line:; It is 1,624 square feet and has atwo-car garage. The second is a single-story
plan (5 Alt) with a 10 foot rear setback. It is 1,460 square feet and has cone-car garage. As
a reference, the.previously proposed. four house plans range from 1,750 to 2;127 square feet;
each has atwo-ear (400 square foot) garage. They each have second floors. that are
equivalent or nearly equivalent. to the lower footprint. Both alternate house plans are
designed to replace a Plan 2 or 3 on the Yarberry Drive side of the private street (lots 12-21),
as these lots are typically 10 feet or more deeper than those lots that back to McDowell
Meadows Subdivision. The. applicant suggests dots 14 and. 19 as the best locations for the
alternate plans. (see Sheet TM-5).
Regarding. reduced paving at the turn-around, the Council directed the applicant to:
® eliminate the 8th parking space at the turn-around and Lot 12,
e pull back the pavement. of the turn-around the few feet that are no longer needed due
to the elimination of on-street parking space 8, and
® landscape both of these .areas.
Council desired to reduce paving and increase greening and privacy to those residents with
existing homes near the roadway terminus.
These modifications have been done. The project.. now proposes 7 on-street parking spaces
and the turnaround paving ends 15% rather than 10 feet from the Derby/Conroy rear
property lines. Landscaping: is shown generally; specific landscaping will be shown prior to
the Planning Commission design review hearing, pursuant to conditions 12 and 13.
Additionally, the Council directed that the Alternative Refuse Collection Exhibit presented
at the Council hearing. be incorporated into the plan. set. This has been done, see Sheet TM-
5. The Council also directed the .following modifications which are required by draft
conditions.
® Provide sound fencing for Allegheny Court residences between the turn-around and
the Derby property line. (Condition 13a has been expanded to specify sound
mitigation).
® Ensure that the sound fence (Lots 1 and 16-21) is designed to deter graffiti. (See
Condition 13b)
® Modify PUD Development Standards Page 5. VIII E to eliminate the exception to the 15
gallon minimum tree size and Page 7 IX p to state that trees proposed for retention but
subsequently damaged or removed during' construction shall be replaced on a one-to-one
trunk diameter basis (pursuant to the IZO chapter 17) .with each replacement tree being
atleast a 24-inch box size. (See Condition 15)
® Modify Construction Noise Condition to limit deliveries to Sam to Spm and state that
these hour restrictions supersede and are snore restrictive than those identified in the
Noise Study and the Development Standards, (See Condition 16)
• Sewer and water shall be public and the storm drain system shall be private. (See
Condition 24a and 25b)
® Ensure that the CC&R's contain the appropriate storm drain funding mechanism
subject to review and approval of the City Engineer. (See Condition 24a and 26a)
® .New vaults. and other electrical, gas, and communications infrastructure shall be
installed underground. (See Condition 26e)

Green Building, use of a PLTD) ~ staff refers the Council to the July 6th City Council packet
and to attachments of that packet: the Planning Commission reports of May 12 and
especially March 24`'' and their associated attachments. The Initial Study analyzing the

Project's environmental effects was provided in the Juhy 6th City Council packet and is dated
February 17, 2009.
4. FINANCIAL IMPACTS:
This. is a cost recovery project; the applicant. will pay for the cost of processing the
application. As of May, the applicant had paid $19,557.00 in cost recovery development
review fees. The project is also .subject to development impact fees and water and
wastewater capacity charges.

