17 AMENDING ZONING ORDINANCE NO. 1072 N.C.S., AS AMENDED, BY
1s RECLASSIFYING AND REZONING A 68~ ACRE PARCEL LOCATED EAST OF
19 SONOMA MOUNTAIN PARKWAY AT CHEHALIS DRIVE TO A PLANNED UNIT
20 DISTRICT TO ALLOW FOR DEVELOPMENT OF THE WILLOW GLEN
21 RESIDENTIAL PROJECT; APN 136-080-009 & 010

23 BE IT ORDAINED BY THE COUNCIL OF THE CITY OF PETALUMA AS
24 FOLLOWS:

26 Section 1. The City Council Finds that the Planning Commission filed with the City
27 Council on March 17, 1997, 'its report set forth in its minutes of February 25, 1997 (File #
2s REZ/PUD/TSM 95005) recommending the adoption of an amendment to the Zoning
29 Ordinance No. 1072 N.C.S., as amended, by reclassifying and rezoning certain lands being
3o more particularly described as Assessor's Parcel Number 136-080-009 & 010; a 68~ acre
31 site located east of Sonoma Mountain Parkway at Chehalis Drive.

33 Section 2. The City Council fizrther finds that said Planning Commission held a public
34 hearing on said proposed amendment on February 25, 1997, after giving notice of said
35 hearings, in the manner, for the period and in the form required by said Ordinance No.
36 1072 N.C.S., as amended.

3g Section 3. The City Council further finds that the requirements of the California
39 Environmental Quality Act have been satisfied through the preparation of an expanded
4o Initial Study which indicated that the proposed amendment, as mitigated through the
41 adoption of a Mitigated Negative Declaration pursuant to Resolution 97-86 N.C.S. will
42 not result in a significant impact on the environment.

3 Section 4. Pursuant to the provisions of Zoning Ordinance No. 1072 N.C.S., as
4 amended, the City Council finds as follows:

6 Findings for Rezoning to Planned Unit District

8 1. The proposed Amendment to Zoning Ordinance No. 1072 N.C.S., to classify and
9 rezone Assessor's Parcel No.136-080-009 & 010, known as the Willow Glen
to project, into a Planned Unit District (PUD) is in general conformity with the
11 Petaluma General Plan/Corona/Ely Specific Plan because it integrates important
12 design features specified, including: significant Open .Space habitat/corridor along
13 Lynch Creek, the addition of a four acre public park, appropriate design of streets
14 and ,pathways for public use, and a broad range of admirable house designs
15 contributing to attractive streetscapes.

17 2. The public necessity, convenience and general welfare clearly permit and will be
18 furthered by the proposed Amendment to the Zoning Ordinance, classifying and
19 rezoning the Willow Glen property, because the project, as conditioned, includes
20 Development Standards/zoning regulations appropriate for the protection and
21 promotion of public health, safety, morals, peace, comfort, convenience, prosperity
22 and general welfare of the residents of this development and the general public.

24 3. The requirements of the California Environmental Quality Act (CEQA) have been
25 satisfied through preparation of an Expanded Initial Study/Mitigated Negative
26 Declaration to avoid or reduce to a level of insignificance, potential environmental
27 impacts generated by the proposed Willow Glen project.

29 4. The portion of Lynch Creek traversing the project site has been previously zoned
30 to Flood Way and Flood Plain Combining District.

32 IF ANY SECTION, subsection, sentence, clause or phrase or word of this ordinance is for
33 any reason held to be unconstitutional by a court of competent jurisdiction, .such decision
34 shall not affect the validity of the remaining portions of this ordinance. The City Council
35 of the City of Petaluma hereby declares that it would have passed and adopted this
36 ordinance and each and all provisions thereof irrespective of the fact that any one or more
37 of said provisions be declared unconstitutional.
