Section 17.04.010 of the Petaluma Municipal Code is hereby amended to read 39 as follows: 40 41 42 1 Ord. 2086 NCS Page 1 of 14 1 17.04.010 Codes Adopted. 2 There is hereby adopted by the City of Petaluma for the purpose of 3 establishing rules and regulations governing building activity in the 4 City, providing for the collection of permit fees, the issuance of 5 permits; the adoption of the latest editions of recognized codes; 6 amendment of such codes, and thus regulate the erection, 7 construction, enlargement, alteration, repair, moving, removing, 8 conversion, demolition, occupancy, use, height and area; including 9 the installation of electrical, gas plumbing and mechanical systems; 10 including regulations applying to the construction of fences, signs, 11 swimming pools, yard drainage systems, grading and excavation of 12 land; and provide for the abatement of unsafe buildings; the 13 following uniform codes: 14 15 A. Uniform Building Code, 1997 Edition, Volumes 1, 2, and 3, 16 as adopted and published by the International Conference of 17 Building Officials, including all appendices except Volume 1 18 Appendix Chapter #4, Barriers For Swimming Pools, Spas 19 and Hot Tubs; Volume 1 Appendix Chapter #11, 20 Accessibility; and Volume 1 Appendix Chapter #30 21 Elevators, Dumbwaiters, Escalators and Moving Walks. 22 23 With respect to Uniform Building Code, the following 24 sections shall be included: 25 26 106.4.4. Definition of `Abandoned': "Work shall be 27 considered abandoned if an inspection has not been 28 recorded and approved within 180 days." 29 30 Ord. 2086 NCS Page 2 of 14 2 1 107.5.1.2(a) A Stop Work Order will be issued when: 2 3 a) Work is being done or has been done without a 4 permit. 5 b) Work being done is beyond the scope of the issued 6 permit. 7 c) Work being done does not match approved plans. 8 d) Work being done violates current adopted Building 9 Codes. 10 e) Work being done in violation of Municipal Code and 11 Zoning Ordinance. 12 13 107.5.1.2(b) Violators receiving a Stop Work Order are required 14 to respond to the Building Division within 48 hours 15 of the issued notice to receive instructions on how 16 to rescind the order. If no response is forthcoming, 17 within 48 hours, the Building Division will forward a 18 Building Code Violation memo to the City 19 Attorney's Office for abatement action. A copy of 20 the abatement request will be sent to the Planning 21 Department for their use and information. 22 23 107.5.1.2(c) A building permit application with constructions 24 plans and supporting (structural calculations, energy 25 calculations, handicapped access) documents must 26 be submitted for approval within 15 working days 27 following response to the Building Division. Plans 28 will be reviewed within 15 working days and a 29 correction letter issued or permit application 30 approved. A response to any correction letter must Ord. 2086 NCS Page 3 of 14 3 1 be returned within 15 working days. Five working 2 days will be required to review this second 3 submission and a permit approved for issue. Permits 4 ready for issue must be issued within 5 working 5 days. All construction must be inspected as work 6 progresses and signed off by all (affected) 7 departments within 60 days of building permit 8 issuance. 9 10 107.5.1.2(d) All time limitations for plan check review and 11 construction indicated in the building codes shall not 12 apply to any work indicated in Section (a) that has 13 received a Stop Work Order. 14 15 107.5.1.2(e) An additional fee of double the permit fee shall be 16 added to each permit reflecting a Stop Work Order. 17 18 Section 207 and 214 of the 1Tniform Building Code are hereby amended as follows: 19 20 207I)efinition 21 22 "Fully sprinklered building -residential" is added to read as follows: 23 24 FULLY SPRINKLERED BUII.,DING RESIDENTIAL -shall mean the installation of automatic 25 fire sprinklers in attics, garages, (attached or not) and other unprotected spaces in addition to any 26 other fire sprinkler system required for residential structures. 27 28 29 30 Ord. 2086 NCS Page 4 of 14 4 1 214 Definition 2 3 "Multi-Family Dwelling" is added to read as follows: 4 5 MULTI-FAMILY DWELLING -Any structure containing more than one living uriit or designed 6 to be occupied by more than one family unit. This definition is applicable only as it relates to the 7 installation of a fire sprinkler system. 