l l AN ORDINANCE AMENDING SECTION 14-419 OF THE M-L, LIGHT
12 INDUSTRIAL DISTRICT TO ESTABLISH MEDICAL OFFICE USES OF A
l3 LIMITED NATURE AS A CONDITIONAL USE

15 BE IT ORDAINED BY THE COUNCIL OF THE CITY OF PETALUMA AS
l6 FOLLOWS:

I8 Section 1. On March 26, 1996 the Planning Commission held a duly notice public
19 hearing on the proposed amendment to the City of Petaluma Zoning Ordinance.

21 Section 2. Following a public hearing, the Planning Commission recommended
22 approval of the amendment to the. Petaluma Sign Ordinance.

24 Section 3. The City Council finds that the amendment is exempt from the
25 requirements of the California Enviromnental Quality Act (CEQA) pursuant to State
26 Guidelines or City of Petaluma recognized legal holidays Section 15061(b)(3).

28 Section 4. The City Council finds that the proposed Zoning Ordinance Amendment
29 to allow for medical office uses of a limited nature conforms to the Petaluma General
3o Plan in that the activity and operation of the use is similar to those uses specifically listed
31 in the Industrial Land Use description. In addition, the allowance for limited medical
32 uses also will not significantly impact available industrial space and/or land.

34 Section 5. The City Council finds that the proposed Zoning Ordinance Amendment
35 to allow for medical office uses of a limited nature does not pose any threat to the public
36 health, safety or welfare, because the overall scope and intensity of limited medical office
37 uses is relatively low. In addition, the proposed amendment will not create objectionable
38 odors, noise impacts or nuisance related impacts.

40 Section 6. The City Council finds that the proposed Zoning Ordinance Amendment
4l to allow for medical office uses of a limited nature conforms with the M-L, Light
42 Industrial Zoning District of the Petaluma Zoning Ordinance in that the expansion of the
43 conditional uses will not detract from the overall purpose of this District which is to
44 provide for light industrial uses including limited executive and administrative office
45 uses.

NOW, THEREFORE BE IT ORDAINED that the City Council amends Section 14-419
of the Petaluma Zoning Ordinance as follows:
Section 14419 Medical office uses of a limited nature (not more than 1,500 sduare feet of
total floor area; not more than 1 practitioner and 2 emplo, e~esl.
IF ANY SECTION, subsection, sentence, clause or phrase or word. of this ordinance is
for any reason held to be unconstitutional by a court of competent jurisdiction, such
decision shall not affect the validity of the remaining portions of this ordinance. The City
Council of the City of Petaluma hereby declares that it would have passed and adopted
this ordinance and each and all provisions thereof irrespective of the fact that any one or
more of said provisions be declared unconstitutional.
