Seconded by: Matt Nla~uire AN ORDINANCE OF THE COUNCIL OF T>FIE CITY OF PETALLTM~I REPEALING 5ECTIOl~T 11.56.090, "SPECIAL PERMITS FOR USE OF METER SPACE" OF CIIAPTER 11.5b "PARING METERS" OF TIIE CITY OF PETALiTMA MiJ1VICIPAL CODE AND ADDING SECTION 11.44.160 "SPECIAL PERMITS FOR ITSE OF PARKING SPACE" T'O CIIAPTER 11.44 "RESTRICTED OR PROIIIBITED PARKING" BE IT ORDAINED BY THE COUNCIL OF THE CITY OF PETALUMA AS FOLLOWS: Section 1. Section 11.56.090 of Chapter 11.56 "Parking Meters" of the Petaluma Municipal Code is hereby repealed in its entirety. Section 2. Section 11.44.160 is hereby added to Chapter 11.44 "Restricted or Prohibited Parking" of the Petaluma Municipal Code and shall read as follows: 11.44.160 Special hermits for use of parking spaces. A. Construction Parking Permits. Any person who is engaged in construction or repair work on a building or in a street in a parking zone designated as provided in Sections 11.44.030 through 11.44.060, and who will require for such work a vehicle be used for tools or equipment stored in or fixed on such vehicle, may apply to the Finance Department for a permit to park such vehicle in such parking zone during the time actually engaged in such construction or repair work. The permit shall be issued for a maximum of thirty (30) days at a time and may be renewed. A daily fee shall be set by resolution of the City Council. B. Reserved Parking Permits. Reserved parking permits .may be obtained for all-day parking facilities or portions thereof, as are designated by resolution for permit parking. Any person may apply to the Finance Department for such a permit, which shall be issued for a set period and a fee which shall be set by resolution of the City Council. C. Residential Parking Permits. Persons who have as their primary residence a house or apartment located in the Parking Meter Zones, as defined in Section Ord. 2036 NCS Page 1 of 2 11.56.010 of Chapter 11.56 and have no off-street parking available, may obtain an annual parking permit from the Finance Department when such person provides adequate proof of residence. A fee for each permit shall be set by resolution of the City Council. Section 3. If any section, subsection, sentence, clause or phrase or word of this ordinance is for any reason held to be unconstitutional by a court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance. The City Council of the City of Petaluma hereby declares that it would have passed and adopted this ordinance and each and all provisions thereof irrespective of the fact that any one or more of said provisions be declared unconstitutional. Section 4. The City Clerk is hereby directed to publish/post this ordinance for the period and in the manner required by the City Charter.
