HomeMy WebLinkAboutOrdinance 2170 N.C.S. 12/15/2003 _~ _ 1 q ~ ORDINANCE NO. 2170 N.C.S. 2 ~~i~ .~ ~ ~~~~ 3 4 Introduced by Seconded by 5 6 7 Council Member Torliatt Council Member Healy 8 9 10 AN ORDINANCE OF THE COUNCIL OF THE CITY OF PETALUMA AMENDING PETALUMA 11 MUNICIPAL CODE SECTION 1.04.060(8), AMENDING PENALTIES FOR VIOLATIONS OF 12 PROVISIONS OF THE CITY CODE CLASSIFIED AS INFRACTIONS 13 14 15 BE IT ORDAINED BY THE COUNCIL OF THE CITY OF PETALUMA AS FOLLOWS: 16 Section 1 . Amendment. Subsection 1.04.060~B) of the Petaluma Municipal Code 17 is hereby amended to read as follows: 18 19 Pursuant to Government Code Section 36900 (or in amounts 20 provided by subsequent amendments to Government Code 21 Section 36900), unless otherwise specified, any person, firm or 22 corporation convicted of an infraction under the provisions of this 23 code shall be punishable by a fine as follows: upon a first 24 conviction, by a fine not to exceed one hundred dollars; upon a 25 second conviction of a violation of the same code provision 26 committed within one year, by a fine not to exceed five hundred 27 dollars; and for each additional conviction of a violation of the 28 same code provision committed within one year, by a fine not to 29 exceed one thousand dollars. Unless otherwise specified, any 30 person, firm or corporation convicted of a misdemeanor under the 31 provisions of this code shall be punishable by a fine not to exceed 32 one thousand dollars, or by imprisonment in the county jail for a 33 period of not more than six months, or by both such fine and 34 imprisonment. 35 36 Section 2. If any section, subsection, sentence, clause or phrase or word of this 37 ordinance is for any reason held to be unconstitutional, unlawful or otherwise invalid by Ordinance No. 2170 N.C.S. Page 1 ... :. ,' 1 a court of competent jurisdiction, such decision shall not affect the validity of the 2 remaining portions of this ordinance. The City Council of the City of Petaluma hereby 3 declares that it would have passed and adopted this ordinance and each and all 4 provisions thereof irrespective of the fact that any one or more of said provisions be 5 declared unconstitutional, unlawful or otherwise invalid. 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 Section 3. This ordinance shall become effective the later of thirty (30) days after the date of its adoption by the Petaluma City Council or January 1, 2004. Section 4.
