of the City of Petaluma, California
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PETALUMA AUTHORIZING
AWARD OF CONTRACT FOR AGRICULTURAL RECYCLED WATER SYSTEM EXPANSION
—ADOBE ROAD PROJECT (C66501936)TO K.J. WOODS CONSTRUCTION,INC.
WHEREAS, City staff has prepared construction bid documents and advertised for construction for the
Agricultural Recycled Water System Expansion—Adobe Road(C66501936) ("Project"); and
WHEREAS, in accordance with the City of Petaluma Charter and Municipal Code, California Public
Contract Code Section 20162, and other applicable law, City staff solicited bids for the Project; and
WHEREAS,the Project was bid on August 23,2024,through the issuing of a Notice Inviting Bids, and eight
(8)bid was received and opened on September 26, 2024, in accordance with applicable law; and
WHEREAS,the lowest responsible base bid for the Project was submitted by K.J. Woods Construction, Inc.
from San Francisco, CA, for a base bid of$2,938,000; and
WHEREAS,the bid submitted by K.J.Woods Construction,Inc.was found by staff to be fair and reasonable;
and satisfies the bidding requirements for the Project; and
WHEREAS, staff has verified that K.J. Woods Construction, Inc. possesses a valid California Contractor's
License, Class A (General Engineering Contractor), number 701797 that qualifies the Contractor to perform the
Project; and
WHEREAS, the City has received no protests concerning the K.J. Woods Construction, Inc. proposal, and
the time to protest the proposal has lapsed; and
WHEREAS, on November 3, 2008, the Council,by Resolution 2008-206, adopted the Resolution Certifying
the Water Recycling Expansion Program (WREP) Environmental Impact Report (EIR); and
WHEREAS, on December 7, 2015, the Council, by Resolution 2015-187 N.C.S., adopted the Resolution
Certifying Addendum No. 1 to the WREP EIR Certified by Resolution No. 2008-206; and
WHEREAS,the total project budget has sufficient funds to cover the cost of this phase of work.
NOW, THEREFORE,BE IT RESOLVED that the City Council of the City of Petaluma hereby:
1. Declares that the above recitals are to be true and correct and are incorporated into this resolution as
findings of the City Council.
2. Determines that the environmental effects of the Agricultural Recycled Water System Expansion—Adobe
Road Project were examined and are within the Scope of the Water Recycling Expansion Program
Environmental Impact Report and subsequent Addenda, which was certified on was certified on

November 3, 2008,by City Council as Resolution No. 2008-206,with addenda certified on December 7,
2015 by City Council Resolution No. 2015-187
3. Approves the project budget for the Agricultural Recycled Water System Expansion — Adobe Road
Contract.
4. In accordance with the City of Petaluma Charter and Municipal Code, California Public Contract Code
Section 20162, and other applicable law, waives any and all non-conformance in the bid of K.J. Woods
Construction, Inc. for the Agricultural Recycled Water System Expansion — Adobe Road project
(C66501936) and finds that K.J. Woods Construction, Inc., is the lowest responsible bidder with a base
bid of$2,938,000.
5. Awards the contract for the Agricultural Recycled Water System Expansion — Adobe Road Project
(C66501936) to K.J. Woods Construction, Inc., in the amount of$2,938,000, the amount of the lowest
responsive bid, conditioned on K.J. Woods Construction, Inc.'s timely execution of the project contract
and submitting all required documents, including but not limited to, executed bonds, certificates of
insurance, and endorsements, in accordance with the project bid documents.
6. Approves a construction contract contingency of$600,000.
7. Authorizes and directs the City Manager to execute the project contract on behalf of the City of Petaluma
upon timely submission by K.J. Woods Construction, Inc., of the signed project contract and all other
required documents, including but not limited to, executed bonds, certificates of insurance, and
endorsements, in accordance with the project bid documents.
Under the power and authority conferred upon this Council by the Charter of said City.
