HomeMy WebLinkAboutOrdinance 2054 N.C.S. 08/04/1997 P': CLM ~ tl ~ pv°~ 1 2 A U G 3- 1997 ~ 3 4 5 6 ORDINANCE NO. 2054 N.C.S. s Introduced by Councilmember Seconded by Councilmember 9 10 Pamela Torliatt Nancy Read 11 12 AN ORDINANCE OF THE CITY OF PETALUMA AMENDING ZONING 13 ORDINANCE NO. 1072 N.C.S., AS .AMENDED, BY RECLASSIFYING AND 14 REZONING A 4~ ACRE PARCEL LOCATED EAST OF SONOMA MOUNTAIN 15 PARKWAY AND IMMEDIATELY SOUTH OF THE AMERICANA SUBDIVISION; 16 APN 137-070-058 17 TUXHORN ESTATES II 18 BE IT ORDAINED BY THE COUNCIL OF THE CITY OF PETALUMA AS 19 FOLLOWS: 20 21 Section 1. The City Council finds that the Planning Commission filed with the City 22 Council on July 21, 1997, its report set forth in its minutes of June 24, 1997 (File # 23 REZ97003/TSM97002 - Tuxhorn Estates II) recommending the adoption of an 24 amendment to the Zoning Ordinance No. 1072 N.C.S., as amended, by reclassifying and 25 rezoning certain lands being more particularly described as Assessor's Parcel Number 137- 26 070-058; a 4f acre site located east of Sonoma Mountain Parkway and immediately south 27 of the Americana Subdivision. 28 29 Section 2. The City Council further finds that said Planning Commission held a public 30 hearing on said proposed amendment on June 24, 1997, after giving notice of said 31 hearings, in the manner, for the period and in the .form required by said Ordinance No. 32 1072 N.C.S., as amended. 33 34 Section 3. The City Council further finds that the requirements of the California 35 Environmental Quality Act have been satisfied through the preparation of an Initial Study 36 which indicated that the proposed amendment, as mitigated through the adoption of a 37 Mitigated Negative Declaration pursuant to Resolution 97-203 N.C.S. will not result in a 3s significant impact on the environment. 39 4o Section 4. Pursuant to the provisions of Zoning Ordinance No. 1072 N.C.S., as 41 amended, the City Council finds as follows: 42 43 Findings for Rezoning to Planned Unit District 44 45 1. The proposed Amendment to Zoning Ordinance No. 1072 N,C.S., to classify and 46 rezone Assessor's Parcel No. 137-070-058, known as the Tuxhorn Estates II 47 project, into a Planned Unit District (PUD) is in general conformity with the 48 Petaluma General Plan/Corona/Ely Specific Plan because it integrates important 49 design features specified, including: appropriate design of streets and pathways for 1 Ord. 2054 NCS Page 1 of 2 1 public use, and a broad range of admirable house designs contributing to attractive 2 streetscapes. 3 2. The public necessity, convenience and general welfare clearly permit and will be 4 furthered by the proposed Amendment to the Zoning Ordinance, classifying and 5 rezoning the Tuxhorn Estates II property, because the project, as conditioned, 6 includes Development Standards/zoning regulations appropriate for the protection 7 and promotion of public health, safety, morals, peace, comfort, convenience, 8 prosperity and general welfare of the residents of this development and the general 9 public. 10 3, The requirements of the California Environmental Quality Act (CEQA) have been 11 satisfied through preparation of an Initial Study/Mitigated Negative Declaration to 12 avoid or reduce to a level of insignificance, potential environmental impacts 13 generated by the proposed Tuxhorn Estates II project. 14 15 IF ANY SECTION, .subsection, sentence, clause or phrase or word of this ordinance is for 16 any reason held to be unconstitutional by a court of competent jurisdiction; such decision 17 shall not affect the validity of the remaining portions of this ordinance.
