Seconded by Nancv Read ORDINANCE AUT~O~ZING CITY MANAGER TO NEGOTIATE AND EXECiJTE AI.L DOCiT1VIEN~'S R~I,ATING TO I.INI) PROPERTY ON McNEA~t PEN~NSULA BE IT ORDAINED BY THE COLTNCIL OF THE CITY OF PETALUMA AS FOLLOWS: 5ection 1. The 1987 General Plan classifies the subject property, formerly owned by the railroad and currently owned by the Lind's of Jerico Dredging, as a public park. Said property is identified in the draft Petaluma River Access and Enhancement Plan as an area warranting acquisition, preservation, enhancement and development for passive recreational purposes. Section 2. The City Council authorized staffto seek a grant from the Sonoma County Agricultural Preservation and Open Space District to acquire fee title to the property which grant was approved. Section 3. The City has conducted negotiations with the property owner and the Sonoma County Agricultural Preservation and Open Space District resulting in preliminary agreements. Section 4. The City Council finds that acquisition of said parcel and granting of said easement are consistent with the General Plan of the City of Petaluma and are exempt under Section 15316 of the California Environmental Quality Act guidelines because the acquisition and easement are required to establish a future park site. The City Manager is authorized to negotiate and execute all documents related to this action.
