Introduced by Councilmember Seconded by Councilmember Matt Maguire Janice Cader-Th6mpson REZONING A 7.13 ACRE PARCEL, APN 137-070-069, TO PLANNED UNIT DISTRICT (PUD), TO ALLOW FOR DEVELOPMENT OF A RETAIL/COMMERCIAL SITE, TO BE KNOWN AS THE PARKWAY PLAZA SHOPPING CENTER, LOCATED AT THE CORNER OF RIESLING ROAD AND SONOMA MOUNTAIN PARKWAY BE IT ORDAINED BY THE COUNCIL OF THE CITY OF PETALUMA AS FOLLOWS: Section 1. The City Council finds that the Planning Commission filed with the City Council on April 19, 1999, its report set forth in its minutes of February 23,1999, recommending the adoption of an amendment to Zoning Ordinance Section 1072 N.C.S., as amended, by reclassifying and rezoning certain lands being more particularly described as Assessor's Parcel Number 137-070-069, a 7.13 acre site located at the corner of Riesling 28 Road and Sonoma Mountain Parkway. 29 30 Section 2. The City Council further finds that said Planning Commission held a public 31 hearing on said proposed amendment on February 23, 1999, after giving notice of said 32 hearing, in the manner, for the period, and in the form required by said Ordinance No. 1072 33 N.C.S., as amended. 34 35 Section 3. Pursuant to the provisions of Zoning Ordinance No. 1072 N.C.S., as amended, 36 the City Council finds as follows: 37 Ord. 2090 NCS Page 1 of 3 Page 1 1 1. The proposed Amendment to the Zoning Ordinance No. 1072 N.C.S., to reclassify 2 and rezone Assessor's Parcel No. 137-070-069, known as the Parkway Plaza 3 Shopping Center, from Agricultural (A), to Planned Unit District (PUD), to 4 accommodate primarily the northeast quadrant of the City is in general conformity 5 with the Petaluma General Plan. 6 7 2. The public necessity, convenience and general welfare clearly permit and will be 8 furthered by the proposed Amendment to the Zoning Ordinance, reclassifying and 9 rezoning the Parkway Plaza Shopping Center site to PUD. 10 11 3. The requirements of the California Environmental Quality Act (CEQA) have been 12 satisfied through preparation of an Initial Study/Mitigated Negative Declaration to 13 avoid or reduce, to a level of insignificance, potential impacts generated by the 14 proposed Parkway Plaza Shopping Center PUD. 15 16 Section 4. Pursuant to the provisions of Zoning Ordinance No. 1072 N.C.S., and based 17 upon the evidence it has received and in accordance with the findings made, the City 18 Council hereby adopts an amendment to said Zoning Ordinance No. 1072 N.C.S., so as to 19 reclassify and rezone said property herein referred to, in accordance with the 20 recommendation of the Planning Commission. 21 22 Section 5. The City Clerk is hereby directed to post this Ordinance for the period and in 23 the manner required by the City Charter. 24 25 IF ANY SECTION, subsection, sentence, clause or phrase or word of this Ordinance is for 26 any reason held to be unconstitutional, unlawful or otherwise invalid by a court of 27 competent jurisdiction, such decision shall not affect the validity of the remaining portions 28 of this Ordinance. The City Council of the City of Petaluma hereby declares that it would 29 have passed and adopted this Ordinance and each and all provisions thereof irrespective of 30 the fact that any one or more of said provisions be declared unconstitutional, unlawful or 31 otherwise invalid.
