10 AUTHORIZING THE CITY MANAGER TO EXECUTE ALL DOCUMENTS RELATING TO THE
11 EXCHANGE OF THE PROPERTY BETWEEN THE CITY AND SHAMROCK MATERIALS, INC.,
12 BEING A PORTION OF A.P. NOS. 007-700-002 and 007-163-008, RESPECTIVELY,
13 AND TO THE ACCEPTANCE OF AN EASEMENT FROM
14 SHAMROCK MATERIALS, INC.,
15 TO FACILITATE ACCESS BETWEEN MC NEAR PENINSULA PARK,
16 PHASE 1 IMPROVEMENTS AND HOPPER STREET

19 BE IT ORDAINED BY THE COUNCIL OF THE CITY OF PETALUMA AS FOLLOWS:

22 Section 1.
23 The 1987 General Plan identified the desire to prepare a River Plan for the
24 implementation of public access and riverfront enhancement and restoration goals
25 and objectives. Said Plan was prepared as the River Access and Enhancement Plan,
26 which was adopted in 1996. Said Plan identified public access, riparian habitat
27 enhancement, and bank stabilization improvements to be implemented on the
28 McNear Peninsula proposed park site.

30 Section 2.
31 The City Council authorized City Management to seek a grant from the State of
32 California Department of Parks and the Coastal Conservancy/Bay Area Ridge Trail
33 Funds to allow the development of riverfront amenities on the McNear Peninsula Phase
34 1 property, now known as AP No. 007-700-002 located. on Copeland Street; said grants
35 were approved in the total amount of $500,000,

37 Section 3.
38 City Management, on behalf of the City of Petaluma, has concluded negotiations with
39 the adjacent property owner, Shamrock Materials, Inc., resulting in qn agreed upon

1 property exchange of approximately 4,500 square feet of land through a Lot Line
2 Adjustment process, and the granting of an access easement from Shamrock Materials
3 to the City of Petaluma, approximately 2,800 square feet in area, to complete
4 connection of the planned trail to Hopper Street.

6 Section 4.
7 The City Council finds that exchange of said property, as set forth on Exhibit A,
8 attached hereto, is consistent with the Generdl Plan of the City of Petaluma and is
9 exempt under Section 15316 of the California. Environmental Quality Act guidelines
10 because the exchange is being pursued to establish future public access and
11 restoration and enhancement of natural resources. The City Manager is authorized to
12 execute all documents related to this action of exchanging equal portions of the City
13 and Shamrock properties and the acceptance of an easement from Shamrock
14 Materials, Inc. as identified in Exhibit A, attached hereto.
