AN ORDINANCE OF THE COUNCIL OF THE CITY OF PETALUMA
AMMENDING CHAPTER 11.12.150 OF THE PETALUMA MUNICPAL
CODE FOR VEHICLE CODE ENFORCEMENT OF PRIVATE PROPERTY
ROADWAYS WITHIN THE MAGNOLIA HILLS SUBDIVISION
(MADRONE LANE AND PEPPERWOOD LANE)
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF PETALUMA AS
20 FOLLOWS:

22 WHEREAS, The Magnolia Hills Homeowners Association requests the Police and Fire
23 Departments obtain lawful authorization to enforce Vehicle Code provisions in CVC 21107.5 on
24 roadways within private subdivision; and

26 WHEREAS, The Magnolia Hills Homeowners Association is requesting this because of
27 public safety concerns, and CVC 21107.5 allows the City to adopt this authority by resolution;
28 and

30 WHEREAS, The Magnolia Hills Homeowners Association understands that they are
31 responsible for the appropriate placement of signs and the ongoing maintenance associated with
32 signs and roadways within the private area; and

34 WHEREAS, The Magnolia Hills Homeowners Association understands that no
35 agreement for extra Police and Fire services attaches to this amendment.

37 NOW, THEREFORE, BE IT RESOLVED, the City Council of the City of Petaluma
38 does hereby approve the amendment of PMC 11.12.150 (Private Facilities Identified) to include
39 roads within the Magnolia Hills subdivision pursuant to CVC Section 21107.5.
I If any section, subsection, sentence, clause or phrase or word of this ordinance is for any
2 reason held to be unconstitutional, unlawful or otherwise invalid by a court of competent
3 jurisdiction, such decision shall not affect the validity of the remaining portions of this
4 ordinance. The City Council of the City of Petaluma hereby declares that it would have passed
5 and adopted this ordinance and each and all provisions thereof irrespective of the fact that any
6 one or more of said provisions be declared unconstitutional, unlawful or otherwise invalid.

8 This ordinance shall become effective thirty (30) days after the date of its adoption by the
9 Petaluma City Council.

11 The City Clerk is hereby directed to post this ordinance for the period and in the manner
12 required by the City Charter.
