~ BE IT ORDAINED by the City Council of the City of Petaluma as follows:
~o Section 1. That the City Council finds that the Planning Commission after holding
~ ~ public hearing pursuant to Chapter 13.2Q.Q70 of the Municipal Code, filed with the City
~~ ~ouncil on the 25th day of July, 1995, its reports and affirmative recommendation relative to
~~ the establishment of precise plan line for the Rainier Cross Town Connector and Interchange,
~-~ and that said recommended precise plan line is further designated and shown on that certain
;_, description (metes and bounds description is avaiiable in the office of the City Clerk).
~~ Section 2. The City Council finds that the notice of public hearing required to be held
» by the City Cauncil upon receipt of the Planning Commission report and recommendation and
~s as set forth in Resolution No. 95-229 NCS duly adopted by this Council on August 21, 1995,
~~ was given in the manner, for the period and in the form required by Chapter 13.20.090 of the
,o Municipal Code.
~~ Section 3. The City Council further finds that, after public hearing on September 18,
~~ 1995, no protests or objections to said proposed precise plan lines which could be sustained
~~ were received: and that changes and modifications were made to said proposed prvcise plan
za ]ine and that the public safety, comfort, convenience, interest and welfare required by the
~, adoption of the recommended precise plan lines hereinbefore described, and that the

~ recommendation of the Planning Commission is consistent with the purposes of Chapter 13.20
2 of the Municipal Code.
~ Section 4. If any section, subsection, sentence, clause or phrase or word of this
a ordinance is for any reason held to be unconstitutional by a court of competent jurisdiction,
s such decision shall not affect the validity of the remaining portions of this ordinance. The City
~ Council of the City of Petaluma hereby declares that it would have passed and adopted this
~ ordinance and each and all provisions thereof irrespective of the fact that any one or more of
s said provisions be declared unconstitutional.
9 Section 5. The City Clerk is hereby directed to publish this ordinance for the period
~o and in the manner required by the City Charter.
