18 BE IT ORDAINED BY THE COUNCIL OF THE CITY OF PETALUMA AS
19 FOLLOWS:

21 Section 1. Section 11.76.050 is added to the City of Petaluma Municipal Code as follow:

23 11.76.050 Protective equipment required while using a City of
24 Petaluma Skate Park Facility.
25 No person shall use a City of Petaluma Skate Park Facility who is
26 not wearing a helmet, knee pads, and elbow pads suitable to
27 provide protection in the event of falls or collisions. A first
28 violation of this section shall constitute an infraction. Subsequent
29 violations may constitute an infraction or a misdemeanor pursuant
30 to City Code section 1.04.060.

32 Section 2. If any section, subsection, sentence, clause or phrase or word of this ordinance
33 is for any reason held to be unconstitutional by a court of competent jurisdiction, such decision
34 shall not affect the validity of the remaining portions of this ordinance. The City Council of the
35 City of Petaluma hereby declares that it would have passed and adopted this ordinance .and each
36 and all provisions thereof irrespective of the fact that any one or more of said provisions be
37 declared unconstitutional.

1 Section 3. This project is exempt under CEQA guidelines section 15061(b)(3) in that it
2 can be determined with certainty that there is no possibility that the activity regulated by this
3 ordinance may have a significant effect on the environment.
4 Section 4. This ordinance is declared by the City Council to be an urgency measure
5 necessary for the immediate preservation of the public peace, health, or safety. The facts
6 constituting such urgency are: on May 31, 1997, the City of Petaluma Skate Park Facility was
7 opened to the general public. At the current time, there is no ordinance in place requiring that
8 users of the park use protective equipment. Requiring users to wear protective equipment is
9 deemed necessary to protect the users of the facility from injury. In order to immediately protect
10 and preserve peace, health or safety, it is necessary for this ordinance to be declared an urgency
11 ordinance.
12 Section 5. This ordinance shall become effective immediately upon passage by four-fifths
13 vote of the City Council.
14 Section 6. The City Clerk is hereby directed to post this ordinance for the period and in
15 the manner required by the City Charter.
