The Petaluma City Council, via Development Agreements, required certain 21 developers of the Corona Ely Specific Plan Area to fulfill their General Plan obligations, as 2 2 defined in Policy 10, Program 11 of the Housing Element, by dedicating land to the City for 2 3 the purpose of providing affordable housing. 24 25 2 5 Section 2. The McBail Company dedicated the four-plus acre Wisteria Site, APN 137- 2 7 070-060, which legal description is attached as Exhibit A to this ordinance. 28 29 3 o Section 3. The nonprofit company, Burbank Housing Development Corporation, will 31 develop the site into a 28-manufactured home subdivision, using manufactured housing. 32 33 3 4 Section 4. The City of Petaluma and Burbank Housing have entered into an Option 35 A~reement stipulating that the project will be completed by 1997, attached as E~ibit B to 3 6 this Ordinance. 37 38 3 9 Section 5. Burbank Housing will secure all financial backing to complete the 4 o development in the timeframe outlined in the Option Agreement. 41 42 43 IF ANY SECTION, subsection, sentence, clause, phrase or word of this Ordinance is for 44 any reason held to be unconstitutional by a court of competent jurisdiction, such decision 4 5 shall not affect the validity of the remaimng portions of this Ordinance.