RESOLUTION OF THE PE'TALUMA CITY COUNCIL
AI)®PTING A MITIGATED NEGATIVE IDECI,ARATION AND A 1VIITIGATION
MONITORING AND REPORTING PROGRAM FOR THE BIRCHES SUBDIVISION
LOCATED AT S70 WO®D. SORREL, APN 019-020-013
WHEREAS, the applicant has applied to rezone the property to a Planned Unit District
(PUD) and has proposed the associated Development .Plan and PUD Standards.("the Project");
and
WHEREAS, the City of Petaluma ("City") prepared an Initial. Study for the proposed
Project consistent -with the .California Environmental Quality Act (CEQA) and pursuant to 14
California Code of Regulations Section 15064(f)(2), and' determined that a Mitigated Negative
Declaration 'was required to analyze the potential. significant environmental impacts of the
Project; and.
WHEREAS, in evaluating certain potential' environrriental effects of the Project in the
Initial Study, including but -not limited to effects of climate change, water supply, and. traffic, the
City relied on the program. EIR for the City of Petaluma General Plan 2025, certified with
appropriate findings of fact on April 7, .2008 with the adoption of Resolution No. 2008-084
N.C.S.; and
WI-IEREAS, the. Project, Initial Study and Mitigated Negative Declaration found that
with the specified mitigation measures relating to potential air quality and noise, Project impacts
would be avoi"ded or reduced to a level of insignif cancer: other than effects on climate change
resulting from greenhouse gas emissions from the Proj'ect~ and
WHEREAS, as to the incremental contribution of this .Project to cumulative climate
change, the Initial Study and Mitigated Negative. Declaration .analyzed additional. information
regarding this Project and determined that The Birches. is consistent with all current State
measures and General Plan 2025 policies regarding greenhouse' gas reduction, but also that after
careful investigation; because of the difficulty of,determining individual contributions to climate
change from projects: as small' as The Birches, the Project's direct andlor incrementaT'contribution
to cumulative climate change is too speculative to determine; 'and
- WHEREAS, on or before February 26, 2009, the City's Notice of Intent to Adopt
Mitigated Negative Declaration based on the Initial Study,. providing for atwenty-day public
comment period commencing February 19,..2009 and ending March 24; 2009 and. a Notice of
.Public Hearing to be held-on March 24, 2009~before the City of Petaluma Planning Commission
was published' and mailed to all residents and property owners within 500 feet of the Project as
well as all persons having requested special notice of said proceedings; and
WHEREAS; a staff report dated March 24, 2009 and incorporated herein by reference,
described and analyzed the. Project and the Mitigated Negative Declaration, including its
supporting technical studies and"reports;. and
WHEREAS, the Planning Commission held a public hearing on March 24; 2009, during
which the Commission considered thee-..Project and the Mitigated Negative Declaration and
received- and considered all written and oral `,public comments on environmental effects of the
Project which were submitted up to and at the -time. of the public hearing; and
WHEREAS, at that hearing;, 'the Planning Commission expressed their -dissatisfaction
that the-.proposed. roadway:in the area of lots 9 - 1,4 was ;not designed to accommodate delivery
and garbage trucks, and acted to continue he project to a.date certain, May 12, 2009, to allow the
applicant time to make improvements;,,and
WHEREAS, a further staff report dated;May 12, 2009 and incorporated herein by
reference, sur~arzed the proposed roadway modifications andahe other changes which the
applicant made in response. to concerns expressed by more, than one Planning Commissioner and
the public; and
WHEREAS; the 'Planning Commission h'el`d a second. pul'lic hearing on May 12, 2009,
during which the Commission again considered. the Project and the Mitigated, Negative
Declaration .and received +and. considered, all written and oral.. public comments on environmental

effect's of the Project which were ~subrriitted up to and at the: time ~of;the.publc hearing;. and.
WHEREAS; on. May 12, 2009; the Planning Commission completed its review of the
Project and the Mitigated. Negative Declaration; mitigation. measures, and a Mitigation
Monitoring Program and' recommended adoption of the Mitigated Negative Declaration and the
Mitigation Monitoring arid. Reporfig Program; 'and'
WHEREAS, :bascd.in part on its recommendation of a Mitigated Negative Declaration,
the Planning Commission recommended approval of other.Project entitlements; and
WHEREAS, an .Agenda; Bill; dated July 6, 2009 and incorporated herein by reference,
`described and analyzed the 1Vlitigafed Negative Declaration; including comments and responses;

N-3: Because of the proximity to existing residences to .the site, construction activities shall be
restricted as follows: These restrictions shall be noted in all related construction contracts:
• Construction Scheduling. The following measures are recommended to limit construction
and related activities to the portion of the day when the number of persons in the adjacent
residential uses is lowest:
a. Limited construction hours to between T30 a.m. and 7:00 p.m. Monday .through
Friday and 9:00 a:m. to 7:00 p:m. on Saturdays'. Prohibit construction on Sundays and
all holidays recognized by the City of Petaluma;.
b. Do not allow the on-site :cleaning or servicing of machinery on weekends or before
7:1.5 a.m. or past 7:45 p:m. Monday through Friday;. and
c. Limit ahe allowable hours for the delivery of materials or equipment to the site and
truck traffic coming to and from the. site for any purpose to weekday (Monday
through Friday) non-holiday hours between 7:3q arn. and 7:00 p.m.
• Construction Equipment Mufflers and Maintenance. Properly muffle and maintain all
construction equipment powered by internal combustion engines.
® Idling Prohibitions. Prohibit unnecessary idling of internal combustion engines.
Equipment. should be turned.. off when not in use:
® Equipment Location and Shielding. Locate all stationary noise-generating construction
equipment, such as air compressors, as far as practical from the adjacent, homes.
Acoustically shield such equipment when itmust be located near adjacent residences.
• Quiet Equipment Selection. Select quiet construction equipment, particularly air
compressors, whenever possible. (Fit motorized equipment with proper mufflers in good
working order.)
o Noise Disturbance Coordinator. Designate a "noise:disturbance coordinator" who would
be responsible for responding to any local complaints about construction noise. This
individual. would most likely be the contractor or. a .contractor's representative. The
disturbance coordinator would determine the cause of'the noise complaint (e.g., starting
too early,, bad muffler, etc.) and would require that reasonable measures warranted to
correct the problem. be implemented. Conspicuously post a telephone number for the
disturbance coordinator at the construction site and include it in the notice sent to
neighbors regarding the construction schedule.
