Section 17.04.010 of the Petaluma Municipal Code is hereby amended to read as follows: 17.04.010 Codes Adopted. There is hereby adopted by the City of Petaluma for the purpose of establishing rules and regulations governing building activity in the 1~~ . I o~ lo Ord. 1998 NCS 1 City, providing for the collection of permit fees, the issuance of 2 permits; the adoption of the latest editions of recognized codes; 3 amendment of such codes, and thus regulate the erection, 4 construction, enlargement, alteration, repair, moving, removing, 5 conversion, demolition, occupancy, use, height and area; including 6 the installation of electrical, gas plumbing and mechanical systems; 7 including regulations applying to the construction of fences, signs, 8 swimming pools, yard drainage systems, grading and excavation of 9 land; and provide for the abatement of unsafe buildings; the 10 following uniform codes: 11 12 A. Uniform BUII.DING Code, 1994 Edition, Volumes 1, 2, 13 and 3, as adopted and published by the International 14 Conference of Building Officials; including all appendices 15 except Volume 1 Appendix Chapter #4, Barriers For 16 Swimming Pools, Spas and Hot Tubs, Volume 1 Appendix 17 Chapter #11, Accessibility and Volume 1 Appendix Chapter 18 #30 Elevators, Dumbwaiters, Escalators and Moving Walks. 19 20 With respect to Uniform Building Code, the following 21 sections shall be included: 22 23 107.5.1.2(a) A Stop Work Order will be issued when: 24 a) Work is being done or has been done without a 25 permit. 26 b) Work being done is beyond the scope of the issued 27 permit. 28 c) Work being done does not match approved plans. 29 d) Work being done violates current adopted Building 30 Codes. 31 e) Work being done in violation of Municipal Code and 32 Zoning Ordinance. 33 34 107.5.1.2(b) Violators receiving a Stop Work Order are required 3.5 to respond to the Building Division within 48 hours 36 of the issued notice to receive instructions on how 37 to rescind the order. If no response is forthcoming, 38 within 48 hours, the Building Division will forward a 39 Building Code Violation memo to the City 40 Attorney's Office for abatement action. A copy of 41 the abatement request will be sent to the Planning 42 Department for their use and information. 43 44 107.5.1.2(c) A building permit application with constructions 45 plans and supporting (structural calculations, energy 2 1-~. a. o~ cv Ord. 1998 NCS calculations, handicapped access) documents must 2 be submitted for approval within 15 working days 3 following response to the Building Division. Plans 4 will be reviewed within 15 working days and a 5 correction letter issued or permit application 6 approved. A response to any correction letter must 7 be returned within 15 working days. Five working 8 days will be required to review this second 9 submission and a permit approved for issue. Permits 10 ready for issue must be issued within 5 working 11 days. All construction must be inspected as work 12 progresses and signed off by all (affected) 13 departments within 60 days of building permit 14 issuance. 15 16 107.5.1.2(d) All time limitations for plan check review and 17 construction indicated in the building codes shall not 18 apply to any work indicated in Section (a) that has 19 received a Stop Work Order. 20 21 107.5.1.2(e) An additional fee of double the permit fee shall be 22 added to each permit reflecting a Stop Work Order. 23 24 904.2.1 Fire sprinkler requirements for all Occupancies is 25 amended to read as follows: 26 l. "Automatic sprinkler systems shall be 27 installed and maintained throughout all new 28 buildings 3,500 or more square feet in area 29 or three stories or more in height and in all 30 buildings that will house an occupancy, 31 which in the opinion of the Fire Chief, may 32 create a substantial threat to life or property. 33 The Fire Chief shall be guided by the 34 statistical report of the California Fire 35 Incident Reporting System. Sprinkler 36 systems shall be installed in accordance with 37 the applicable National Fire Protection 38 Association Pamphlet. Sprinkler systems 39 installed in non-residential buildings shall be 40 monitored by automatic transmission of an 41 alarm to an approved central alarm receiving 42 station. For purposes of this section, new 43 building shall mean any building for which 44 site plan and architectural review application Ord. 1998 NCS 3 ~j q. 3 o~r lo was made pursuant to the Zoning Ordinance 2 on or after June 20, 1990." 