Seconded by Council Member s 6 Matt Maguire Mike O'Brien s REZONING OF TWO PARCELS (APN 137-061-014 & A PORTION OF APN 137-061- 9 018 ALSO KNOW AS PARCEL 1 ON PARCEL MAP 333) FROM AGRICULTURAL 10 (A) TO PLANNED UNIT DISTRICT (PUD), TO ALLOW FOR DEVELOPMENT OF 11 THE 78-LOT "TRADITIONS" RESIDENTIAL SUBDIVISION LOCATED AT THE 12 SOUTHWEST CORNER OF SONOMA MOUNTAIN PARKWAY AND MARIA DRIVE 13 14 BE IT ORDAINED BY THE COUNCIL OF THE CITY OF PETALUMA AS FOLLOWS: 15 16 Section 1. The City Council finds that the Planning Commission filed its report set forth in its 17 minutes of July 24, 2001, recommending the denial of an amendment to Zoning Ordinance 18 Section 1072 N.C.S., as amended, by reclassifying and rezoning certain lands, being more 19 particularly described as Assessor's Parcel No. 137-061-014 & a portion of 137-061-018 20 located at the southwest corner of Sonoma Mountain Parkway and Maria Drive. 21 22 Section 2. The City Council further finds that said Planning Commission held a public hearing 23 on said proposed amendment on July 24, 2001, after giving notice of said hearing, in the 24 manner, for the period, and in the form required by said Ordinance No. 1.072 N.C.S., as 25 amended. 26 27 Section 3. Pursuant to the provisions of Zoning Ordinance No. 1072 N.C.S., as amended, the 28 City Council finds as follows: 29 30 1. The proposed Amendment to Zoning Ordinance No. 1072 N.C.S., to classify and rezone 31 the subject parcels from Agricultural (A) to Planned Unit District (PUD) will result in a more Ord. 2123 NCS Page 1 of 3 1 I desirable use of land and a better physical environment than would be possible under any single 2 zoning district or combination of zoning districts. 3 a The proposed uses comply with the Planned Unit District designation, which allows inclusion s within its boundaries of a mixture of uses, or unusual density, building intensity, or design 6 characteristics, which would not normally be permitted in a single use district, and to govern 7 the development of residential projects. Additionally, this proposal incorporates the policies s and guidelines of the PUD-Planned Unit District of Article 19A of the Zoning Ordinance. 9 10 2. The public necessity, convenience and welfare clearly permit and will be furthered by 11 the proposed Amendment to the Zoning Ordinance, reclassifying and rezoning the Traditions 12 site to Planned Unit District. 13 14 The Planned Unit District Guidelines/Development Standards describe permitted and 15 conditional uses as well as those, which would not otherwise be allowed to be established at 16 this location. This specific list of uses prevents the creation of any nuisance to the existing 17 surrounding uses. 18 19 3. The requirements of the California Environmental Quality Act (CEQA) have been 20 satisfied through the preparation of an Initial Study and the drafting of a Mitigated Negative 21 Declaration to avoid or reduce to a level of insignificance, potential impacts generated by the 22 proposed Traditions Planned Unit District. 23 24 In compliance with the requirements of the California Environmental Quality Act, an Initial 25 Study was prepared for the rezoning of the site from Agricultural (A) to Planned Unit District 26 (PUD). Based upon the Initial Study, a determination was made that no significant 27 environmental impacts would result. A copy of this notice was published in the Argus Courier 28 and provided to residents and occupants within 300 feet of the site, in compliance with CEQA 29 requirements. 30 31 Section 4. Pursuant to the provisions of Zoning Ordinance No. 1072 N.C.S., and based upon 32 the evidence it has received and in accordance with the findings made, the City Council hereby Ord. 2123 NCS Page 1 of S N 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 adopts an amendment to said Zoning Ordinance No. 1072 N.C.S., so as to reclassify and rezone said property. Section 5. The City Clerk is hereby directed to post this Ordinance for the period and in the manner required by the City Charter. IF ANY SECTION, subsection, sentence, clause or phrase or word of this Ordinance is for any reason held to be unconstitutional, unlawful or otherwise invalid by a court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this Ordinance. The City Council, of the City of Petaluma, hereby declares that it would have passed and adopted this Ordinance and each and all provisions thereof irrespective of the fact that any one or more of said provisions be declared unconstitutional, unlawful or otherwise invalid.
