SUBJECT: Resolution Accepting Completion of the Mountain View Sewer Main
Replacement (Petaluma Blvd. South to Purrington Road),,Project
RECOMMENDATION.
It is recommended:that the City Council adopt the attached-Resolution accepting completion of
the Mountain View Sewer Main Replacement (Petaluma Blvd. South to Purrington Road)
Project.
BACKGROUND
The project met the Regional Water'Quality Control:Board's mandatory enforcement directive
after sanitary sewer overflows(SSOs)were reported in 2008. The project involved replacement
of 28 manholes and approximately 5,200 linear feet of 6,,8�and 12-inch vitrified clay (VCP)
sewer mains on Mountain View Avenue from Petaluma Boulevard South to Purrington Road
(see attached location map). Bids were opened on September 26,:2011. On October 17, 2011,
the City Council awarded the construction contract to Team Ghilotti, Inc. of Petaluma, CA, in
the amount of$841,049, and approved a project budget of$1,401,049:. Construction was
successfully completed on Marl 1;2012-.
The proposed action meets :Council Goal: "Plan for and implement=priority capital projects as
funding permits".
DISCUSSION
•
The final construction contract cost is $866,609:89, which includes change+orders totaling
$34,67289; The approved project budget established a change order contingency of$200,000
for unforeseen conditions. Change orders included modifications to manholes and laterals due to
unseen underground conditions;,resolving conflicts with existing storm drains and unmarked
PG&E gas lines;.and,extra,paving to match the existing street_, City staff successfully negotiated
reimbursement from PG&E for the=extra work incurred due to unmarked gas lines in the amount
of$17,239: Project costs included $175,000 for engineering and design servicesWith GHD,

approximately $56,000 for constructton;;i'nspectiomperformed byPublic Works & Utilities staff
and $15;500 for geotechnical and materials•testingwnh Miller Pacific, Inc. There are no
disputed claiins,and the project was completed without any significant incidences.
FINANCIAL IMPACTS •
• The Mountain View Sewer Main Replacement (Petaluma Blvd. South to Purrington Road),
Project Number C66401005, was-approved-by City Council in the amount of$1,401,049. With
the design, construction contract,.change order contingency, construction inspection, and
' keotechnical and materials testing, the total cost for the•projectwas $1,113,110. The City has
been reimbursed $1 7,239 for costs:associated with,unmarked gas lines, leaving $3,05,178 as the
current project account.balance. -At project closeout, all remaining funds will be returned to the
Wastewater CIP fund to be used on future projects..

Following the acceptance of the project, the City Clerk will file a Notice of Completion with the
Sonoma County Recorder and the Finance Divisioii will release the retention money
($86,660.99) to-the contractor-within-60 days.

RESOLUTION ACCEP-TING'.COMPLETION.OF THE
MOUNTAIN VIEW SEWER MAIN:REPLACEMENT (PETALUMA BLVD. SOUTH TO
PURRINGTON ROAD)
•
WHEREAS, in accordance with Section 68 of Article'X of the City of Petaluma Charter,
Section.20162 of the California Public Contract Code and other applicable laws, the City of
Petaluma solicited bids for the Mountain View Sewer Main Replacement (Petaluma Blvd. South
to PurringtonRoad) ("Project");and
WHEREAS, bids for the Project were opened on September 26, 2011 in accordance with
California Public Contract Code Section 4104.5 and other_applicable;laws; and
WHEREAS, the apparent low bidder for the Project was Team Ghilotti, Inc.(TG1) with a
bid of$841,049; and
•
WHEREAS, by Resolution No. 2011-149 N.C.S..adopted October 17, 2011, the City
Council of the City of Petaluma-found'the bid of$841,049 fo'r4heP'roject to be the lowest
responsive bid; awarded the Project to Team Ghilotti, Inc. in the amount of$841,049
conditioned on TGI's timely executing the Project contract and submitting all required
documents; and authorized and directed the City Manager.to sign the Project contract on behalf
of the City upon such timely submission and to execute on behalf of the any amendments to
the ProJect contract that are necessary to effectively complete the project and/or to realize the
Project and/or cost benefits for the:City; and
WHEREAS, the following,change orders (CO) affecting the Project amount have been
approved:
CO No. 1: Differing site conditions, storm drain conflicts&.manhole mods. $ 6,483.17
CO No. 2: Extra Work due to unmarked'PG&E gas lines $17,238.99
CO No. 3: Differing site conditions,:lateral relocation and additionabipaving $10,950.73
Total Change Orders: $34,672.89; and
WHEREAS, the final contract amount as amended including all change orders is
$866,609:89; and
WHEREAS, City staff has inspected the Project and determined that it has been
completed in accordance with the contract requirements subject to the Contractor's continuing
• warranty and other obligations pursuant to the contract;-and
WHEREAS, based on the foregoing, staff recommends acceptance of the Project on
behalf of the City;

NOW,THEREFORE, BE IT RESOLVED by tl e'City Connellof the City of Petaluma
as follows:
1. The contract entitled Mountain View Sewer'Main Replacement (Petaluma Blvd.
South to Purrington_Road), City Project C66401005 with a final contract
amount of$866,609.89, is accepted as complete subject to the Contractor's
continuing warrantyand other obligations pursuant to the contract.
2. . The City Clerk/RecordingSecretary is hereby authorized and directed to file a Notice
of Completion concerning the Project with the Sonoma County Clerk's Office within
ten(10) days of the date of this Resolution. •
3. Staff is hereby authorized and directed to,release all undisputed retention not subject
to pending change orders within sixty.(60)days•ofthe date of this Resolution and in
accordance with the terms;of the Project contract, the Petaluma City Charter,
California Public Contract Code Section 7107 and applicable law.