3 2. "Additions or alterations made to a building 4 so that the combined building exceeds 3,500 5 square feet in area or three stories or more in 6 height shall be required to install and 7 maintain an automatic sprinkler system as 8 described in Subsection 1 throughout the 9 addition or alteration, except that a one-time 10 addition or alteration of an aggregate area. 11 not to exceed 250 square feet to an 12 unsprinklered building shall be exempt from 13 this subsection, if made more than one year 14 after the `Certificate of Occupancy' is 15 issued." 16 3. "It shall not be the intent of this requirement 17 to reduce the more restrictive requirements 18 of Chapter 9 of the Uniform Building Code, 19 1994 Edition. Other requirements for fire 20 sprinkler criteria shall be in accordance with 21 the Uniform Fire Code - City of Petaluma." 22 23 1804.8 Crawl Space Grade and Drainage. 24 Foundation walls shall have a 3" (minimum) 25 diameter through wall pipe to conduct underfloor 26 water to the outside of the building. UnderEloor 27 area shall be graded to the through-wall pipe and 28 exterior grading shall be sloped away from the 29 building. 30 31 Grade level in underfloor areas shall not be lower 32 than exterior grade unless adequate drainage to a 33 positive outfall is provided. Where any water will 34 collect in the underfloor area, an approved drainage 35 system shall be provided. 36 37 106.2(5) Retaining Walls shall be amended to read as stated 38 in Ordinance #1727 N.C.S./1988 for Retaining Wall 39 Standards. 40 41 1503 Roof Covering Material shall be revised to read as 42 stated in Ordinance #1744 N.C.S./1989 for roof 43 covering material to be Class "B" or better. Uniform Code for the Abatement of Dangerous Buildings, 10 1994 Edition, as the same is adopted and published by the 11 International Conference of Building Officials. 12 13 E. Uniform Administrative Code, 1994 Edition, as the same is 14 adopted and published by the International Conference of 15 Building Officials. 16 17 F. Uniform Building Security Code, 1994 Edition, as the same 18 is adopted and published by the International Conference of 19 Building Officials. 20 21 G. Uniform Sign Code, 1994 Edition, as the same is adopted 22 and published by the International Conference of Building 23 Officials, except Section 303 is omitted. 24 25 H. Dwelling Construction under the Uniform Mechanical 26 Code, 1994 Edition, as published by the International 27 Conference of Building Officials. 28 29 I. 1994 Analysis of Revisions to the Uniform Building Codes 30 as the same is adopted and published by the International 31 Conference of Building Officials. 32 33 J. Uniform Mechanical Code, 1994 Edition, as the same is 34 adopted and published by the International Conference of 35 Building Officials and the International Association of 36 Plumbing and Mechanical Officials. 37 38 K. Uniform Plumbing Code, 1994 Edition, as the same is 39 adopted and published by the International Association of 40 Plumbing and Mechanical Officials. 41 42 L. Uniform Swimming Pool, Spa and Hot Tub Code, 1994 43 Edition, as the same is adopted and published by the 44 International Association of Plumbing and Mechanical 45 Officials. Uniform Solar Energy Code, 1994 Edition, as the same is adopted and published by the International Association of Plumbing and Mechanical Officials. N. National Electrical Code, 1993 Edition, as adopted and published by the National Fire Protection Association. All references to permit fees within items A through N above are hereby deleted. The permit fees shall be fixed by the Fee Schedules adopted by the City Council by Resolutions 86- 178 N.C.S. and 87-199 N.C.S. This ordinance supersedes and makes void Petaluma Ordinance 1888 N.C.SJ1992. Section 2. If any section, subsection, sentence, clause or phrase or word of this ordinance is for any reason held to be unconstitutional by a court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance. The City Council of the City of Petaluma hereby declares that it would have passed and adopted this ordinance and each and all provisions thereof irrespective of the fact that any one or more of said provisions be declared unconstitutional. Section 3. Effective Date. This ordinance to take effect January 1, 1996. All plans submitted before January 1, 1996 will be reviewed under 1991 Codes. All plans submitted after January 1, 1996 will be reviewed under the 1994 Building Codes and the 1993 National Electrical Code. Existing subdivisions with approved plans under the 1991 Codes will be allowed to complete that phase of the work, all new phases or models not previously approved will be reviewed under the 1994 Codes. Section 4. The City Clerk is hereby directed to post this ordinance for the period and in the manner required by the City Charter.
