CALIF®RNIA FIRE C®DE, INC®RP®RATING THE 1997 EDITI®N ®F
THE UNIF®R1VI FIRE C®DE AND UNIF®R1VI FIRE C®DE STANDARDS.
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF PETALUMA AS FOLLOWS:
SECTI®N 1
Section 17.20.010 of the 1Vlunicipal Code is hereby amended to read as follows:
17.20.010 AD®PTI®N ®F CALIF®RNIA BUILDING STANDARDS TITLE 24,
PART 9, CALIF®RNIA FIRE C®DE, INC®RPORATING THE 1997
EDITI®NS ®F TDE UNIF®RM FIRE C®DE (UFC).
There is hereby adopted by the City of Petaluma for the purpose of prescribing regulations
governing conditions hazardous to life and property from fire, hazardous materials or explosion
that certain Code and Standards known as the California Building Standards Title 24, Part 9,
California Fire Code, incorporating the 1997 edition of the Uniform Fire Code, including
Appendix Chapters I-A, I-C, II-B, II-C, II-F, III-B, III-C, III-D, IV-A, VA, VI-A, VI-B, VI-D
and VI-E, and appendix standards 10-1, 10-2,10-3, 74-2, 79-3, 79-5, 80-1, 81-1, 81-2, 81-3, 82-1,
88-1 published by the International Fire Code Institute, being particularly the 1997 edition and
the whole thereof, save and except such portions as are hereinafter deleted, modified or amended
by this chapter; not less than one (1) copy of this has been and is now filed in the office of the
clerk of the City and the same is adopted and incorporated as fully as if set out at .length herein
and the provisions thereof shall be controlling within the limits of the City.
SECTI®N 2
Section 17.20.025 is added to the Petaluma 1Vlunicipal Code to read as follows:
17.20.025 1VI®DIFICATI®NS
The Chief or his/her designated representative may, on a case-by-case basis, modify any of the
provisions of the Uniform Fire Code upon application in writing by the owner or lessee, or

his/her duly authorized agent, when the Chief or his/her designated representatives determine
there are practical difficulties in the way of carrying out the strict letter of the code, provided that
the spirit of the code shall be observed, public safety secured, and substantial justice done. The
particulars of such modification when granted or allowed and the decision of the Chief or his/her
designated representative thereof shall be entered upon the records of the department and a
signed copy shall be furnished the applicant. For the purposes of this section, the cost of
compliance with the provisions of this Code shall not constitute a practical difficulty.
SECTION 3
Section 17.20.030 of the Petaluma 1Vlunicipal Code entitled "Definitions" is hereby
amended by addeng new sub-paragraph C., to read as follows:
Whenever the term "Uniform Fire Code" is used in this ordinance, it shall mean the "California
Building Standards Title 24, Part 9 California Fire Code, incorporating the 1997 edition of the
Uniform Fire Code".
SECTION 4
CITY CLEF -FILING
The city clerk is hereby directed to file this ordinance, specifically the modification of the
Uniform Fire Code, 1997 Edition, and the attached findings of fact, with the California
Department of Housing and Community Development.
SECTION 5
12EPEAL OF CONFLICTING OItIIINANCES.
All former ordinances or parts thereof conflicting or inconsistent with the provisions of this
ordinance or of the Code or Standards hereby adopted are hereby repealed.
IF ANY SECTION, subsection, sentence, clause or phrase or word of this ordinance is for any
reason held to be unconstitutional, unlawful or otherwise invalid by a court of competent
jurisdiction, such decision shall not affect the validity of the remaining portions of this
ordinance. The City Council of the City of Petaluma hereby declares that it would have passed
and adopted this ordinance and each and all provisions thereof irrespective of the fact that any
one or more of said provisions be declared unconstitutional, unlawful or otherwise invalid.
