S. 6 7 Introduced by Councilmember Seconded by Councilmember 8 Pamela Torliatt Mary Stompe 9 to AN ORDINANCE OF THE CITY OF PETALUMA AMENDING ZONING 11 ORDINANCE NO 1072 N.C.S., AS AMENDED, BY RECLASSIFYING AND 12 REZONING ASSESSOR'S PARCEL NUMBER 007-057-033 FROM R1-6,500 TO 13 PLANNED UNIT DISTRICT (PUD) 14 PEP PROJECT 167 EDITH STREET 15 BE IT ORDAINED by the Council of the City of Petaluma as follows: 16 Section 1. The City Council finds that the Planning Commission filed with the City Council 17 on August 17, 1998, its report as set forth in its minutes of July 14, 1998, recommending the 18 adoption of an amendment to Zoning Ordinance No. 1072 N.C.S., as amended, by reclassifying 19 and rezoning certain lands being more particularly described as Assessor's Parcel Number 007- 20 057-033 (See Exhibit "A") from R1-6,500 to PUD (Planned Unit District). 21 22 Section 2. The City Council further finds that said Planning Commission held a public hearing 23 , on said proposed amendment to Zoning Ordinance No. 1072 N.C.S., as amended, on July 14, 24 1998, after giving notice of said hearing in the manner, for the period and in the form required by 25 said Ordinance No. 1072 N.C.S., as amended. 26 27 Section 3. Pursuant to the provisions of Zoning Ordinance No. 1072 N.C.S., as amended, the 28 City Council finds the proposed amendment in general conformity with the Petaluma General 29 Plan, and further, that the public interest, convenience and general welfare will be furthered by the 30 proposed amendment. 31 32 Section 4. Pursuant to the provisions of Zoning Ordinance No. 1072 N.C.S., as amended, and 33 based upon the evidence it has received and in accordance with the findings made, the City 34 Council hereby adopts amendment to said Zoning Ordinance NO. 1072, N.C.S. so as to reclassify 1 Ord. 2076 NCS Page 2 of 2 1 2 3 4 5 6 7 and rezone said property hereinbefore referred to in accordance with the recommendation of the Planning Commission. Section 5. The City Council finds that the requirements of California Environmental Quality Act Guidelines, Section 15083, have been satisfied and hereby incorporates by reference the Negative Declaration prepared and approved for the project site. 8 Section 6. The City Clerk is hereby directed to post this Ordinance for the period and in the 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 manner required by the City Charter. IF ANY SECTION, subsection, sentence, clause or phrase or word of this ordinance is for any reason held to be unconstitutional by a court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance. The City Council of the City of Petaluma hereby declares that it would have passed and adopted this ordinance and each and all provisions thereof irrespective of the fact that any one or more of said provisions be declared unconstitutional.
