RECOMMENDATION: Adopt a :resolution .approving the project budget and authorizing award of contract for the Crinella Drive Reconstruction Project. 2. BACKGROUND: Proposition 1B {Prop. 1B) prodded $19.925 billion in bond funds for a variety of transportation priorities, including $2 billion for cities and counties to fund the maintenance and improvement of local transportation facilities. As determined by the State Controller's Office, the City of Petaluma's appropriation totaled $1:,764,064 in Prop 1B funding. Funding was broken out into two different allocation years: 2007-08 ($916,741:85) and 2008-09 ($847,322.03). In order to, receive either allocation; the .City had to submit a planned use to the State Department of Finance .for approval prior to disbursement of the funds. On April 7, 2008, City Council approved the $916,741:85', 2007-08 Proposition 1B allocation for the reconstruction of Crinella Drive, from McGregor Avenue to Bungalow Lane. The initial estimates for the project were derived from a visual inspection of the roadway, as well as from the original record drawings dating back to the early 70's. The expected road work was to basically remove and: replace the existing, asphalt;. but not the existing base or sub-base, which was assumed to be adequate: As part of a thorough design, staff required the consultant to conduct a full geotechnical investigation, including borings at six locations within project limits. ~ The geotechrical study concluded that the pavement design used to estimate the construction cost had -not been. adequate; and recommended more extensive (deeper) reconstruction of the roadway: On December 15, 2008; City Council approved the use of the 200.8-09 Prop 1B allocation, also for the Crinella Drive Reconstruction Project, in order to cover the increased. costs due to the need for ari expanded scope of work (full reconstruction of the roadway). Two alternatives were investigated in_early design: one was, a typical roadway reconstruction, which. would remove all of the existing structural ection, to be hauled off-site by the contractor and typcally~taken to a landfill; the other was to recycle the bulk of the materials in-place., The recycled:in-place method not only reduces the amount of material to be taken to a landfill, but also dowers -the amount of green house gas (GHG) emissions produced during the processing of new material and when material is trucked in and out of the construction site. In addition, the~projeet can be completed faster with less disruption to the public using the recycled in-place method, and completed for approximately the same cost. On July 13, 2009, a total of six (6) bids were received, .all of which were- considered responsive. With a bid of $764;294.72, the apparent low bidder is North Bay Construction, Inc. North Bay Construction has satisfactorily performed milar projects for other .municipal agencies. Staff verified that North Bay Construction possesses a valid Class A California contractor's license no. 357560; which qualifies North Bay Construction to perform the work. DISCUSSION: Staff recommends authorizing City.Manager to .enter into, contract with the low bidder, North Bay Construction, Inc.,.. to construct the Crinella Drive Reconstruction Project. If not awarded at this fume, the City will. still be accountable for spending the Proposition 1B funds in the future or risk losing the funding by June 2011. 4. FINANCIAL IMPACTS: The State Department of'Finance approved the City's planned use of Prop 1B funds for this project and has deposited a total of $1,764,064 directly into aCity-designated account. The Prop 1 B funds do not require a :local match. In accordance with -the City of Petaluma Charter and Municipal Code, California Public Contact Code Section 20162 :and other applicable law, waives any and all non-conformance in the bid of North Bay Construction, Inc: for the Crinella Drive. Reconstruction Project, finds the bid of $764,294.72 to be the lowest responsive bid, and further` finds tha_tNorth Bay Construction Inc is the lowest responsible bidder. 3. Awards the contract for the Crinella Drive Reconstruction Project to; North Bay Construction. Inc; in the amount of $764;294.72, the amount .of the lowest responsive bid, conditioned on North Bay Construction, Inc. timely executing the project contract and submitting all. required documents, including; but, not. limited to, executed bonds; certificates of insurance, and endorsements, in accordance with the prgj ect bid documents. 4. Directs. staff to 'issue a:notice of award to North Bay .Construction, Inc. 5. Authorizes and directs the 'City Manager to execute the project contract on behalf of the City of Petaluma upon. timely ~subrnission by North Bray Construction, Inc. of the signed project contract and all other ;required documents, ;including: but not limited to, executed bonds, certificates of insurance, and endorsements,,inaccordancc with the project bid documents.
