HomeMy WebLinkAboutOrdinances 1991 10/02/1995ATE 'OF ORDINANCE NOV 1 1995 ORDINANCE NO. 1991 NCS 2 INTRODUCED BY: SECONDED BY: 3 Councilmember Stompe Vice Mayor Shea a AN ORDINANCE ESTABLISHING A PRECISE PLAN LINE OVER CERTAIN PROPERTY FOR THE RESERVATION OF 6 FUTURE RIGHTS -OF -WAY 7 FOR THE PROPOSED RAINIER CROSS TOWN CONNECTOR s AND INTERCHANGE 9 BE IT ORDAINED by the City Council of the City of Petaluma as follows: to Section 1. That the City Council finds that the Planning Commission after holding I I public hearing pursuant to Chapter 13.20.070 of the Municipal Code, filed with the City 12 Council on the 25th day of July, 1995, its reports and affirmative recommendation relative to 13 the establishment of precise plan line for the Rainier Cross Town Connector and Interchange, 14 and that said recommended precise plan line is further designated and shown on that certain s description (metes and bounds description is avaiiable in the office of the City Clerk). 16 Section 2. The City Council finds that the notice of public hearing required to be held 17 by the City Council upon receipt of the Planning Commission report and recommendation and is as set forth in Resolution No. 95-229 NCS duly adopted by this Council on August 21, 1995, 19 was given in the manner, for the period and in the form required by Chapter 13.20.090 of the 20 Municipal Code. 21 Section 3. The City Council further finds that, after public hearing on September 18, 22 1995, no protests or objections to said proposed precise plan lines which could be sustained 23 were received: and that changes and modifications were made to said proposed precise plan 24 line and that the public safety, comfort, convenience, interest and welfare required by the 2, adoption of the recommended precise plan lines hereinbefore described, and that the Ord. 1991 NCS Page 1 of 2 pages I recommendation of the Planning Commission is consistent with the purposes of Chapter 13.20 2 of the Municipal Code. 3 Section 4. If any section, subsection, sentence, clause or phrase or word of this 4 ordinance is for any reason held to be unconstitutional by a court of competent jurisdiction, 5 such decision shall not affect the validity of the remaining portions of this ordinance. The City 6 Council of the City of Petaluma hereby declares that it would have passed and adopted this 7 ordinance and each and all provisions thereof irrespective of the fact that any one or more of 8 said provisions be declared unconstitutional. 9 Section 5.