8 9 904.2.1 Fire sprinkler requirements for all Occupancies is deleted in its entirety. 10 11 Sections 904.1.1, 904.1.2, 904.1.2.1, 904.2.1, 904.2.1.1, 904.2.1.2, 904.2.1.3, 904.2.1.4, 12 904.2.1.5, 904.2.1.6 and 904.2.9 are hereby added to read as follows: 13 14 904.1.1 General 15 16 An automatic fire extinguishing system shall be installed in the occupancies and locations as set 17 forth in this section. 18 19 904.1.2 Standards 20 21 Fire extinguishing systems shall comply with the National Fire Protection Association and/or 22 Petaluma City Fire Department standards. When conflicts occur between NFPA. and local 23 standards, the local standards shall prevail. 24 25 26 27 28 29 30 s 1 904.1.2.1 lJniform Building Code (iJBC) standards for sprinklers and standpipes. 2 3 Where the 1997 edition of the UBC standards 9-1 and 9-3 (automatic fire sprinkler systems) and 4 9-2 (standpipe systems) are referenced in this code, substitute the current edition of NFPA 13, 5 13D, 13R, and 14 respectively. 6 7 904.2.1 Fire Extinguishing Systems (sprinklers) in Commercial Buildings Required. 8 9 Commencing on or after July 1, 1999, all commercial buildings or structures for which building 10 permits are submitted, shall have an approved fire sprinkler system. 11 12 Exception: Buildings which do not exceed 1000 square feet and present no exposure 13 hazard to other structures. 14 15 904.2.1.1 Existing Commercial Buildings 16 17 Required throughout all existing commercial buildings which are added to and: 18 19 1. Increases the original square footage by 25 or 20 2. Causes the structure to exceed 24 feet. in height at any point. 21 22 904.2.1.2 Change of Occupancy 23 24 In all buildings or tenant spaces where a change of occupancy results in an increased hazard 25 classification to the building or tenant space as defined in table 3-A of the UBC, 1997 edition. 26 27 904.2.1.3 Destroyed by Fire 28 29 In all existing commercial buildings where fire burns more than 50% of the structure as 30 determined by the Fire Marshal and Building Official. Ord. 2086 NCS Page 6 of 14 6 1 2 904.2.1.4 Lot Splits 3 4 In all existing structures on land parcels that are split or subdivided where emergency vehicle 5 access, water supply, grade(s), or other conditions exist which do not meet Fire Code or City 6 standards. 7 8 904.2.1.5 Annexations into the City 9 10 In all existing commercial structures which are annexed to the city when: 11 12 1. The occupancy use of the building which increase the fire hazard and/or is a hazardous 13 occupancy, as defined in Table 3-A of the UBC 1997 edition, or 14 2. The building square footage is 3.500 square feet or more. 15 16 904.2.1.6 Design Criteria 17 18 Fire sprinkler systems installed in buildings of undetermined use shall be designed and installed to 19 have a design density of (.33) gallons per minute per square foot over a minimum design area of 20 3000 square feet. Where a subsequent occupancy change requires a system with greater capacity, 21 it shall be the building owners' responsibility to upgrade the system to the required density and 22 meet any additional. requirements of the Fire Code at the time of such change. 23 24 904.2.9 Group I2, Division 1 ®ccupancies and Multi-Family Dwellings. 25 26 An automatic sprinkler system shall be installed throughout every apartment house and multi- 27 family dwelling. Residential or quick response standard sprinklers shall be used in the dwelling 28 units guest room portions of the building. 29 Ord. 2086 NCS Page 7 of 14 7 1 Sections 904.2.10, 904.2..10.1, 904.2.10.2, and 904.2.10.3 of the 1V1<unicipal Code are hereby 2 added to read as follows: 3 4 904.2.10 Fire Extinguishing Systems (sprinklers) Residential Structures Required. 5 6 In all newly constructed single family dwellings that: 7 8 1. Exceed 3500 square feet (until July 1, 2000 -see 1003.2.10.1). 9 2. Are outside the Petaluma FD four minute response area. 10 3. Are three or more stories in height. 11 4. Are located in a Very High. Fire Hazard Severity Zone. 12 5. Are located at elevations or in areas where the water supply does not meet fire flow 13 requirements. I4 6. Are. located more than 150 feet from an approved all weather emergency vehicle access. 15 7. Are located where access is hampered by insufficient road widths, excessive grades, lack 16 of adequate turnarounds, or other conditions which would impede or delay emergency 17 response vehicles. 