HomeMy WebLinkAboutRESOLUTION 2024-137 N.C.S. 11/04/2024 Docusign Envelope ID:CB580FD6-5391-48A9-ABB1-C88FF653EBF1 Resolution No. 2024-137 N.C.S. of the City of Petaluma, California RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PETALUMA AUTHORIZING THE CITY MANAGER OR DESIGNEE TO SUBMIT AN APPLICATION FOR AN AMOUNT UP TO $20,000,000 FOR THE ONE PETALUMA, COMMUNITY RESILIENCE CENTER(CRC) COMMUNITY-DRIVEN INVESTMENTS FOR CHANGE FROM THE U.S. ENVIRONMENTAL PROTECTION AGENCY, OFFICE OF ENVIRONMENTAL JUSTICE AND EXTERNAL CIVIL RIGHTS, ENVIRONMENTAL AND CLIMATE JUSTICE COMMUNITY CHANGE GRANTS PROGRAM AND EXECUTE ALL RELATED DOCUMENTS IF AWARDED WHEREAS, the U.S. Environmental Protection Agency (the "EPA"), Environmental and Climate Justice Community Change Grant Program (Community Change Grants) offers an unprecedented opportunity to transform disadvantaged communities across the United States into healthy, climate resilient, and thriving communities for their current and future residents. The EPA is authorized to provide approximately $2,000,000,000 for the fiscal year 2023-2024 to eligible entities for competitive Community Change Grant (CCG)awards,under the Clean Air Act(CAA) § 138,codified at 42 U.S.C. § 7438,including up to$20,000,000 for implementation projects; and WHEREAS, the EPA issued a Notice of Funding Opportunity("NOFO") dated November 21, 2023, with applications being accepted on a rolling basis over a 12-month period through November 21, 2024; and WHEREAS, these programs will empower communities and their partners to design, develop, and implement multi-faceted community-driven projects to help disadvantaged communities address a wide range of environmental and climate justice issues; and WHEREAS, applicant is a City of Petaluma, and is eligible to submit an application for and administer CCG Program Funds as the Local Government within the State of California, as defined by the regulations in 2 CFR 200.1, as the Lead Applicant and is eligible to enter into a Statutory Partnership with a Community Based Organization(CBO); and WHEREAS, if awarded, City as Lead Applicant hereby agrees to use the CCG funds only for Eligible Activities as approved by EPA and in accordance with all Program requirements, Program Guidelines, other rules and laws, as well as in a manner consistent and in compliance with its Application and other contracts between the Lead Applicant and EPA; and WHEREAS, the City desires to submit an application (the "Application") to the EPA for CCG Program Funding in an amount not to exceed $20,000,000 (the "CCG Award") for eligible activities as approved by the EPA and in accordance with the CCG Program Statutes,the CCG Program Guidelines, other rules and laws, as well as in a manner consistent and in compliance with the Standard Agreement and other contracts between the City and the EPA. NOW, THEREFORE,BE IT RESOLVED,by the City Council of the City of Petaluma as follows: 1. Declares the above recitals to be true and correct and are incorporated into this resolution as findings of the City Council. Resolution No. 2024-137 N.C.S. This action is exempt from the California Environmental Quality Act (CEQA) in accordance with CEQA Guidelines Section 15378(b)(5), as submitting a grant application does not meet CEQA's definition of a "project"because the action does not have the potential for resulting in either a direct physical change in the environment or a reasonably foreseeable indirect physical change in the environment. The proposed Project will be subject to environmental review and approvals before any construction activities occur. The environmental document(s)will be determined when the City receives funding for and initiates the planning, environmental review, and design phase. 3. The City Council hereby authorizes the City Manager or designee to submit an application for an amount up to $20,000,000 for the Community Change Grant Program from the EPA and execute all related documents if awarded. Under the power and authority conferred upon this Council by the Charter of said City.
