l4 AN ORDINANCE OF THE CITY OR PETALUMA AMENDING ZONING
15 ORDINANCE NO. 1072 N.C.S. AS AMENDED, BY RECLASSIFYING AND
16 REZONING A 4.98 ACRE PARCEL LOCATED 901 AND 911 SUNNY SLOPE ROAD
17 TO A PLANNED UNIT DISTRICT TO ALLOW FOR DEVELOPMENT OF THE
18 PAMELA PLACE II PROJECT AP No.'s: 019-201-010, 011, 012, 017 and 018

20 BE IT ORDAINED BY THE COUNCIL OF THE CITY OF PETALUMA AS
21 FOLLOWS:

23 Section 1: The City Council finds that the Planning Commission filed. with the City
24 Council on August 5, 1996, its report set forth in its minutes of July 9, 1996 (File
25 #TSM96003) recommending the adoption of an amendment to the Zoning Ordinance No.
26 1.072, as amended, by reclassifying and rezoning certain lands being more particularly
27 described as Assessor's Parcel Numbers 019-201-0 l 0, 011, 012, 017 and 018; a 4.98
28 acre site located at 901 and 911 Sunny Slope Road.

30 Section 2: The City Council further finds that said Planning Commission held public
31 hearings on said proposed amendment on June 25, 1996 and July 9, 1996 after giving
32 notice of said hearings, in the manner, for the period and in the form required by said
33 Ordinance No. 1072 N.C.S., as amended.

35 Section 3: The City Council further finds that the requirements of the California
36 Environmental Quality Act have been satisfied through the preparation of an Initial Study
37 which indicates that the proposed amendment, as mitigated through the adoption of a
38 Mitigated Negative Declaration pursuant to Resolution No. g~_~4~ N.C.S. will not
39 result in a significant impact on the environment.

41 Section 4: the public necessity, convenience and general welfare clearly permit and will
42 be furthered by the proposed amendment to the Zoning Ordinance, reclassifying and
43 rezoning the Pamela Place II Subdivision to PUD.

45 Section 5: Pursuant to the provisions of Zoning Ordinance No. 1072 N.C.S., as amended,
46 the City Council finds the following:

2 Findings for Rezoning to PUD
3 1. The City Council finds that the proposed Amendment to the PUD Zoning District
4 established as part of the Sunny Slope Annexation for APN's 019-201-010, 011, 012,
5 017, 018 is in conformity with the density range of the Suburban General Plan
6 Designation and the policies of the General Plan. which encourage sensitive
7 development of infill and hillside sites.
8 2. The City Council finds that based on the original analysis of the Sunny Slope
9 Annexation and Assessment District, the public necessity, convenience and general
10 welfare will be furthered by the proposed amendment to the Zoning Ordinance to
1 1 reclassify this site to Planned Unit Development for Pamela Place II.
12 3. The City Council finds that the requirements of the California Environmental Quality
13 Act (CEQA) have been satisfied through the preparation of an Initial Study/Mitigated
14 Negative Declaration to avoid or reduce to a level of insignificance, potential adverse
15 environmental impacts generated by the proposed Pamela Place II PUD.

17 IF ANY SECTION, subsection, sentence, clause or phrase or word of this ordinance is

for any reason held to be unconstitutional by a court of competent jurisdiction, such
decision shall not affect. the validity of the remaining portions of this ordinance.. The City
Council of the City of Petaluma hereby declares that it would have passed and adopted
this ordinance and each and all provisions thereof irrespective of the fact that any one or
more of said provisions be declared unconstitutional.