18 8. A fully sprinklered building (residential -see definition, Section 207) shall be required 19 when two or more conditions as noted in section 1003.2.10 (items 2-7) are present. 20 21 904.2.10.1 Residential Fire Extinguishing System Required After duly 1, 2000. 22 23 Commencing on or after July 1, 2000, all single family dwellings for which a building permit is 24 submitted shall require a residential fire extinguishing system designed in accordance with NFPA 25 13 "D". A fully sprinklered building (residential -see definition, Section 207) shall be required as 26 conditions exist per 1003.2.10(#8). 27 28 904.2.10.2 Residential Type Sprinkler Heads. 29 Ord. 2086 NCS Page 8 of 14 8 1 Fire sprinklers installed in residential occupancies shall be approved and listed quick response type 2 heads in living and sleeping areas. 3 4 904.2.10.3 Residential Conversions and Additions S 6 Fire sprinkler systems shall be installed in all single-family dwellings which are converted to 7 duplexes, bed and breakfasts, inns, lodging houses, or similar uses (see multi-family definitions, 8 Section 207). All additions in residents with an existing sprinkler system shall require the 9 extension of the sprinkler system into the addition. Existing residences in which an addition occurs 10 and no fire sprinkler system has been installed will not require installation of a .sprinkler system in 11 either the existing structure or the addition. 12 13 1804.8 Crawl Space Grade and Drainage. 14 Foundation walls shall have a 3" (minimum) 15 diameter through wall pipe to conduct underfloor 16 water to the outside of the building. Underfloor 17 area shall be graded to the through-wall pipe and 18 exterior grading shall be sloped away from the 19 building. 20 21 Grade level in underfloor areas shall not be lower 22 than exterior grade unless adequate drainage to a 23 positive outfall is provided. Where any water will 24 collect in the underfloor area, an approved drainage 25 system shall be provided. 26 27 106.2(5) Retaining Walls shall be amended to read as stated 28 in 17.04.035 Amendment Uniform Building Code. 29 Ord. 2086 NCS Page 9 of 14 9 1 1503 Roof Covering Material shall be revised to read as 2 stated in 17.04.045 Amendment Uniform Building 3 Code for roof covering material to be Class "B" or 4 better. 5 6 B. Uniform Housing Code, 1997 Edition, as the same is 7 adopted and published by the International Conference of 8 Building Officials. 9 C. Dwelling Construction Under the Uniform Building Code, 10 1997 Edition, as the same is adopted and published by the 11 International Conference of Building Officials. 12 D. Uniform Code for the Abatement of Dangerous Buildings, 13 1997 Edition, as the same is adopted and published by the 14 International Conference of Building Officials. 15 E. Urform Administrative Code, 1997 Edition, as the same is 16 adopted and published by the International Conference of 17 Building Officials. 18 F. Uniform Building Security Code, 1997 Edition, as the same 19 is adopted and published by the International Conference of 20 Building Officials. 21 G. Uniform Sign Code, 1997 Edition, as the same is adopted 22 and published by the International Conference of Building 23 Officials, except Section 303 is omitted. 24 H. Dwelling Construction under the Uniform Mechanical 25 Code, 1997 Edition, as published by the International 26 Conference of Building Officials. 27 I. 1997 Analysis of Revisions to the Uniform Building Codes 28 as the same is adopted and published by the International 29 Conference of Building Officials. Ord. 2086 NCS Page 10 of 14 10 1 J. Uniform Mechanical Code, 1997 Edition, as the same is 2 adopted and published by the International Conference of 3 Building Officials. 4 K. Uniform Plumbing Code, 1997 Edition, as the same is 5 adopted and published by the International Association of 6 Plumbing and Mechanical Officials. 7 L. Uniform Swimming Pool, Spa and Hot Tub Code, 1997 8 Edition, as the same is adopted and published by the 9 International Association of Plumbing and Mechanical 10 Officials. 11 M. Uniform Solar Energy Code, 1997 Edition, as the same is 12 adopted and published by the International Association of 13 Plumbing and Mechanical Officials. 14 N. National Electrical Code, 1996 Edition, as adopted and 15 published by the National Fire Protection Association. 16 17 All references to permit fees are hereby deleted. The permit fees shall be fixed by the Fee 18 Schedules adopted by the City Council by Resolution. 