HomeMy WebLinkAboutOrdinance 2028 N.C.S. 09/03/1996~~ E~E~~@~~E AY 1 ~.E ®ItDINANCE N®. 2 0 2 8 N.C.S. 12 Introduced by Councilmember 13 14 Matt N1a~uire 15 16 Seconded by Councilmember Vice Nlayor Stompe 17 AN ®RDINANCE AMENDING TITLE 8 ®F THE PETAI,IJMA MiTNICIPAI. 18 C®DE CHAPTER 8.24 T® INCLiJDE CE1tTAIN RESIDENTIAL PItOPEItTY 19 iTNDEIt THIS MAINTENANCE ®RDINANCE 20 21 WHEREAS, the City Council has determined that the visual appearance of residential 22 rental properties within the City is important to the economic vitality of the community; and 23 24 \1VHEREAS, residential rental properties that are not adequately maintained are 25 detrimental to the health and welfare of the community; and 26 27 WHEREAS, it is the intent of the City Council that the provisions of this ordinance shall 28 apply to all residential rental properties containing three or more residential units on a parcel. 29 30 NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Petaluma as 31 follows: 32 33 Section fl. Chapter 8.24 of the Petaluma Municipal Code is hereby amended to read as follows: Ord. 2028 NC5 1 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 Chapter 8.24 Property Maintenance Ordinance Sections: 8.24.030 Property Maintenance Standards 8.24.010 Statement of Intent The purpose of this ordinance is to prevent the visual blight that may often occur when commercial, industrial or residential rental buildings and lots are not adequately maintained and allowed to deteriorate to an unacceptable condition of public appearance. Such blight is a detriment to the health and welfare of the City and can negatively affect the vitality of the local business community. The measures contained herein are intended to ensure that the building and grounds of any improved site (whether occupied or not) or vacant lot in a commercial, er industrial or residential zone are maintained at an appropriate level in order to minimize vandalism, accumulation of trash, deterioration of the landscaping or other occurrences that contribute to the blighted appearance of the property and the overall area over time. 8.24.020 Definitions A. Building: shall mean any structure or structures used for commercial, industrial or residential rental use, including accessory structures. C. Property: shall mean improved or vacant commercial, industrial or residential rental real property including, but not limited to, front yards, side yards, rear yards, driveways, parking areas, sidewalks, fences and any structures on the property. D. Residential Rental: shall mean improved residential real property containing three (3) or more residential units on a single parcel of land. Ord. 2028 NCS 2 Page 2 of4 1 2 8.24.030 Business Maintenance Standards 3 4 It shall be unlawful for any property owner in any commercial, industrial or residential 5 zone to maintain or to allow to be maintained such property in such a manner that any of 6 the following conditions are found to exist on the property. These conditions shall apply 7 to vacant undeveloped properties in any commercial or industrial zone, and to any 8 developed property or portion thereof on which a commercial or industrial business or 9 businesses may be operating or which have ceased operation, and to any residential rental 10 property. 11 12 J. Buildings or portions of buildings which are abandoned, boarded up, partially 13 destroyed, or left in a state of partial construction, and such buildings which are 14 unpainted or where the paint on the building exterior is mostly worn off and visible 15 from a public street. 16 17 Section 2: If any section, subsection, sentence, clause or phrase or word of this ordinance is 18 for any reason held to be unconstitutional by a court of competent jurisdiction, 19 such decision shall not affect the validity of the remaining portions of this 20 ordinance.
