AN ORDINANCE OF THE CITY OF PETALUMA AMENDING ZONING
ORDINANCE NO. 1072 N.C.S. AS AMENDED, BY RECLASSIFYING AND
REZONING 4.29 ACRE PARCEL LOCATED AT THE SOUTHERN CORNER OF
THE REISLING ROAD/SANDSTONE DRIVE INTERSECTION TO A PLANNED
UNIT DISTRICT TO ALLOW FOR DEVELOPMENT OF THE GRAYSTONE PLACE
RESIDENTIAL PROJECT; AP NO. 137-070-063
BE IT ORDAINED BY THE COUNCII, OF THE CITY OF PETALUMA AS
FOLLOWS:
21 Section 1. The City Council finds that the Planning Commission filed with the City
22 Council on June 3, 1996, its report set forth in its minutes of May 14, 1996 recommending
23 the adoption of an amendment to the Zoning Ordinance No. 1072 N.C.S., as amended, by
24 reclassifying and rezoning certain lands being more particularly described as Assessor's
25 Parcel Number 137-070-063; a 4.29 acre site located at the southern corner of Reisling
26 Road/Sandstone Drive intersection.

28 Section 2. The City Council further finds that said Planning Commission held public
29 hearings on said proposed amendment on May 14, 1996, after giving notice of said
3o hearings, in the manner, for the period and in the form required by said Ordinance No.
31 1072 N. C. S_, as amended.

33 Section 3. The City Council further finds that the requirements of the California
34 Environmental Quality Act have been satisfied through the preparation of an EIR in
35 conjunction with the CoronalEly Specific Plan and through the adoption of a Mitigated
36 Negative Declaration in conjunction with the Graystone Creek Subdivision.

38 Section 4. Pursuant to the provisions of Zoning Ordinance No. 1072 N.C.S. as amended
39 the City Council finds as follows:

43 1. The proposed Amendment to Zoning Ordinance No. 1072 N.C.S., to reclassify
44 and rezone Assessor's Parcel No. 137-070-063, known as Graystone Place
45 Subdivision, to Planned Unit Development (PUD) district is in general conformity
46 with the Petaluma General Plan.

2. The public necessity, convenience and general welfare clearly permit and will be
furthered by the proposed Amendment to the Zoning Ordinance, reclassifying and
rezoning the Graystone Place Subdivision to PUD.
3. The proposed PUD Development Plan has complied with the requirements of
CEQA through the preparation and certification of the EIR in conjunction with the
adoption of the CoronalEly Specific Plan and the adoption of the Mitigated
Negative Declaration prepared for the Graystone Creek Subdivision by the City
Council for this project site which addresses the potential environmental impacts
associated with its development, and no further environmental analysis is
necessary.
IF ANY SECTION, subsection, sentence, clause or phrase or word of this ordinance is for
any reason held to be unconstitutional by a court of competent jurisdiction, such decision
shall not affect the validity of the remaining portions of this ordinance. The City Council
of the City of Petaluma hereby declares that it would have passed and adopted this
ordinance and each and all provisions thereof irrespective of the fact that any one or more
of said provisions be declared unconstitutional.