19 20 Section 2. Section .17.04.035 of the Petaluma Municipal Code is hereby amended to 21 read: 22 23 17.04.35 Amendment -Uniform Building Code. 24 Section 106.2, Exemption #5 of the 1997 Uniform Building Code as adopted in 25 Section 17.04.010 is amended to read as follows: 26 "Retaining walls which are not over two (2) feet in height measured from top of 27 the footing to the top of the wall, unless supporting a surcharge, or impounding flammable 28 liquids." Ord. 2086 NCS Page 11 of 14 11 1 "Property line retaining walls may be of all heart redwood up to two (2) feet in 2 height; property line retaining walls up to four (4) feet shall be of pressure treated lumber; 3 property line retaining walls over four (4) feet to be engineered." 4 "On-site retaining wall s up to four (4) feet may be of all heart redwood or 5 pressure treated; over four (4) feet walls shall be engineered and set back a minimum 6 distance equal to the height of the wall from the property line or foundation of the 7 building." 8 "Height of walls are measured from the bottom of finished board or top of footing 9 to top of finished board." (Ord. 1727 N.C.S., .1988.) 10 11 Section 3. Section 17.04.040 of the Petaluma Municipal Code is to be deleted. All 12 permit fees shall be fixed by the fee schedules adopted by the city council by Resolutions as stated 13 in Section 17.04.010. 14 Section 4. Section 17.04.045 of the Petaluma Municipal Code is hereby amended to 15 .read: 16 17 fl7.04.045 Amendments -Uniform Building Code. 18 The following sections of the Uniform Building Code as adopted in Section 19 17.04.010 are amended to read as follows: 20 A. Section 2310. 21 "All roof covering materials applied as exterior wall covering shall have a 22 fire rating of Class "B" or better, in accordance with UBC Standard 15-2. 23 B. Section 1503: 24 "All materials applied as roof covering shall have a fire rating of Class "B" 25 or better, in accordance with UBC Standard 15-2." 26 C. Appendix Section 1514. Reroofing. 27 "All materials applied as roof covering for reroofing shall have a fire rating 28 of Class "B" or better; material in accordance with UBC Standard 15-2." (Ord. 29 1744 N.C.S: 2, 1988.) 30 Ord 2086 NCS Page 12 of 14 12 1 Section 5. Section 17.04.050 of the Petaluma Municipal Code is to be deleted. 2 Appendix C of the Uniform Plumbing Code as adopted by Section 17.04.010 is now' part 3 of the body of the Code and is mandatory. 4 5 Section 6. Section 17.04.060 of the Petaluma Municipal Code is to be deleted. This 6 amendment to the Uniform Plumbing Code is not needed as State Law/Code mandates 7 that "ultra-low flush" water closets be installed. 8 9 This Ordinance supersedes and makes void Petaluma Ordinance 1998 N.C.S./1996. 10 11 FINDINGS OF FACT 12 13 Pursuant to California Health and Safety Code Section 17958.7, the attached findings are hereby 14 made and the amendment made to the Uniform Building Code (1997 Edition) is necessary due to 15 local climatic, geological or topographical conditions. 16 17 CITY CLERK -FILING 18 19 The City Clerk is hereby directed to file this ordinance, specifically the modification of the 20 Uniform Building Code (1997 Edition), and the attached findings of fact with the California 21 Department of Housing and Community Development and the California Building Standards 22 Commission. 23 24 Section 7. If any section, subsection, sentence, clause or phrase or word of this ordinance 25 is for any reason held to be unconstitutional by a court of competent jurisdiction, such decision 26 shall not affect the validity of the remaining portions of this ordinance. The City Council of the 27 City of Petaluma hereby declares that it would have passed and adopted this ordinance and each 28 and all provisions thereof irrespective of the fact that any one or more of said provisions be 29 declared unconstitutional. 30 Ord. 2086 NCS Page 13 of 14 13 1 Section 8. Effective Date. This ordinance to take effect July 1, 1999. All plans submitted 2 before July 1, 1999 will be reviewed under 1994 Codes. All plans submitted after July 1, 1999 3 will be reviewed under the 1997 Building Codes and the 1996 National Electrical Code. Existing 4 subdivisions with approved plans under the 1994 Codes will be allowed to complete that phase of 5 the work, all new phases or models not previously approved will be reviewed under the 1997 6 Codes. 7 8 Section 9.
