Introduced by Councilman Seconded by Councilman Nancy Read Mary Stompe AN ORDINANCE OF THE CITY OF PETALUMA AMENDING ZONING ORDINANCE NO. 1072 N.C.S. AS AMENDED, BY RECLASSIFYING AND REZONING A 6.7f ACRE PARCEL LOCATED BETWEEN CAPRI AVENUE AND CAPRI CREEK AND SOUTH OF MARIA DRIVE TO A PLANNED UNIT DISTRICT TO ALLOW FOR DEVELOPMENT OF THE WOODSIDE VILLAGE RESIDENTIAL, PROJECT; AP No. 13b-061-027 BE IT ORDAINED BY THE COUNCIL OF THE CITY OF .PETALUMA AS FOLLOWS: Section 1. The City Council finds that the Planning Commission filed with the City Council on June 3, 1996, its report set forth in its minutes of May 14, 1996 (File #TSM96002) recommending the adoption of an amendment to the Zoning Ordinance No. 1072 N.C.S., as amended, by reclassifying and rezoning certain lands being more particularly described as Assessor's Parcel Number 136-061-027; a 6.7± acre site located between Capri Avenue and Capri Creek and south of Maria Drive. Section 2. The City Council further finds that said Planning Commission held public hearings on said proposed amendment on March 26, 1.996, and on May 14, 1996, after giving notice of said hearings, in the mamier, for the period and in the form required by said Ordinance No. 1072 N.C.S., as amended. 1 Ord. 2016 NCS Page 1 of 3 pages „ ., ~, ..f l Section 3. The City Council further finds that the requirements of the California 2 Environmental Quality Act have been satisfied through the preparation of an Initial Study 3 which indicates that the proposed amendment, as mitigated through the adoption of a 4 Mitigated Negative Declaration pursuant to Resolution No. 96-166 N.C.S. will not result 5 in a significant impact on the environment. 6 7 Section 4. Pursuant to the provisions of Zoning Ordinance No. 1072 N.C.S. as amended 8 the City Council finds as follows: 9 t0 PUTD Rezoning Findings: u 1. The proposed Amendment to Zoning Ordinance No. 1072 N.C_S., to reclassify 12 and rezone Assessor's Parcel No. 137-061-027, known as Woodside Village ~ 3 Subdivision, to Planned Unit Development (PUD) district is in general conformity 14 with the Petaluma General Plan. 15 t6 2. The public necessity, convenience and general welfare clearly permit and will be 17 furthered by the proposed Amendment to the Zoning Ordinance, reclassifying and 18 rezoning the Woodside Village Subdivision to PUD. 19 20 3. The proposed PUD Development Plan has complied with the requirements of 21 CE.QA through the preparation and certification of the Mitigated Negative 22 Declaration prepared and adopted (Resolution No. 96-166N.C.S.) by the City 23 Council for this project which addresses the potential environmental impacts 24 associated with its development, and no further environmental analysis is 25 necessary. 26 27 IF ANY SECTION, subsection, sentence, clause or phrase or word of this ordinance is 28 for .any reason held to be unconstitutional by a court of competent jurisdiction, such 29 decision shall not affect the validity of the remaining portions of this ordinance.
