HomeMy WebLinkAboutOrdinance 2061 N.C.S. 10/20/1997 1 ~ ' 2 NO U 19 1997 4~ ~ 3 4 5 6 7 8 _ 9 1o ORDINANCE NO. 2061 N.C.S. 11 12 Introduced by Councilmember Seconded by Councilmember 13 14 Pamela Torliatt Matt Maguire 15 16 AN ORDINANCE OF THE CITY OF PETALUMA AMENDING ZONING 17 ORDINANCE NO. 1072 N.C.S., AS AMENDED, BY RECLASSIFYING AND 18 REZONING A 10.2 ACRE PARCEL LOCATED WEST OF SUNNYSLOPE ROAD 19 BETWEEN SMITH DRIVE AND SUNCREST HILL DRIVE; APN 019-203-007 20 21 22 23 24 BE IT ORDAINED BY THE COUNCIL OF THE CITY OF PETALUMA AS 25 FOLLOWS: 26 27 Section 1. The City Council Finds that the Planning Commission filed with the City 28 Council on October 6, 1997, its report set forth in its minutes of July 22, 1997 (File # 29 TSM97001; Larry's Lollipop PUD) recommending the adoption of an amendment to the 3o Zoning Ordinance No. 1072 N.C.S., as amended, by reclassifying and rezoning certain 31 lands being more particularly described as Assessor's Parcel Number 019-203-007; a 32 10.2 acre site located on the west side of Sunnyslope Road between Smith Drive and 33 Suncrest Hill Drive. 34 35 Section 2. The City Council further finds that said Planning Commission held a 36 public hearing on said proposed amendment on July 22, 1997, after giving notice of said 37 hearings, in the manner, for the period and in the form required by said Ordinance No. 38 1072 N.C.S., as amended. 39 4o Section 3. The City Council further finds that the requirements of the California 41 Environmental Quality Act have been satisfied through the preparation of an Initial Study 42 which indicated that the proposed amendment, as mitigated through the adoption of a 43 Mitigated Negative Declaration pursuant to Resolution 97-274 N.C.S. will not result in a 44 significant impact on the environment. 45 Ord. 2061 NCS Page 1 of 2 1 1 Section 4. Pursuant to the provisions of Zoning Ordinance No. 1072 N.C.S., as 2 amended, the City Council finds as follows: 3 4 IF ANY SECTION, subsection, sentence, clause or phrase or word of this ordinance is 5 for any reason held to be unconstitutional by a court of competent jurisdiction, such 6 decision shall not affect the validity of the remaining portions of this ordinance.
