Summary Statement: .
On July 9, 2009; the City received 8 bids for- the Shollenberger Park Dredge Materials Removal and Disposal for
2005/2006 Disaster Project; ranging from $706;497 to $1,437,812.;70. The project involves the removal and
disposal, of 65,000 cubic yards' of Petaluma River dredge. material from Shollenberger Park. The work is
anticipated to begin ri Gate August and is expected to be completed by the end of October 2009.

Adopt resolution authorizing award of the contract .for Bid Alternate "A" of the Shollenberger
Park Dredge Materials Removal and Disposal for 20.05/2006 Disaster Project Nos. F00334806
and F003.80306 to the low bidder, Evans Brothers.Inc:
2. , BACKGROUND'
During the storm. events. of December 17, 2005 to. January 3, 2006, record-setting heavy rains
resulted in prolonged surface runoff, flooding, and high river levels, causing material to be
deposited in the Petaluma River. This material was dredged and placed at Shollenberger Park
in 2007. This project entails .removing said dredge material from Shollenberger Park and
delivering it to an approved. landfill facility.
The engineer's estimate is $1;;473,211.00. The following is .the summary of bids:

The cost of ,bid Alternate `A' is the same as the cost of the base bid. Utilizing Bid Alternate
`A' allows for -work to be performed six. days per week, 10-12 hours per .day in lieu of the
base bid. that would be performed 5 days per .week, 8 hours per day. Using Bid Alternate `A'
makes this project :completion date prior to the winter rains more likely. The costs for the
various work areas are to be tracked separately for the Federal Emergency Management
Agency/Office of Emergency Services (FEMA/OES) cost recovery. All work associated with
this contract will be 75% funded by FEMA, and 25% by OES.

Staff verified that Evans Brothers Inc. possesses a valid Class A California contractor"s
license which qualifies them to perform the work.

RESOLUTION
AUTIIORIZING AWARD OF .CON'TRACT FOR TI=IE SI-IOLLEEBERGER PARK DREDGE
MATERIALS REMOVAL AND DISPOSAL FOR 2005/2006 DISASTER PRO.IEC'T NOS.
F00334806 ~AND:.F00380306 T.O EVANS BROTHERS INC'.
WHEREAS, City staff, through a design consultant, has. prepared construction bid documents
and advertised for construction ofthis Project; acid
WHEREAS,. in accordance. with the City :of Petaluma :Charter and. Municipal Code; California
Public Contract Code Section 20162 ;and other applicable law, City staff solicited bids for the Project;
and
WHEREAS, the. project was bid on July 9, 2009; and' eight bids were received and opened in
accordance with applicable law;.and.
WHEREAS,, the lowest bid for ,the Project was from. Evans Brothers Inc. for $706,497.00; and
WI-IEREAS, staff -has determined that Evans Brothers Inc.'s bid satisfies the bidding
requirements for the Project; and
W>FIEREAS, staff has'verified that Evans Brothers Inc. possesses a valid California Contractor's.
License, Class A, number 443'018', that..qualifies Evans Brothers, Inc. to perform the Project; and
WHEREAS, the Project is ~categorcally exempt from the California Environmental Quality Act
"CE'QA")~ pursuant to 14 California Code of Regulations, Chapter 3 ("CEQA Guidelines"), Section
15304(g) because it consists of permanent disposal of maintenance: dredging spoils where those spoils
are to be deposited in a spoils area authorized by applicable state and. federal regulations.
NOW, TIIEREFORE, BE.IT RESO><.VED that he Petaluma City Council hereby:
1. In accordance with the :City of .Petaluma Charter and Municipal Code, California Public Contact
Code Section 20162 and. other`applicable law, waives any and ;all non-conformance in the bid of
Evans .Brothers, Iric. for. the .Shollenberger Park Dredge .Materials Removal and Disposal. for
2005/2006, Disaster Project, finds the bid. of $706,497:00 to be the lowest responsive bid and
further.find's thaf Evans Brothers. Irc. is the lowesf responsible bidder.
2. Awards the contract for the .Shollenberger Park Dredge Materials Removal and Disposal. for
2005/2006 Disaster Project to Evans Brothers Inc.. under Bid Alternate .°A'; in the amount of
$706;4;97.00, the_ amount of ,the lowest responsive bid, conditioned on Evans Brothers Inc. timely

executing the' project contract and submitting all required documents, including, but not limited
to,.'executed° bonds; certificates of insurance, and endorsements, in accordance with the project
bid docuineritS.
3.: Directs staffto issue a notice of award to Evans Brothers, Inc.
4. Authorizes and directs the City Manager to execute the project contract on behalf of the City of
Petaluma upon timely submission by Evans Brothers Inc. of the signed project contract and a_Il
