AMENDING ZONING ORDINANCE NO. 1072 N.C.S. BY RECLASSIFYING
AND REZONING CERTAIN PROPERTIES KNOWN AS THE dVEST VIEW
ESTATES SUBDIVISION RESIDENTIAL DEVELOPMENT PROJECT FROM
R-1 6,500 AND R-1 20,000 TO PUD (PLANNED UNIT DEVELOPMENT)
AP NOS. 006-470-010; 006-480-003, 005, 011, 012, 016, 031
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF PETALUMA AS
FOLLOWS:
21 Section 1. The City Council finds that the Planning Commission filed with the City
22 Council on April 23, 1996, its report as set forth in its minutes of November 14, 1995,
23 December 5, 1995, March 12, 1996, and April 23, 1996, recommending the adoption of
24 an amendment to Zoning Ordinance No. 1072 N.C.S., by reclassifying and rezoning from
25 R-1 6,500 and R-1 20,000 to PUD (Planned Unit Development), certain lands more
26 particularly described as AP Nos. 006-470-010, 006-480-003, 005, 011, 012, 016, 031,
27 consisting of 21.63 acres situated on Bodega Avenue between N. Webster St. and Ruth
28 Ct..

30 Section 2. The City Council further finds that said Planning Commission held a public
31 hearing on said proposed amendment to Zoning Ordinance No. 1072 N.C.S., on
32 November 14, 1995, December 5, 1995, and March 12, 1995, after giving notice of said
33 hearings in the manner, for the period and in the form required by said Ordinance No.
34 1072 N.C.S..

36 Section 3. Pursuant to the provisions of Zoning Ordinance No. 1072 N.C.S., the City
37 Council finds that the proposed amendment to Zoning Ordinance No. 1072 N.C.S., to
3s reclassify and rezone Assessor's Parcel Nos. 006-470-010; 006-480-003, 005, 011, 012,
39 016, and 031 known as the West View Estates Subdivision, to Planned Unit Development
40 (PUD) is in general conformity with the Petaluma General Plan.

42 Section 4. The public necessity, convenience and general welfare clearly permit and
43 will be furthered by the proposed amendment to the Zoning Ordinance, reclassifying and
44 rezoning the West View Estates Subdivision to PUD.

1 Section 5. The requirements of the California Environmental Quality Act (CEQA)
2 have been satisfied through preparation of an Initial Study and adoption of a Mitigated
3 Negative Declaration as set forth in Resolution No. 96-150 N.C.S. to avoid or reduce to a
4 level of insignificance, potential impacts generated by the proposed West View Estates
5 PUD.

7 Section 6. Pursuant. to the provisions of Zoning Ordinance No. 1072 N.C.S., and
8 based upon the evidence it has received and in accordance with the findings made, the
9 City Council hereby adopts an amendment to said Zoning Ordinance No. 1072. N.C.S., so
1 o as to reclassify and rezone said property herein referred to, in accordance with the
11 recommendation of the Planning Commission.

13 Section 7. The City Clerk is hereby directed to post this Ordinance for the period and
14 in the manner required by the City Charter.

16 IF ANY SECTION, subsection, sentence, clause or phrase or word of this ordinance is
17 for any reason held to be unconstitutional by a court of competent jurisdiction, such
18 decision shall not affect the validity of the remaining portions of this ordinance. The City
19 Council of the City of Petaluma hereby declares that it would have passed and .adopted
20 this ordinance and each and all provisions thereof .irrespective of the fact that any one or

more of said provisions be declared unconstitutional.
