AN ORDINANCE AUTRORIZING AIVIENIDIVIENT TO
PUBLIC EMPLOYEES RETIREIVIENT SYSTEM CONTRACT
BETWEEN TDE CITY OF PETALUMA
AND TDE BOAR OF AI)1VIINISTItATION OF TDE CALIFORNIA
PUBLIC EMPLOYEES' RETIREMENT SYSTEM
BE IT ORDAINED by the City Council of the City of Petaluma as follows:
Section 1. That an amendment to the contract between the City of Petaluma and the
Board of Administration, California Public Employees' Retirement System is hereby authorized, a
copy of said amendment being attached hereto, marked Exhibit, and by such reference made a part
hereof as though herein set out in full. The amendment relates to Section 21573 -Third Level of
.1.959 .Survivor Benefits for local miscellaneous members as set forth in the attached exhibit.
The following is a list of the options this City has under contract with the California Public
Employees' Retirement System, including the subject of this ordinance:
a. Section 21222.1 (Special 5% Increase-1970). Legislation repealed said Section
effective January 1, 1980.
b. Section 20042 (One Year Final Compensation)
c. Section 20965 (Credit for Unused Sick Leave)
d. Section 21326 (Special 1%-7% Increase) for or on behalf of those local miscellaneous.
members who retired or died prior to July 1, 1974
e. Sections 21624, 21626, and 21628 (Post-Retirement Survivor Allowance) for local
fire members only
f. Section 21024 (Military Service Credit as Public Service), Statutes of 1976
g. Section 21574 (Fourth Level of 1959 Survivor Benefits) for local safety members only

h. Section 21573 (Third Level of 1959 Survivor Benefits) for local miscellaneous
members.
Section 2. The Mayor of the City Council of the City of Petaluma is hereby authorized,
empowered, and directed to execute said amendment for and on behalf of said City.
Section 3. This ordinance shall take effect thirty (30) days upon its adoption, and prior to
the ordinance adoption, it shall be published one time in the Argus Courier, a newspaper of general
circulation, published and circulated in the City of Petaluma and thenceforth and thereafter the same
shall be in full force and effect.
Section 4. If any section, subsection, sentence, clause or phrase or word of this ordinance
is for any reason held to be unconstitutional by a court of competent jurisdiction, such decision shall
not affect the validity of the remaining portions of this ordinance. The City Council. of the City of
Petaluma hereby declares that it would have passed and adopted this ordinance and each and all
provisions thereof irrespective of the fact that any one or more of said provisions be declared
unconstitutional.
Section 5. The City Clerk is hereby directed to publish this ordinance for the period and in
the manner required by the City Charter.
