HomeMy WebLinkAboutOrdinance 2069 N.C.S. 05/04/1998 VY. ~a~ {~-,~la~ t~ ~ Irv' t~ 'i..,,sl~-~ @ 6cs 7 41998 ORDINANCE NO. 2069 NCS INTRODUCED BY: SECONDED BY: Nancy Read Mary Stompe AN ZTRGENCY ORDINANCE AUTHORIZING AMENDMENT TO PUBLIC EMPLOYEES RETIREMENT SYSTEM CONTRACT BETWEEN THE CITY OF PETALUMA AND THE BOARID OF ADMINISTRATION OF THE CALIFORNIA PUBLIC EMPLOYEES' RETIREMENT SYSTEM BE IT ORDAINED by the City Council of the City of Petaluma as follows: Section 1. That an amendment to the contract between the City of Petaluma and the Board of Administration, California Public Employees' Retirement System is hereby authorized, a copy of said amendment being attached hereto, marked Exhibit, and by such reference made a part hereof as though herein set out in full. The amendments relate to 2 % at 55 for local miscellaneous members and Fourth Level of 1959 Survivors Benefits for local safety members as set forth in the attached exhibit. Section 2. The Mayor of the City Council of the City of Petaluma is hereby authorized, empowered, and directed to execute said amendment for and on behalf of said City. Section 3. This ordinance shall take effect immediately upon its adoption, and prior to the ordinance adoption, it shall be published one time in the Argus Courier, a newspaper of general circulation, published and circulated in the City of Petaluma and thenceforth and thereafter the same shall be in full force and effect. Section 4. Urgency Ordinance -This ordinance shall be adopted as an urgency ordinance pursuant to Government Code Section 25123, "All ordinances shall become effective 30 days from the date of final passage, except the following ordinances, which shall take effect immediately: G.C. §25123 (e) Those specifically relating to the adoption or implementation of a 5/4/98 Ord. 2069 NCS Page 1 of 2 pages i' memorandum of understanding with an employee organization and G.C. §25123 (f) Those relating to salaries and other compensation of officers, other than elected officers, and employees. " Section 5. If any section, subsection, sentence, clause or phrase or word of this ordinance is for any reason held to be unconstitutional by a court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance. The City Council of the City of Petaluma hereby declares that it would have passed and adopted this ordinance and each and all provisions thereof irrespective of the fact that any one or more of said provisions be declared unconstitutional. Section 6. The City Clerk is hereby directed to publish this ordinance for the period and in the .manner required by the City Charter. INTRODUCED and ordered published this 6th day of April, 1998.
