REZONING A 1.36 ACRE PARCEL
LOCATED AT 850 KEOKUK STREET, APN 006-031-048, FROM C-H,
HIGHWAY COMMERCIAL, TO PUD, PLANNED UNIT DISTRICT
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF PETALUMA AS FOLLOWS:
Section 1. The City Council finds that the Planning Commission filed with the City Council on
January 19, 1999, its report set forth in its minutes of December 8, 1998, forwarding a
recommendation to the City Council to adopt a rezoning of a 1.36 acre parcel, APN 006-031-
048, located at 850 Keokuk Street, from C-H, Highway Commercial, to PUD, Planned Unit
District.
Section 2. The City Council further finds that the Planning Commission held a public hearing on
the proposed amendment on December 8, 1998 after giving notice of said hearing, in the manner,
for the period, and in the form required by said Ordinance No. 1072 N.C.S., as amended.
Section 3. The City Council further finds that the requirements of the California Environmental
Quality Act (CEQA) have been satisfied through the preparation of an Initial Study, and, by
Resolution No. 99-18 N.C.S., has adopted a Negative Declaration for the project, finding that
there is no substantial evidence that significant impacts to the environment would occur.
Section 4. The City Council has reviewed the proposed Rezoning and the PUD Development
Standards for the subject parcel from C-H; Highway Commercial, to PUD, Planned Unit District,
and in accordance with the recommendation of the Planning Commission, does hereby find:
4o A. That the Planned Unit District will result in a more desirable use of land and a better
41 physical environment than would be possible under any single zoning district or
42 combination of zoning districts.

t The proposed PUD will allow uses more compatible with the existing surrounding uses
2 and will delete some uses currently allowed in the C-H, Highway Commercial District,
3 which may no longer be appropriate for the site. No change is proposed to existing
4 structures, parking, or landscaping. The project has been conditioned to provide
5 additional street trees and to underground overhead utility lines, which will result in a
6 more attractive streetscape. In addition, any future change in use will be required to
7 comply with the provisions of the Zoning Ordinance (unless otherwise provided in the
8 PUD Development Standards), including, but not limited to, building and site design,
9 parking, and landscaping.

1l B. That the proposed rezoning to PUD is consistent with the provisions of Article 19A,
12 Planned Unit District, of the Zoning Ordinance.

14 The project complies with the applicable provisions of Article 19A and provides for
15 development standards and permitted and conditional uses. The Planned Unit District
16 allows for a mixture of uses, densities, building intensity, or design characteristics. In
17 accordance with Article 19A, any and all compatible land uses may be allowed in the
18 PUD.

20 C. That the PUD is proposed on property which has a suitable relationship to one or more
21 thoroughfares, and that said thoroughfares are adequate to carry any additional traffic
22 generated by the development.

24 The site is located at the intersection of Keokuk Street and Magnolia Avenue. Keokuk is
25 designated as a collector street and Magnolia Avenue is designated as an arterial in the
26 General Plan. Site access is provided from both Keokuk Street and Magnolia Avenue.
27 No intensification of use is proposed; therefore, no significant additional traffic would be
28 generated at this time by this project. A future change in use would be evaluated based,
29 in part, on traffic generated and the adequacy of the existing street network to
30 accommodate such traffic.

32 D. That the proposed project, as conditioned, will not be detrimental to the public welfare,
33 will be in the best interests of the City, and will be in keeping with the general intent and
34 spirit of the zoning regulations of the City and with the General Plan.

36 The project, as conditioned, complies with the applicable provisions of the Municipal
37 Code and the General Plan. No change in use is proposed at this time. The existing

1 business has been in operation for 33 years and provides a basic community service. No
2 change is proposed to the existing General Plan designation of Public and Institutional.
3 The existing uses on Parcel I are consistent with the General Plan designation. The
4 existing uses on Parcel 2 are consistent with the General Plan through the zoning
5 designation of PUD, which allows for flexibility in uses and standards. The rezoning
6 does not result in any change to the existing uses from what was previously allowed
7 under the C-H zoning and the General Plan designation of Public and Institutional.

9 Section 5. Pursuant to the provisions of Zoning Ordinance No. 1072 N.C.S., and based upon the
10 evidence it has received and in accordance with the findings made, the City Council hereby
11 adopts the Rezoning for APN 006-031-048 from C-H, Highway Commercial, to PUD, Planned
12 Unit District, and the related PUD Development Standards, as revised or modified.

14 Section 6. The City Clerk is hereby directed to post this Ordinance for the period and in the
15 manner required by the City Charter.

17 IF ANY SECTION, subsection, sentence, clause or phrase or word of this ordinance is for any
18 reason held to be unconstitutional by a court of competent jurisdiction, such decision shall not
19 affect the validity of the remaining portions of this ordinance. The City Council of the City of
20 Petaluma hereby declares that it would have passed and adopted this ordinance and each and all
21 provisions thereof irrespective of the fact that any one or more of said provisions be declared
22 unconstitutional.
