18 BE IT ORDAINED BY THE COUNCII. OF THE CITY OF PETALUMA AS
19 FOLLOWS:

21 Section 1. The City Council finds that the Planning Commission filed with the City
22 Council on August 27, 1996 its report as set forth in its minutes of August 27, 1996,
23 recommending the adoption of an amendment to Zoning Ordinance No. 1072 N.C.S., by
24 reclassifying and rezoning from PUD (Corona Club Subdivision Planned Unit
25 Development) to PUD (Corona Creek II Subdivision Planned Unit Development), certain
26 land more particularly described as AP No. 137-061-015, consisting of 10.96 acres
27 situated at 464 Corona Road.

29 Section 2. The City Council further finds that said Planning Commission held a public
30 hearing on said proposed amendment to Zoning Ordinance No 1072 N.C.S., on August
31 27, 1996, after giving notice of said hearings in the manner, for the period and in the form
32 required by said Ordinance No. 1072 N.C.S.

34 Section 3. Pursuant to the provisions of Zoning Ordinance No. 1072 N.C.S., the City
35 Council finds that the proposed amendment to Zoning Ordinance No. 1072 N.C.S., to
36 reclassify and rezone Assessor's Parcel No. 137-061-015, known as the Corona Club
37 Subdivision Planned Unit Development (PUD) to the Corona Creek II Subdivision PUD
38 District is in general conformity with the Petaluma General Plan.

40 Section 4. The public necessity, convenience and general welfare clearly permit and
41 will be furthered by the proposed amendment to the Zoning Ordinance, reclassifying and
42 rezoning Assessors Parcel No. 137-061-015 to PUD for the Corona Creek II Subdivision.

44 Section 5. The requirements of the California Environmental Quality Act (CEQA)
45 have been satisfied through the preparation and certification of an Environmental Impact

Report for the Corona EIy Specific Plan (certified, approved and adopted by Resolution
No. 89-122 N.C.S.) which adequately addresses the potential environmental impacts
associated with the Corona Creek II Subdivision project, and no further environmental
analysis is necessary pursuant to Section 15182 of the CEQA Guidelines.
Section 6. Pursuant to the provisions of zoning Ordinance No. 1072 N.C.S., and
based upon the evidence it has received and in accordance with the findings made, the City
Council hereby adopts an amendment to said Zoning Ordinance No. 1072 N.C.S., so as to
reclassify and rezone said property herein referred to, in accordance with the
recommendations of the Planning Commission.
Section 7. The City Clerk is hereby directed to post this Ordinance for the period and
in the manner required by the City Charter.
IF ANY SECTION ,subsection, sentence clause or phrase or word of this ordinance is for
any reason held to be unconstitutional by a court of competent jurisdiction, such decision
shall not affect the validity of the remaining portions of this ordinance. The City Council
of the City of Petaluma hereby declares that it would have passed and adopted this
ordinance and each and all provisions thereof irrespective of the fact that any one or more
of said provisions be declared unconstitutional.
