' " 1 SEP ° 319.98 2 3 4 5 ORDINANCE NO. 2 0 7 5 N.C.S. 6 7 Introduced by Councilmember Seconded by Councilmember 8 9 Vice Mayor Maguire Nancy Read 10 11 12 AMENDING ZONING ORDINANCE NO. 1072 N.C.5. 13 BY RECLASSIFYING AND REZONING CERTAIN PROPERTY 14 AT 204 DOUGLAS STREET, AP NO. 008-161-014, 15 TO ADMINISTRATIVE AND PROFESSIONAL OFFICE (C-O) ZONING DISTRICT 16 17 BE IT ORDAINED BY THE COUNCIL OF THE CITY OF PETALUMA AS 18 FOLLOWS: 19 20 Section 1. The City Council finds that the Planning Commission filed with the City 21 Council on June 9, 1998, its report as set forth in its minutes of June 9, 1998, 22 recommending the adoption of an amendment to Zoning Ordinance No. 1072 N.C.S., by 23 reclassifying and rezoning from Neighborhood -Commercial (C-N) to Adrrunistrative and 24 Professional Office (C-O), certain land more particularly described as a 3.06 acre parcel 25 addressed as 204 Douglas Street, APN 008-161-014. 26 27 Section 2. The City Council further finds that the Planning Commission held a public 28 hearing on the proposed amendment to Zoning Ordinance No. 1072 N.C.S., on June 9, 29 1998, after giving notice of said hearing in the manner, for the period and in the form 30 required by Ordinance No. 1072 N.C.S. 31 Ord. 2075 NCS Page 1 of 3 1 1 Section 3. Pursuant to the provisions of Zoning Ordinance No. 1072 N.C.S., the City 2 Council finds that the proposed amendment to Zoning Ordinance No. 1072 N.C.S. to 3 reclassify and rezone a 3.06 acre parcel, Assessors Parcel No. 008-161-014, known as the 4 Petaluma School District Administrative Offices site, to Administrative and Professional 5 Office (C-O) Zoning District is in general conformity with the Petaluma General Plan. 6 7 Section 4. The City Council further finds that the public necessity, convenience and 8 general welfare clearly permit and will be furthered by the proposed amendment to the 9 Zoning Ordinance, reclassifying and rezoning the Petaluma School District site to C-O. 10 11 Section 5. The City Council further finds that the requirements of the California 12 Environmental Quality Act (CEQA) have been satisfied through the preparation of an 13 Initial Study/Negative Declaration to avoid or reduce to a level of insignificance, potential 14 impacts generated by the proposed Petaluma School District. 15 Section 6. Pursuant to the provisions of Zoning Ordinance No. 1072 N.C.S., and 16 based upon the evidence it has received and in accordance with the findings made, the City 17 Council hereby adopts an amendment to said Zoning Ordinance No. 1072 N.C.S., so as to 18 reclassify and rezone said property herein referred to, in accordance with the 19 recommendations of the Planning Commission (see attached Exhibit). 20 21 Section 7. The City Clerk is hereby directed to post this Ordinance for the period and 22 in the manner required by the City Charter. Ord. 2075 NCS Page 2 of 3 2 Y 1 2 IF ANY SECTION, subsection, sentence, clause or phrase or word of this ordinance is for 3 any reason held to be unconstitutional by a court of competent jurisdiction, such decision 4 shall not affect the validity of the remaining portions of this ordinance.
